ปลัดกระทรวงแรงงาน สั่งกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ตรวจสอบความปลอดภัยในการทำงานพร้อมหาข้อเท็จจริงทันที กรณีลูกจ้างถูกเครื่องจักรกระแทกศีรษะเสียชีวิตที่ จ.ระยอง พร้อมเตือนนายจ้าง ลูกจ้างให้ปฏิบัติตามกฎหมายความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน เพื่อป้องกันการเกิดเหตุซ้ำอีก
นายบุญชอบ สุทธมนัสวงษ์ ปลัดกระทรวงแรงงาน เปิดเผยว่า ตนได้รับรายงานสถานการณ์ด้านแรงงานที่สำคัญจากสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดระยอง ว่าเกิดเหตุลูกจ้างถูกเครื่องจักรกระแทกศีรษะเสียชีวิต จึงได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ลงพื้นที่ตรวจสอบหาสาเหตุ รวมถึงความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานภายในโรงงานพร้อมสอบข้อเท็จจริงด้านความปลอดภัย ในเบื้องต้นพนักงานตรวจความปลอดภัยสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดระยอง และศูนย์ความปลอดภัยในการทำงานเขต 2 (ชลบุรี) รายงานว่า สถานที่เกิดเหตุเป็นโรงงานประกอบกิจการผลิตและจำหน่ายยางรถยนต์ ตั้งอยู่ในพื้นที่หมู่ 6 ต.มาบยางพร อ.ปลวกแดง จ.ระยอง เหตุเกิดเมื่อวันที่ 28 มีนาคม 2566 เวลา 19.20 น. ขณะที่นาย ZHANG KEYI อายุ 35 ปี สัญชาติจีน ลูกจ้าง ทำงานในตำแหน่งช่างซ่อมบำรุง หลังดำเนินการซ่อมบำรุงสายพานลำเลียงผ้าใบของเครื่องตัดผ้าใบเสร็จ ได้นั่งลงบริเวณเครื่องจักรเพื่อตรวจสอบว่าสายพานลำเลียงผ้าใบมีการสวิงหรือไม่ แต่เครื่องจักรในส่วนเครื่องหนีบผ้าใบกลับเริ่มทำงาน ทำให้กระแทกโดนศีรษะของลูกจ้างชนเข้ากับแผงกั้นเครื่องจักรอย่างแรง นายจ้างได้ส่งตัวไปรักษาที่โรงพยาบาลปลวกแดงและเสียชีวิตในเวลาต่อมา ทั้งนี้ ตนต้องขอแสดงความเสียใจกับครอบครัวของลูกจ้างผู้เสียชีวิตต่อเหตุการณ์ที่เกิดขึ้น เบื้องต้น สำนักงานประกันสังคมจังหวัดระยองจะเร่งดำเนินการให้ครอบครัว ทายาทของลูกจ้างผู้เสียชีวิต ได้รับสิทธิประโยชน์จากกองทุนเงินทดแทน เป็นเงินค่าทำศพ 50,000 บาท เงินทดแทนกรณีเสียชีวิตร้อยละ 70 ของค่าจ้างระยะเวลา 10 ปี เป็นเงิน 1,680,000 บาท เงินบำเหน็จชราภาพกรณีเสียชีวิต 16,035 บาท รวมทั้งสิ้น 1,746,035 บาท ในส่วนสาเหตุของการเกิดอุบัติเหตุและการดำเนินการด้านความปลอดภัยได้มอบให้กรมสวัสดิการและคุ้มครองแรงงานดำเนินการตามตามอำนาจหน้าที่ต่อไป ตนอยากเน้นย้ำไปถึงนายจ้าง ลูกจ้างให้ปฏิบัติตามกฎหมายความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานอย่างเคร่งครัด เพื่อป้องกันไม่ให้เกิดเหตุเช่นนี้อีก
ด้าน นายนิยม สองแก้ว อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) กล่าวเพิ่มเติมว่า พนักงานตรวจความปลอดภัยสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดระยอง และศูนย์ความปลอดภัยในการทำงานเขต 2 (ชลบุรี) จะเชิญนายจ้างและผู้ที่เกี่ยวข้องมาพบเพื่อสอบข้อเท็จจริงเพิ่มเติมในวันที่ 4 เมษายน 2566 ว่านายจ้างมีการฝ่าฝืนไม่ปฏิบัติตามกฎหมายหรือพระราชบัญญัติความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน พ.ศ. 2554 กฎกระทรวงกำหนดมาตรฐาน กฎกระทรวงกำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการด้านความปลอดภัย อาชีวอนามัยและสภาพแวดล้อมในการทำงานเกี่ยวกับเครื่องจักร ปั้นจั่น และหม้อน้ำ พ.ศ.2564 และกฎกระทรวงกำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการด้านความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานหรือไม่ หากนายจ้างไม่ปฏิบัติตามกฎหมายดังกล่าวจะดำเนินการตามอำนาจหน้าที่ต่อไป

The Permanent Secretary of Labour instructed the Department of Labour Protection and Welfare to check work safety and investigate facts immediately in the case of an employee being hit on the head by a machine in Rayong province. He warned employers and employees to comply with occupational safety, health, and working environment laws to prevent a recurrence.
The Permanent Secretary of Labour, Mr. Boonchob Suttamanaswong, said that he received an important report from the Rayong Provincial Labour Protection and Welfare Office of an accident where an employee was hit by a machine on the head and died. He instructed the Department of Labour Protection and Welfare to investigate the cause, including the factory’s occupational safety, health, and working environment. He also instructed an investigation of safety facts. Initially, the Safety Inspectors of the Rayong Labour Protection and Welfare Office and the Center for Safety at Work Region 2 (Chonburi) reported that the accident scene is a factory producing and selling tires in Moo 6, Mapyangphon Subdistrict, Pluak Daeng District, Rayong Province. The incident occurred on March 28, 2023, at 19.20 hours. Mr. Zhang Keyi, a 35-year-old Chinese national employed as a maintenance technician, was sitting around the machine after completing the maintenance of the fabric conveyor belt of the canvas cutting machine to check if the conveyor belt swings or not. However, the machine resumed operations and hit the employee’s head hard against the machine barrier. The employer sent him to Pluak Daeng Hospital for treatment, where he died later. He expressed his condolences to the family of the deceased employee. The Rayong Social Security Office will speed up the process for the family of the deceased employee to receive benefits from the Workmen’s Compensation Fund, a funeral payment amounting to 50,000 Baht, compensation for death amounting to 70 percent of the wages for ten years, in the amount of 1,680,000 Baht, and an old age pension in the event of death amounting to 16,035 Baht, totaling 1,746,035 Baht. As for the cause of the accident and safety measures, the Department of Labour Protection and Welfare has been assigned to proceed according to its authority. He emphasized that employers and employees strictly comply with occupational safety, health, and working environment laws to prevent this from happening again.
The Department of Labour Protection and Welfare’s Director-General, Mr. Niyom Songkaew, added that the Safety Inspector of the Rayong Office of Labour Protection and Welfare and the Center for Safety at Work Region 2 (Chonburi) would invite employers and those involved to meet for further investigation on April 4, 2023, to assess whether the employer violates the law, the Occupational Safety, Health, and Environment Act B.E. 2554, the Ministerial Regulations Prescribing Standards for the Management and Operation of Occupational Safety, Health and Work Environment on Machinery, Cranes and Boilers B.E. 2564, and Ministerial Regulations Prescribing Standards for the Management and Operation of Occupational Safety, Health, and Working environment. If the employer fails to comply with the law, it will proceed according to its authority.
