วันที่ 21 สิงหาคม 2566 นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า จากกรณีที่สื่อมวลชนนำเสนอข่าวลูกจ้างบริษัทแห่งหนึ่ง ประสบอุบัติเหตุถูกลวดทิ่มตาข้างซ้ายระหว่างทำงานช่วงเดือนพฤษภาคม 2566 ที่ผ่านมา และรักษาตัวเรื่อยมาจนถึงขณะนี้ จึงเป็นกังวล กลัวตกงาน เงินไม่พอใช้ จึงวอนขอให้หน่วยงานที่เกี่ยวข้องช่วยเหลือนั้นว่า ทันทีที่ทราบข่าว ท่านนายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงกลาโหม พล.อ.ประยุทธ์ จันทร์โอชา ได้มีความห่วงใยและให้หน่วยงานที่เกี่ยวข้องเร่งตรวจสอบให้ความช่วยเหลือโดยด่วน ในส่วนของกระทรวงแรงงานผมจึงได้สั่งการให้สำนักงานประกันสังคมเร่งตรวจสอบข้อมูลข้อเท็จจริงเพื่อให้ความช่วยเหลือเยียวยาสิทธิประโยชน์ในทันที
นายสุชาติ กล่าวต่อว่า จากการตรวจสอบข้อเท็จจริงกรณีดังกล่าว ผมได้รับรายงานจาก นายบุญสงค์ ทัพชัยยุทธ์ เลขาธิการสำนักงานประกันสังคม ที่ได้สั่งการให้สำนักงานประกันสังคมจังหวัดลำพูน ตรวจสอบข้อเท็จจริงจากนายจ้างพบว่า นายอริญชย์ ประเสริฐศักดิ์ ยอมรับว่าเป็นนายจ้างที่แท้จริงของ นายโชคชัย ทองโคตร อายุ 28 ปี ลูกจ้างที่ประสบอุบัติเหตุถูกลวดทิ่มตาข้างซ้ายขณะทำงาน ซึ่งมีสถานประกอบการตั้งอยู่ที่จังหวัดเพชรบุรี โดย นายอริญชย์ เป็นผู้รับเหมาช่วงจากบริษัท และนายโชคชัยเป็นลูกจ้างของ นายอริญชย์ ซึ่งได้แจ้งเข้าทำงานตั้งแต่วันที่ 3 มกราคม 2566 และแจ้งลาออกเมื่อวันที่ 8 กรกฎาคม 2566 ทั้งนี้ สำนักงานประกันสังคมจังหวัดลำพูนได้จ่ายเงินค่าทดแทนการหยุดงานให้กับลูกจ้างแล้ว จำนวน 14 วัน เป็นจำนวนเงิน 6,533.30 บาท โดยหากภายหลังมีใบรับรองแพทย์สั่งให้หยุดพักรักษาตัวลูกจ้างสามารถนำมาเบิกเพิ่มเติมได้ สำหรับสิทธิกรณีรักษาพยาบาล และกรณีสูญเสียอวัยวะ ลูกจ้างมีสิทธิ์ได้รับตาม พรบ.เงินทดแทน ซึ่งสำนักงานได้แจ้งให้กับลูกจ้างทราบเรียบร้อยแล้ว ขณะเดียวกันยังได้สั่งการให้สำนักงานประกันสังคมจังหวัดลำพูน ดำเนินคดีพร้อมเปรียบเทียบปรับมาตรา 97 ตาม พรบ.ประกันสังคมกับบริษัท ข้อหายื่นแบบรายการอันเป็นเท็จ และสำนักงานประกันสังคมจังหวัดเพชรบุรี ดำเนินคดีพร้อมเปรียบเทียบปรับมาตรา 96 กับนายอริญชย์ ประเสริฐศักดิ์ ข้อหาแจ้งขึ้นทะเบียนผู้ประกันตนล่าช้าเกินกำหนด
ทั้งนี้ ผมยังได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน เชิญลูกจ้างมาให้ข้อเท็จจริงเพิ่มเติม เพื่อจะได้ตรวจสอบวินิจฉัยให้ลูกจ้างได้รับสิทธิประโยชน์พึงได้ตามกฎหมายคุ้มครองแรงงานต่อไป

Mr. Suchart continued that from an investigation of the facts, he received a report from the Social Security Office’s Secretary-General, Mr. Boonsong Thapchaiyut, who instructed the Lamphun Provincial Social Security Office to investigate the facts from the employer. The investigation found that Mr. Arin Prasertsak accepted that he was the real employer of Mr. Chokchai Thongkot, 28, an employee who had an accident where a wire pierced his left eye while working. The place of business is located in Phetchaburi Province. Mr. Arin is a sub-contractor from a company, and Mr. Chokchai is an employee of Mr. Arin. He has been working since January 3, 2023, and resigned on July 8, 2023. The Lamphun Provincial Social Security Office has already paid compensation for the employee’s absence of 14 days for 6,533.30 Baht. If the medical certificate states that the employee must take a break for treatment, the employee can submit additional reimbursements. The employee is eligible for entitlements under the Compensation Act on medical treatment rights and organ loss. The office has already notified the employee. At the same time, he instructed the Lamphun Provincial Social Security Office to prosecute and implement the fine under Section 97 of the Social Security Act against the company, with the allegations of filing false entries. The Phetchaburi Provincial Social Security Office will prosecute and implement the fine of Section 96 on Mr. Arin Prasertsak, charged with late registration of the insured person.
He also instructed the Department of Labour Protection and Welfare to invite employees to provide additional facts to examine and diagnose to ensure employees get their entitlements under labour protection laws.
