วันที่ 15 สิงหาคม 2566 นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงกรณีที่นายณัฐภัทร บุญทม แรงงานไทยเสียชีวิตที่ประเทศโอมานว่า ในเรื่องนี้ท่านนายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงกลาโหม พล.อ.ประยุทธ์ จันทร์โอชา และกระทรวงแรงงานภายใต้การกำกับดูแลของ พล.อ.ประวิตร วงษ์สุวรรณ รองนายกรัฐมนตรี ได้แสดงความเสียใจกับครอบครัวผู้เสียชีวิตจึงกำชับให้กระทรวงแรงงานตรวจสอบข้อมูลและประสานหน่วยงานที่เกี่ยวข้องเพื่อให้ความช่วยเหลืออย่างเร่งด่วน ซึ่งในส่วนของกระทรวงแรงงานผมได้สั่งการให้ทูตแรงงานที่กรุงอาบูดาบี ซึ่งประเทศโอมานอยู่ในความรับผิดชอบของ (ฝ่ายแรงงาน) ประจำสถานเอกอัครราชทูต ณ กรุงอาบูดาบี สหรัฐอาหรับเอมิเรตส์ ประสานกับกระทรวงการต่างประเทศเพื่อให้ความช่วยเหลือในทันที
นายสุชาติ กล่าวต่อว่า จากรายงานของนางปลิดา ร่วมคำ อัครราชทูตที่ปรึกษา (ฝ่ายแรงงาน) ประจำสถานเอกอัครราชทูต ณ กรุงอาบูดาบี สหรัฐอาหรับเอมิเรตส์ พบว่า เมื่อวันที่ 12 สิงหาคม 2566 เวลาประมาณ 11.00 น. ของยูเออี ฝ่ายแรงงานฯ ได้รับแจ้งประสานจากนายวรวิทย์ฯ แรงงานไทยที่ทำงานกับบริษัท Al Marwan International ประเทศสหรัฐอาหรับเอมิเรตส์ว่า ได้รับทราบจากโฟร์แมนของบริษัทว่า นายณัฐภัทร บุญทม อายุ 45 ปี มีภูมิลำเนาอยู่ที่ อ.ท่าบ่อ จ.หนองคาย บริษัทฯ ได้ส่งไปทำงานที่โอมาน โดยใช้ Visit Visaตำแหน่งช่างเครื่องยนต์ดีเซล ขณะทำงานเกิดอุบัติเหตุ จึงถูกนำส่งโรงพยาบาล Badr Al Samaa และเสียชีวิต และไม่ทราบรายละเอียดอื่นๆ เนื่องจากวันดังกล่าวบริษัทฯ ปิดทำการและไม่สามารถติดต่อผู้ใดได้ ฝ่ายแรงงานฯ จึงได้แจ้งให้นายวรวิทย์ฯ แจ้งให้ฝ่ายบุคคลของบริษัทติดต่อมายังฝ่ายแรงงาน เพื่อยืนยันการเสียชีวิตและสาเหตุการเสียชีวิตของนายณัฐภัทร ทั้งนี้ ฝ่ายแรงงาน ได้ประสานข้อมูลไปยัง สถานเอกอัครราชทูต ณ กรุงมัสกัต ประเทศโอมานทราบเรื่องแล้ว นอกจากนี้ ยังได้แจ้งการเสียชีวิตให้ญาติทราบ พร้อมให้กำลังใจนางสภาวดี บุญทม ภรรยาของนายณัฐภัทร ซึ่งปัจจุบันไปทำงานค้าขายอยู่ที่ จ.แม่ฮ่องสอน และได้เดินทางกลับบ้านที่ จ.หนองคายในวันนี้ (15 ส.ค.66)
จากรายงานของฝ่ายแรงงานฯ พบว่า ในส่วนของการเคลื่อนย้ายศพของนายณัฐภัทรนั้นขณะนี้อยู่ระหว่างการชันสูตรศพถึงการเสียชีวิตที่ชัดเจนแล้ว จึงจะสามารถเคลื่อนย้ายศพกลับประเทศไทยได้ ซึ่งนายจ้างจะต้องรับผิดชอบค่าใช้จ่ายในการจัดเตรียมและขนร่างของลูกจ้างสู่บ้านเกิดหรือสถานที่ที่ได้รับการร้องขอจากญาติ ส่วนค่าจ้างค้างจ่ายเดือนสิงหาคม 2566 ถึงวันทำงานวันสุดท้าย และเงินสิ้นสุดสัญญาจ้าง ซึ่งต้องคำนวณตามระยะเวลาทำงานจริง ในส่วนเงินชดเชยการเสียชีวิตต้องรอพิจารณาจากใบมรณบัตร ฝ่ายแรงงานฯ ได้ให้คำแนะนำกับทางบริษัทว่าเมื่อได้รับใบมรณบัตรจากทางโอมานให้ประสานติดต่อขอใบมรณบัตรจากสถานเอกอัครราชทูต ณ กรุงมัสกัต ก่อนดำเนินการส่งศพกลับประเทศไทยทั้งนี้ จากการตรวจสอบสถานะความเป็นผู้ประกันตนของสำนักงานประกันสังคม พบว่า นายณัฐภัทร เคยเป็นผู้ประกันตนมาตรา 33 เมื่อปี 2552 และมีเงินสะสมกรณีชราภาพอยู่ 21,965.44 บาท และจากการตรวจสอบของกรมการจัดหางาน พบว่า นายณัฐภัทร เป็นสมาชิกกองทุนเพื่อช่วยเหลือคนหางานไปทำงานในต่างประเทศ
