“รมว.สุชาติ” สั่ง “กสร.” สอบปมลูกจ้างชูป้ายทวงค่าจ้างหน้าหมู่บ้านดัง พร้อมให้ความเป็นธรรม
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึง กรณีสื่อสังคมออนไลน์ เผยแพร่ข่าวลูกจ้างทำงานบ้านชูป้ายทวงถามค่าจ้างกับนายจ้างหน้าหมู่บ้านดัง จ.นนทบุรี ว่า ผมได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ลงพื้นที่ร่วมกับหน่วยงานในสังกัดกระทรวงแรงงานและหน่วยงานที่เกี่ยวข้องเพื่อตรวจสอบข้อเท็จจริงในทันที เบื้องต้นได้รับรายงานว่า ลูกจ้างดังกล่าวเป็นลูกจ้างหญิง สัญชาติเมียนมา ทำงานเป็นแม่บ้านและเลี้ยงดูบุตรของนายจ้าง ได้รับค่าจ้างรายเดือนๆละ 16,000 บาท เริ่มทำงานตั้งแต่ปลายปี 2565 ถึงกลางเดือนกุมภาพันธ์ 2566 ซึ่งในช่วงเดือนกุมภาพันธ์นายจ้างได้ขอลดค่าจ้างและขอลดวันหยุดประจำสัปดาห์ลง ลูกจ้างจึงได้ขอลาออก แต่นายจ้างไม่อนุญาตจึงได้ลาออกจากงานและยังไม่ได้รับค่าจ้างในเดือนกุมภาพันธ์ จึงมาชูป้ายทวงถามค่าจ้างจากนายจ้างตามที่ปรากฎเป็นข่าว ซึ่งในวันที่ (1 มีนาคม 2566) พนักงานตรวจแรงงานสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดนนทบุรี ได้รับคำร้อง (คร.7) จากลูกจ้างไว้แล้ว ทั้งนี้ ผมได้กำชับให้เจ้าหน้าที่ดำเนินการโดยรับฟังข้อเท็จจริงและให้ความเป็นธรรมแก่ทั้งสองฝ่าย
นายนิยม สองแก้ว อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) กล่าวเพิ่มเติมว่า หลังจากพนักงานตรวจแรงงาน สำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดนนทบุรี ได้รับคำร้องจากลูกจ้างแล้ว จะเชิญนายจ้างและผู้เกี่ยวข้องมาพบเพื่อสอบข้อเท็จจริง และจะชี้แจงข้อกฎหมายตามกฎกระทรวง ฉบับที่ 14 (พ.ศ.2555) ออกตามความในพระราชบัญญัติคุ้มครองแรงงาน พ.ศ.2541 ใช้บังคับกับนายจ้างซึ่งลูกจ้างทำงานเกี่ยวกับงานบ้านอันมิได้ประกอบธุรกิจรวมอยู่ด้วย และจะดำเนินการตามขั้นตอนของกฎหมาย เพื่อให้เกิดความเป็นธรรมแก่ทั้งสองฝ่ายต่อไป
Labour Minister Instructs DLPW to Conduct Fair Investigation the Case of Employee Holding Sign to Demand Wages from Employer in a Popular Village
The “Labour Minister, Mr. Suchart,” assigned the “DLPW” to investigate the case of employees holding up signs to demand wages in front of a famous village, calling for fairness.
The Labour Minister, Mr. Suchart Chomklin, spoke about the case on social media, sharing news about a domestic worker holding up a sign asking for wages from their employer in front of a famous village in Nonthaburi Province. He said he instructed the Department of Labour Protection and Welfare (DLPW) to investigate the area with agencies and relevant agencies under the Ministry of Labour. Initially, it was reported that the employee was a female of Myanmar nationality working as a housewife and raising the employer’s children. She received a monthly wage of 16,000 Baht per month. She started work at the end of 2022. In mid-February 2023, the employer requested to reduce wages and weekly holidays. The employee then asked to resign, but the employer did not allow it. She left her job and still did not receive wages for February. Therefore, as shown in the news, she was raising a sign to demand wages from an employer. On March 1, 2023, the Labour Inspector of the Nonthaburi Provincial Office of Labour Protection and Welfare received a request (Kor.Ror. 7) from the employee. He instructed officials to take action by assessing the facts and providing fair solutions to both parties.
The Department of Labour Protection and Welfare’s Director-General, Mr. Niyom Songkaew, added that after the Labour Inspector of the Nonthaburi Provincial Office of Labour Protection and Welfare received a request from the employee, they will invite the employer and related persons to meet to investigate the facts, and will clarify the law according to the Ministerial Regulation No. 14 (B.E. 2555) issued under the Labour Protection Act B.E. and will proceed following the legal process to ensure fairness to both parties.
