“Pol.Gen. Adul” Instructs Investigation of Employer on Crane Collapse and SSO to Compensate Workers

        The Labour Minister instructed the Department of Labour Protection and Welfare to investigate the facts for actions against the employer and reiterated for the Social Security Office to take care of compensation and benefits under the Compensation Fund, to the families of the workers who passed away.

        On January 24, 2019, Labour Minister, H.E. Police General Adul Sangsingkeo spoke about the case of the crane collapse while workers were connecting the crane in the construction of a luxury condominium on Rama 3 Road, Bang Phongphang, Yannawa, Bangkok. The accident resulted in 5 deaths including Mr. Witoon Chaimee, Mr. Sin Karnsakul, Mr. Wicha Kameeai, Mr. Tanachok Brikrut and Mr. Termsak Sripitak, and 5 injured people, 4 of whom are Thai and 1 Burmese national. Three of the injured workers were hospitalized at Charoenkrung Pracharak including severely injured Mr. Swing Pansa and Mr. Prarunun Pansa, and Mr. Pairoj Roschum with minor injuries and allowed return home. The remaining 2 injured workers were sent to Lerdsin Hospital including Mr. Min Oo, a Burmese national with minor injuries and allowed to return home, and Mr. Yodrak Tinamas, who was hospitalized at the hospital.
        Pol.Gen. Adul spoke about the Ministry of Labour’s assistance measures whereby the Social Security Office will provide entitled benefits under the Compensation Act (No. 2) B.E. 2561 to the families of employees who have died. This will include funeral expenses of 40,000 Baht, compensating 70 percent of wages for 10 years and families will receive the pension from the Social Security Fund. The injured workers will be provided coverage of medical fees of 50,000 to 1 million Baht in case of being admitted to a public hospital, 70 percent of wages paid from the first day that the employee is unable to work until they can work, but not more than 1 year, compensation for no more than 10 years for loss, no less than 15 years for disability and rehabilitation fees which is divided into professional rehabilitation of 24,000 Baht and medical rehabilitation of 24,000 Baht.
        The Labor Minister instructed the Department of Labour Protection and Welfare to investigate the facts to take action against the employer following the Occupational Safety, Health and Working Environment Act 2011, Section 14. The section refers to the case of employers permitting employees to work in conditions or environments at risk of harm to life, body, mind or health, whereby the employer must notify employees of potential dangers and provide an operating manual before the employee starts or changes jobs, or changes workplace. Penalties under Section 16 state that the employer shall arrange for executives, supervisors and employees to receive training in occupational health, safety and working environment, to manage and perform this in the workplace safely, in case an employer employs an employees to work, changes job or workplace, or machinery or equipment, which may cause harm to the employee’s life, body, mind or health. In such a case, the employer must provide training for all employees before starting work. Section 56 stated that any employer who fails to comply with Section 16 should be liable to imprisonment for a term not exceeding 6 months, a fine not exceeding 200,000 Baht or both, and Section 57 states that any employer who fails to comply with Section 14 shall be liable to a fine not exceeding 50,000 Baht.