ด้าน นายบุญชอบ สุทธมนัสวงษ์ ปลัดกระทรวงแรงงาน กล่าวว่า ในส่วนของการดำเนินการที่ประเทศไทย ผมได้สั่งการให้แรงงานจังหวัดพร้อมด้วยหน่วยงานในสังกัดกระทรวงแรงงานจังหวัดหนองคาย ซึ่งเป็นพื้นที่ที่เป็นภูมิลำเนาของแรงงานไทยที่เสียชีวิตรายดังกล่าว ลงพื้นที่เยี่ยมบ้านเพื่อปลอบขวัญให้กำลังใจพร้อมแจ้งข้อมูลขั้นตอนการให้ความช่วยเหลือให้ญาติทราบเพื่อดูแลอำนวยความสะดวกในการประสานกระทรวงการต่างประเทศว่าจะนำศพแรงงานกลับประเทศไทยอย่างไร รวมทั้ง ชี้แจงเรื่องสิทธิประโยชน์ในการจ่ายเงินช่วยเหลือให้แก่ญาติแรงงานไทยเพื่อเป็นการสงเคราะห์ปลอบขวัญ พร้อมรับคำร้องและอำนวยความสะดวกในการดูแลทั้งในเรื่องขั้นตอน เอกสารหลักฐานต่าง ๆ และจ่ายเงินสงเคราะห์ช่วยเหลือแก่สมาชิกกองทุนฯ ตามเงื่อนไขของระเบียบของกองทุนเพื่อช่วยเหลือคนหางานไปทำงานต่างประเทศ และติดตามสิทธิประโยชน์ต่างๆ อันพึงได้รับจากการทำงานในต่างประเทศ นอกจากนี้ ยังได้เน้นย้ำให้แรงงานไทยที่ต้องการไปทำงานต่างประเทศ ขอให้เดินทางไปอย่างถูกต้องตามกฎหมาย ซึ่งปัจจุบันมี 5 วิธี ได้แก่ กรมการจัดหางานจัดส่ง บริษัทจัดหางานจัดส่ง นายจ้างในประเทศไทยพาลูกจ้างไปทำงานต่างประเทศ นายจ้างในประเทศไทยส่งลูกจ้างไปฝึกงานต่างประเทศ และคนหางานแจ้งการเดินทางไปทำงานต่างประเทศด้วยตนเอง จึงขอแจ้งเตือนไปยังคนหางานที่ประสงค์เดินทางไปทำงานต่างประเทศไปทำงานด้วยวิธีที่ถูกต้องตามกฎหมาย อย่าหลงเชื่อนายหน้า และขอให้สมัครเป็นสมาชิกเพื่อช่วยเหลือคนหางานไปทำงานในต่างประเทศ เพื่อจะได้รับสิทธิประโยชน์การคุ้มครอง หากประสบอันตราย เสียชีวิต พิการ ทุพพลภาพ หรือประสบปัญหาในต่างประเทศ
On August 15, 2023, the Labour Minister, Mr. Suchart Chomklin, spoke about the case of Mr. Natthapat Boonthom, a Thai worker who died in Oman. He said that in this regard, the Prime Minister and Minister of Defense General Prayuth Chan-ocha and the Ministry of Labour, under the supervision of Deputy Prime Minister General Prawit Wongsuwan, expressed their condolences to the family of the deceased and urged the Ministry of Labour to examine the information and coordinate with relevant agencies to provide urgent assistance. The Labour Minister has instructed the Labour Ambassador in Abu Dhabi, responsible for Oman (Labour Division) at the Embassy in Abu Dhabi, United Arab Emirates, to coordinate with the Ministry of Foreign Affairs to provide immediate assistance.
