Taipei Labour Office Reports “Taiwan Resolves New Labour Law Reducing Working Hours Effective as of 1 January 2016”

The Taiwan Legislative Assembly has approved the labour law draft in agenda 3 on reducing the number of working hours a maximum of 84 hours a fortnight to 40 hours per week, or 5 working days to 2 holidays in effect as of the 1st of January 2016 onwards. The newly drafted law requires employers to record time-in and time-out of workers, whereby records up to 5 years must be kept as evidence when audited. Furthermore, employers are not permitted to deny showing such documents when requested by officials, whereby violators of the law will be fined from 90,000 – 450,000 Taiwanese Dollars.

          To minimize impacts from the reduction of working hours outlined in the new labour law, the Executive Council of Taiwan will prepare the following 2 measures including 1) the increase of overtime work from a maximum of 46 hours per month to a maximum of 54 hours per month and 2) the reduction of public holidays from the original 19 days to 12 days (same as Taiwanese government officials), with effect from the 1st January 2016 onwards.
