วันที่ 23 กุมภาพันธ์ 2566 นางดรุณี นิธิทวีกุล ผู้ตรวจราชการกระทรวงแรงงาน ลงพื้นที่จังหวัดลำพูนตรวจเยี่ยมสถานประกอบกิจการที่จ้างคนต่างด้าวทำงาน เพื่อตรวจคุ้มครองดูแลสิทธิแรงงานของลูกจ้างแรงงานต่างด้าวให้ได้รับการปฏิบัติตามกฎหมายอย่างเท่าเทียมกับแรงงานไทย โดยมี นางสาวอัจฉราภรณ์ ยะสินธ์ ผู้จัดการฝ่ายบุคคล นายจิตติภูมิ สัมพันธนานนท์ ผู้จัดการฝ่ายผลิต บริษัท ไทย – นิจิ อินดัสทรี จำกัดผู้บริหารระดับสูงกระทรวงแรงงาน พร้อมด้วย หัวหน้าส่วนราชการหน่วยงานในสังกัดกระทรวงแรงงานจังหวัดลำพูน ให้การต้อนรับ ณ บริษัท ไทย – นิจิ อินดัสทรี จำกัด นิคมอุตสาหกรรมภาคเหนือ ตั้งอยู่เลขที่ 77 หมู่ 13 ต.มะเขือแจ้ อ.เมืองลำพูน จ.ลำพูน ซึ่งเป็นสถานประกอบกิจการประเภทการผลิตขนมขบเคี้ยว ขนมกรุบกรอบ มีลูกจ้างทั้งสิ้น 464 คน เป็นแรงงานไทย 324 คน แรงงานต่างด้าว 140 คน
นางดรุณี กล่าวว่า รัฐบาลภายใต้การนำของท่าน พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงกลาโหม และกระทรวงแรงงาน โดยท่านสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน ได้ให้ความสำคัญกับการบริหารจัดการการทำงานของคนต่างด้าวสัญชาติกัมพูชา ลาว เมียนมา และเวียดนาม โดยคำนึงถึงความมั่นคงของประเทศและความปลอดภัยของประชาชนชาวไทย การลงพื้นที่จังหวัดลำพูนในครั้งนี้เพื่อตรวจติดตามการดำเนินการตรวจคัดกรองเบื้องต้นการบังคับใช้แรงงาน หรือบริการและการค้ามนุษย์ด้านแรงงานในแรงงานต่างด้าว ตามมาตรฐานการปฏิบัติงานการตรวจคัดกรอง (SOP) รบ.1 ให้เป็นไปตามกลไกการส่งต่อระดับชาติ มีวัตถุประสงค์เพื่อตรวจติดตามการดำเนินงานการตรวจคุ้มครองแรงงาน และการตรวจคัดกรองเบื้องต้น เพื่อแสวงหาข้อบ่งชี้สำหรับบุคคลที่มีเหตุอันควรสงสัยได้ว่าอาจเป็นผู้เสียหายจากการแสวงหาประโยชน์ด้านแรงงาน แรงงานบังคับ หรือการค้ามนุษย์ด้านแรงงานในแรงงานต่างด้าว รวมทั้งเพื่อตรวจติดตามการรายงานผลการตรวจคัดกรองเบื้องต้นจากการใช้มาตรฐานการปฏิบัติงาน และ แบบ รบ.1 เพื่อแสวงหาข้อบ่งชี้สำหรับบุคคลที่มีเหตุอันควรสงสัยได้ว่าอาจะเป็นผู้เสียหายจากการแสวงหาประโยชน์ด้านแรงงาน แรงงานบังคับ หรือการค้ามนุษย์ด้านแรงงาน ให้มีประสิทธิภาพและเป็นไปตาม NRM ตลอดจนรับทราบปัญหาอุปสรรค กระบวนการ วิธีการตรวจคุ้มครองแรงงาน และการตรวจคัดกรองเบื้องต้น เพื่อแสวงหาข้อบ่งชี้สำหรับบุคคลที่มีเหตุอันควรสงสัยได้ว่าอาจเป็นผู้เสียหายจากการแสวงหาประโยชน์ด้านแรงงาน
โอกาสเดียวกันนี้ นางดรุณี ยังได้เป็นประธานการประชุมตรวจติดตามการดำเนินการตรวจคัดกรองเบื้องต้นการบังคับใช้แรงงานหรือบริการ และการค้ามนุษย์ด้านแรงงานในแรงงานต่างด้าว ตามมาตรฐานการปฏิบัติงาน การตรวจคัดกรอง (SOP) ให้เป็นไปตามกลไกการส่งต่อระดับชาติ โดยได้กำชับให้ส่วนราชการสังกัดกระทรวงแรงงานจังหวัดลำพูนบูรณาการความร่วมมือกับสถานประกอบการในการดูแลคุ้มครองสิทธิแรงงานของลูกจ้างแรงงานต่างด้าวให้ได้รับการปฏิบัติตามกฎหมายอย่างเท่าเทียมกับแรงงานไทย เช่น อัตราค่าจ้างขั้นต่ำ การรักษาพยาบาล การทำประกันสังคม เป็นต้น เพื่อให้ลูกจ้างการได้รับสวัสดิการจากสถานประกอบการ อย่างเป็นธรรม เพื่อเป็นการป้องกันการเกิดปัญหาการค้ามนุษย์ในรูปแบบที่เลวร้าย ซึ่งอาจจะส่งผลกระทบต่อการจัดลำดับสถานการณ์การค้ามนุษย์ของประเทศไทยให้อยู่ในระดับที่ต่ำกว่าเดิมอีกด้วย
สำหรับสถานการณ์ด้านแรงงานต่างด้าวของจังหวัดลำพูน ปัจจุบันมีคนต่างด้าวที่ได้รับอนุญาตทำงานตาม พ.ร.ก.การบริหารจัดการการทำงานของคนต่างด้าวฯ ข้อมูล ณ เดือนมกราคม 2566 จำนวนทั้งสิ้น 15,108 คน นายจ้าง/สถานประกอบการ 3,733 แห่ง ประกอบด้วย คนต่างด้าวที่ไม่ใช่ 3 สัญชาติ ได้แก่ มาตรา 59 (ทั่วไป) จำนวน 174 คน มาตรา 62 (BOI) จำนวน 316 คน คนต่างด้าว บุคคลซึ่งไม่มีสถานะทางทะเบียน มาตรา 63/1(4) จำนวน 1,348 คน แรงงานต่างด้าว 3 สัญชาติ จำนวน 13,270 คน แยกเป็นเมียนมา 13,072 คน กัมพูชา 85 คน ลาว 113 คน