Mr. Suchart continued that the Ambassador Counselor (on Labour) of the Royal Thai Embassy in Abu Dhabi, United Arab Emirates, Mrs. Plida Ruamkham, reported that on August 12, 2023, at 11.00 hours in the local U.A.E. time, the Labour Department received a notification from Mr. Worawit, a Thai worker working for Al Marwan International in the United Arab Emirates that he had come to know from the company’s foreman about Mr. Natthapat Boontom, 45, a resident in Tha Bo District, Nong Khai Province. The company sent him to work in Oman using a Visit Visa as a diesel engine mechanic. An accident occurred while he was working. He was taken to Badr Al Samaa Hospital and eventually died. Other details are unknown as the company was closed that day, and no one was contactable. The Labour Department then informed Mr. Worawit to notify the company’s Human Resources Department to contact the Labour Department to confirm the death and cause of death of Mr. Natthapat. The Labour Department has provided information to the Royal Thai Embassy in Muscat, Oman. In addition, the death was notified to relatives. Encouragement was given to Ms. Phawadee Boontom, the wife of Mr. Natthapat, who currently works in trade in Mae Hong Son Province. She has returned home to Nong Khai Province today (August 15, 2023).
The Labour Department’s report stated that Mr. Natthapat’s body is undergoing an autopsy to determine the cause of death before the body can be transported back to Thailand. The employer is responsible for the cost of preparing and transporting the employee’s body to the hometown or place requested by relatives. Wages payable from August 2023 to the last working day and upon termination of the employment contract must be calculated according to the actual working time. Compensation for death has to be considered on the death certificate. The Labour Department advised the company that when receiving a death certificate from Oman, they should coordinate with the Royal Thai Embassy in Muscat to request a death certificate before transporting the body back to Thailand. According to Social Security Office’s database, Mr. Nuttaphat used to be insured under Section 33 in 2009 and had accumulated money in case of old age of 21,965.44 Baht. The Department of Employment found that Mr. Nattapat is a member of the fund to help job seekers working abroad.
The Permanent Secretary of Labour, Mr. Boonchob Suttamanaswong, said that in terms of operations in Thailand, he had instructed provincial agencies under the Ministry of Labour in Nong Khai, which is the resident province of the deceased Thai worker, to visit their homes to comfort their families and encourage them, and to inform the family about the support process to facilitate the coordination with the Ministry of Foreign Affairs on how to bring back the Thai worker’s body to Thailand. They gave clarification on the benefits to Thai workers’ relatives as a relief aid and prepared to receive requests and facilitate the procedures, documents, evidence, and payment of assistance to members of the fund according to the terms of the fund’s regulations to help job seekers working abroad, They also offered to follow up on various benefits which should be obtained from working abroad. In addition, he emphasized that Thai workers who want to work abroad do so legally. Currently, there are five methods: through the Department of Employment, through recruitment companies, employers in Thailand sending their employees to work abroad, employers in Thailand sending their employees for training abroad, and job seekers notifying their travel to work abroad by themselves. Therefore, he said he would like to inform job seekers who wish to travel to work abroad to do so by legal means. He cautioned people not to be fooled by agents and to apply to the fund helping job seekers to work abroad, which will help them receive protection benefits in the event of danger, death, disability, or experiencing problems abroad.
