Labour Minister Assigns Secretariat to Receive Complains from Former Employees of Brilliant Alliance Terminated Without Compensation

          On August 18, 2021, Labour Minister Mr. Suchart Chomklin assigned the Labour Minister’s Secretariat Mr. Suthep Chitayawong, and Advisor to the Labour Minister Dr. Chamlong Chuayrod to receive complaints from former employee representatives of Brilliant Alliance Co., Ltd., in Samut Prakan, where the employer closed the business and terminated employment without compensation. The company is situated at 393 Moo 17, Bang Sao Thong District, Samut Prakan Province. The company’s business is producing women’s undergarments with 1,318 employees. Mr. Suthep said that the government is concerned about all employees in the event of layoffs due to the impact of the COVID-19. Today, he was assigned by Labour Minister Mr. Suchart Chomklin to receive complaints and meet with employees’ representatives to help protect workers in terms of legal benefits from the government and the Ministry of Labour.

          Mr. Suthep said that from the Department of Labour Protection and Welfare’s report, the company had been closed since March 11 due to the impact of COVID-19 and economic conditions. The Labour Inspector from the Samut Prakan Province Labor Protection and Welfare Office issued an order on March 23, 2021, for the company to pay wages for the days that they ordered the employee to stop working in 2021, in the amount of 774,897.24 Baht and to pay wages in lieu of giving an advance notice amounting to 27,004,038.02 Baht. In addition, compensation totaling 212,900,746.87 Baht and annual vacation wages accumulated in the amount of 2,010,180.57 Baht to 1,237 employees, totaling 242,689,862.71 Baht, with an interest of fifteen percent per year until payment is complete. Both the employer and the employee acknowledged the said order on March 26, 2021. The employers did not take action within the given time; therefore, the employee applied for welfare from the Employee Welfare Fund.

          On April 28, 2021, Deputy Prime Minister General Prawit Wongsuwan, who oversees the Ministry of Labour, provided employee allowance of 21,465,350 Baht to alleviate the suffering of 1,161 employees of Brilliant Alliance Co., Ltd., in Samut Prakan, in the event that the employer terminated their employment without compensation. Today, a group of employees of the said company has come to follow up on the progress of compensation which is currently in legal proceedings.