On February 23, 2023, the Ministry of Labour’s Inspector-General, Mrs. Darunee Nithithaweekul, traveled to Lamphun Province to inspect business establishments that employ foreigners to work, to monitor and protect the rights of foreign workers, ensuring equal treatment with Thai workers. The HR Manager, Ms. Atcharaporn Yasin, and the Production Manager from Thai-Nichi Industries Co., Ltd., Mr. Jittiphum Sumphanthananon, the Ministry of Labour’s executives and heads of government agencies under the Ministry of Labour in Lamphun gave a welcome at Thai-Nichi Industries Co., Ltd., located in the Northern Region Industrial Estate, No. 77, Moo 13, Makhuea Jae Subdistrict, Mueang Lamphun District, Lamphun Province. The company produces snacks and has a total of 464 employees, 324 of which are Thai and 140 foreign.
Mrs. Darunee said that the government, under the leadership of the Prime Minister and Minister of Defense, General Prayuth Chan-ocha, and the Ministry of Labour by the Labour Minister Mr. Suchart Chomklin, gives importance to managing Cambodian, Laotian, Myanmar, and Vietnamese workers, concerning national security and the safety of Thai people. The visit to Lamphun today was to monitor the implementation of the preliminary screening of forced labour or services and labour trafficking in foreign workers, following the Screening Operational Procedure (SOP) Ror.Bor. 1 according to the national referral mechanism. The objective is to monitor the operations of the labour protection inspection and preliminary screening to identify people with reasonable suspicion of being victims of labour exploitation, forced labour, or human trafficking among migrant workers. It also monitors the preliminary screening report from applying the operational standards and form Ror.Bor. 1 to seek indications for persons who have reasonable grounds to suspect that they may be victims of labour exploitation, forced labour, or human trafficking, to be effective and following the NRM, as well as to acknowledge the problems, obstacles, processes, methods of labour protection inspections and preliminary screening to identify people who who have reasonable grounds to suspect that they may be victims of labour exploitation.
On the same occasion, Mrs. Darunee also chaired an audit meeting on the implementation of preliminary screening for forced labour or services and labor trafficking in foreign workers, following the Screening Operational Procedure (SOP) according to the national referral mechanism. She urged government agencies under the Ministry of Labour in Lamphun Province to work with companies in protecting the rights of migrant workers to be treated equally to Thai workers, such as minimum wages, medical treatment, and social security. The efforts aim to ensure that employees receive welfare from companies fairly to prevent the worst forms of human trafficking, which may pull Thailand’s human trafficking ranking lower.
As of January 2023, Lamphun Province has 15,108 foreigners permitted to work under The Royal Decree on the Management of Foreign Workers’ Work. There are 3,733 employers/establishments. The foreign worker population is divided into 174 workers not of the three nationalities under Section 59 (general), 316 under Section 62 (BOI), 1,348 persons without a registration status under Section 63/1(4), 13,270 foreign workers of 3 nationalities, divided into 13,072 Myanmar nationals, 85 Cambodian nationals, and 113 Laotian nationals.
