Migrant Workers of Three Nationalities Under Exemption Criteria Following Cabinet’s Resolution Can Register Online Starting Today

          The Ministry of Labour has commenced services for employers/establishments to notify a list of migrant workers and migrants to register their personal information online, applicable for the three nationalities (Cambodia, Laos, Myanmar) in the Kingdom without permission. A waiver was approved in the Cabinet’s resolution on December 29, 2020, starting today, January 15, 2021, to February 13, 2021. Beyond this deadline, migrants will not proceed to the next steps and cannot live in Thailand or continue to work.
          Labour Minister Mr. Suchart Chomklin chaired the clarification of the list of migrants to be hire and registered online at the website e-workpermit.doe.go.th. The registration was opened on January 15, 2021. The meeting took place at the Saengsingkaew meeting room, 5th floor, Ministry of Labour. The Labour Minister said that Prime Minister General Prayuth Chan-ocha attaches great importance to the safety of public health, the Thai people, and foreign workers. With the new wave of Covid-19 infections, the number of confirmed cases has increased rapidly in many provinces. The government must, therefore, have strict measures to control and prevent further spread. The action plan is adjusted proactively, including cooperation between government agencies, the private sector, and the public.

          “The Ministry of Labour proposed a guideline for the Cabinet to consider and approve, for the exemption for migrants of the three nationalities (Cambodia, Laos, and Myanmar) to remain in the Kingdom and work legally under special circumstances, that is the new wave of Covid-19 outbreaks. The measure aims to delay the import of migrant workers and alleviate labour shortages faced by employers/establishments while inhibiting the spread of Covid-19 from outside the country. The measure targets three groups of migrants consisting of 1. Migrants that an employer/establishment wishes to hire. 2. An migrant who is not working. 3. A dependent who is the child of such migrant, not over 18 years old. The employer/establishment must provide a list of migrants workers to be hired. Migrants who do not have an employer must provide their personal information online, on the e-workpermit.doe.go.th website. The system will be open from January 15, 2021, to February 13, 2021, as their first step. They will then proceed to health checks, and the purchase of health insurance, apply for a work permit. The system will continue to register non-Thai nationals,” said the Labour Minister.

          The Department of Employment’s Director-General Mr. Suchart Pornchaiwisetkun spoke about applying for a work permit of Cambodian, Lao, and Myanmar nationals according to the Cabinet’s resolution dated December 29, 2020. The process is divided into two cases as follows.
          – Migrant workers with an employer/business establishment, including the accompanying dependent who is the child of the migrant worker, not over 18 years old:
          1. Employers/business establishments shall report the names of migrants online on the e-workpermit.doe.go.th website, attaching a photograph of the worker. They must submit a printed invoice for the work permit payment between January 15, 2021, and February 13, 2021.
          2. Employers/business establishments must bring the migrant worker to be screened for Covid-19 and a health check for the six forbidden diseases prescribed by the Ministry of Public Health. Health insurance for two years must be purchased. The total cost is 7,200. This process must be done by April 16, 2021.
          3. Employers/business establishments must pay the application fee through counter services or Krung Thai Bank for 1,900 Baht and submit an application for the work permit on behalf of the migrant workers online on the e-workpermit.doe.go.th website. The applicant must include an attachment of the medical certificate, evidence of payment, and the application, to prepare a non-Thai citizen profile (pink card) by June 16, 2021.
          4. Employers/business establishments must take the migrant worker to register their history (TorRor. 38/1) and an identity card non-Thai citizen (pink card) with the work permit on the back. They must submit the application as evidence at the Department of Provincial Administration or Bangkok Administration by November 12, 2021. The cost of registering the workers’ history is 20 Baht, and the pink card costs 60 Baht.

          – Migrant workers who do not have an employer/business establishment, including the accompanying dependent who is the child of the migrant worker, not over 18 years old:
          1. The migrant worker shall report their information online on the e-workpermit.doe.go.th website, attaching a photograph of the worker and printed proof of personal information. Services are provided in four languages, including Thai, Cambodian, Laos, and Burmese. This process must be completed between January 15, 2021, and February 13, 2021.
          2. The migrant worker must be screened for Covid-19 and a health check for the six forbidden diseases prescribed by the Ministry of Public Health. Health insurance for two years must be purchased. The total cost is 7,200. This process must be done by April 16, 2021.
          3. The migrant worker must register their history (TorRor. 38/1) at the Department of Provincial Administration or Bangkok Administration by June 12, 2021. The cost of registering the workers’ history is 20 Baht, and the pink card costs 60 Baht (in this stage, the migrant worker has not received the pink card).
          4. The migrant worker shall find an employer and register on the list of migrants on the e-workpermit.doe.go.th website, attaching a photograph and printed document online, to pay for the application and work permit through counter services or Krung Thai Bank. The employer/business establishment must submit an application for the work permit on behalf of the foreigner on the e-workpermit.doe.go.th website, attaching the medical certificate, evidence of payment, and the application, to prepare a non-Thai citizen profile (pink card) by September 13, 2021.
          5. The migrant worker must update their profile for non-Thai citizens and receive an identity card non-Thai citizen (pink card) with a work permit on the back of the pink card with the work permit on the back, at the Department of Provincial Administration or Bangkok Administration by November 12, 2021. Migrants working in the sea fishing business must prepare a Seabook (green book) with the Ministry of Agriculture and Cooperatives. There is a fee of 100 Baht. After the Ministry of Agriculture and Cooperatives has considered it successfully, the foreign will receive a Seabook (green book) as proof used with a pink card to stay and work in the country.
