Draft amendments of Labor Standards Law passed the third agenda; heavier fine is imposed to employers who have employees work beyond legal overtime hours

        On 13 June 2011, Taiwan cabinet passed the draft amendment of Labour Standard Law in the third agenda.  It imposes a fine up to NT$ 300,000 to the employers who fails to provide name card for labours, and do not abide by the legislation on working hours, and official holiday.

        On 13 June 2011, Taiwan cabinet passed the draft amendment of Labour Standard Law in the third agenda.  It imposes a fine up to NT$ 300,000 to the employers who fails to provide name card for labours, and do not abide by the legislation on working hours, and official holiday.
According to the law, if the employers fail to provide name card for labours, have employees work beyond 8 hours a day or over 84 hours in 2 weeks, work overtime over than 4 hours a day or 46 hours a month, do not abide by the legislation, deny employees leave, and official holidays etc., will be fined up from the existing range of NT$6,000 to NT$60,000. After a revision of the law in the third agenda, the employers will be fine from NT$ 20,000 to 300,000.
            The revised law also adds a clause regarding announcement of employer’s name. Under the revisions, employers who have employees work beyond legal overtime hours, fail to grant overtime payment or infringe any clause of Labour Standard Law, will be announced the name to the public
 

 

 

 

 

           การแก้ไขกฎหมายในครั้งนี้ ยังเพิ่มข้อกำหนดการประกาศรายชื่อด้วย โดยหากผู้ประกอบการรายใดให้พนักงานทำงานล่วงเวลาเกินกำหนด ไม่จ่ายค่าล่วงเวลา หรือละเมิดข้อกำหนดตามกฎหมายมาตรฐานแรงงาน ชื่อของผู้ประกอบการรายนั้นจะถูกประกาศให้สาธารณชนทราบได้
