รมว.แรงงาน ห่วงใยกรณีลูกจ้างถูกไฟดูดเสียชีวิต 2 ราย ขณะทำความสะอาดแท็งก์น้ำที่ติดตั้งบนชั้นดาดฟ้า สั่งกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ร่วมกับสำนักงานประกันสังคม (สปส.) และกรมการจัดหางาน (กกจ.) ลงพื้นที่ตรวจสอบข้อเท็จจริงและเร่งช่วยเหลือสิทธิตามกฎหมายทันที พร้อมยืนยันไม่ทอดทิ้งและช่วยเหลือครอบครัวลูกจ้างที่เสียชีวิตอย่างเต็มที่ โดยเชิญพบ 30 มีนาคมนี้
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงกรณีสื่อนำเสนอข่าว ทำความสะอาดแท็งก์น้ำถูกไฟช็อตเสียชีวิต 2 คน ว่า ทันที่ทราบข่าว ผมต้องขอแสดงความเสียใจกับเหตุการณ์ที่เกิดขึ้น และได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ร่วมกับสำนักงานประกันสังคม (สปส.) และกรมการจัดหางาน (กกจ.) ลงพื้นที่ตรวจสอบข้อเท็จจริงและเร่งช่วยเหลือสิทธิตามกฎหมายทันที เบื้องต้นได้รับรายงานจาก พนักงานตรวจความปลอดภัยสำนักงานสวัสดิการและคุ้มครองแรงงานกรุงเทพมหานครพื้นที่ 5 (สรพ.5) และศูนย์ความปลอดภัยในการทำงานเขต 12 (ศปข.12) เมื่อวันที่ 21 มีนาคม 2566 เวลา 13.40 น. สถานที่เกิดเหตุเป็นอาคารชุดคอนโดมิเนียม แถวห้วยขวาง กรุงเทพมหานคร ขณะเกิดเหตุมีลูกจ้างทำความสะอาดอาคารชุด จำนวน 4 คน โดยลูกจ้าง 2 คน คือนายเหมือน ทองครบุรี อายุ 50 ปี สัญชาติไทย ทำงานเป็นลูกจ้างตำแหน่งช่างประจำอาคารของนิติบุคคลอาคารชุด และนายคอน กี้ โซ อายุ 45 ปี สัญชาติเมียนมา ซึ่งไม่ใช่ลูกจ้างประจำของนิติบุคคลฯ แต่มาช่วยทำงานเป็นครั้งคราว ได้ขึ้นไปทำความสะอาดบนชั้นดาดฟ้าเพื่อทำความสะอาดภายในแทงก์น้ำ ระหว่างทำงานทั้ง 2 คน เกิดหมดสติ เพื่อนร่วมงานได้ขึ้นมาพบ จึงคาดว่าอาจเกิดไฟฟ้ารั่วแล้วถูกไฟฟ้าดูด จึงได้ทำการสับคัทเอ้าท์แล้วแจ้งเจ้าหน้าที่กู้ภัยและโรงพยาบาลเข้าช่วยเหลือปฐมพยาบาล แต่ทั้งสองคนได้เสียชีวิต ปัจจุบันอยู่ระหว่างรอผลชันสูตรเพื่อหาสาเหตุการเสียชีวิต ทั้งนี้ ผมได้สั่งการให้หน่วยงานในสังกัดเร่งดำเนินการตามอำนาจหน้าที่ พร้อมให้ความช่วยเหลือครอบครัวญาติของลูกจ้างผู้เสียชีวิตได้รับสิทธิตามกฎหมายโดยเร็ว
ทางด้าน นายนิยม สองแก้ว อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) กล่าวว่า พนักงานตรวจความปลอดภัยสำนักงานสวัสดิการและคุ้มครองแรงงานกรุงเทพมหานครพื้นที่ 5 (สรพ.5) และศูนย์ความปลอดภัยในการทำงานเขต 12 (ศปข.12) ได้มีหนังสือเชิญนายจ้างและผู้เกี่ยวข้องมาพบ ในวันที่ 30 มีนาคม 2566 เพื่อสอบข้อเท็จจริงเพิ่มเติมว่านายจ้างได้ปฏิบัติตามพระราชบัญญัติความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน พ.ศ. 2554 และกฎกระทรวงกำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการด้านความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานเกี่ยวกับไฟฟ้า พ.ศ. 2558 หรือไม่ ซึ่งหากนายจ้างฝ่าฝืน หรือไม่ปฏิบัติตามกฎหมายดังกล่าวจะดำเนินการตามอำนาจหน้าที่ต่อไป
ทางด้าน นายบุญสงค์ ทัพชัยยุทธ์ เลขาธิการสำนักงานประกันสังคม (สปส.) กล่าวเพิ่มว่า ในส่วนของสำนักงานประกันสังคมกรุงเทพมหานครพื้นที่ 3 หากตรวจสอบพบว่าลูกจ้างผู้เสียชีวิต ทั้งสองคนเป็นผู้ประกันตนเบื้องต้นทายาทจะได้รับสิทธิประโยชน์กรณีเสียชีวิตเนื่องจากการทำงานเป็น ค่าทำศพ จำนวน 50,000 บาท เงินทดแทนกรณีเสียชีวิต และเงินบำเหน็จชราภาพ ซึ่งสำนักงานประกันสังคมกรุงเทพมหานครพื้นที่ 5 จะเร่งดำเนินการตามสิทธิต่อไป
The Labour Minister showed concern about two electrocuted employees dying while cleaning the rooftop water tank. He instructed the Department of Labour Protection and Welfare (DLPW), the Social Security Office (SSO), and the Department of Employment (DOE) to investigate the facts and promptly assist in legal rights. He confirmed that they fully support the family of the deceased employee and invited them to meet on March 30.
The Labour Minister, Mr. Suchart Chomklin, spoke about the case where the media presented news on two people who were cleaning a water tank and were electrocuted, causing both to die. Upon hearing the news, he shared his condolences for the incident. He instructed the Department of Labour Protection and Welfare (DLPW), the Social Security Office (SSO), and the Department of Employment (DOE) to investigate the facts and support them with legal rights immediately. Initial reports from the Safety Inspectors of the Bangkok Labour Protection and Welfare Office Area 5 (LPWO.5) and the Workplace Safety Center Area 12 (WSC.12) said that the incident happened on March 21, 2023, at 13.40 hours. The accident happened in a Condominium in Huai Khwang, Bangkok. At the time of the incident, there were four condominium cleaning employees, 2 of whom were Mr. Muen Thongkhonburi, 50 years old, of Thai nationality, working as an employee in the condominium juristic person, and Mr. Konky So, 45 years old, a Myanmar national, who is not a regular employee of the juristic person but comes to work from time to time. They went up to the rooftop to clean the inside of the water tank. While working, both of them lost consciousness. Their colleagues found them. Therefore, it is expected that there may be a leakage and an electric shock. They cut out the electricity and informed rescuers and the hospital to help, but both died. Autopsy results to determine the cause of death are pending. The agencies are prepared to help the family and relatives of the deceased employee to their legal entitlements as soon as possible.
The Department of Labour Protection and Welfare’s Director-General, Mr. Niyom Songkaew, said that the Safety Inspector of the Bangkok Labour Protection and Welfare Office Area 5 (LPWO.5) and the Workplace Safety Center in Area 12 (WSC.12) sent a letter inviting employers and related parties to meet on March 30, 2023, to further investigate whether employers have complied with the Occupational Safety, Health, and Working Environment Act B.E. B.E. 2554, and Ministerial Regulations Prescribing Standards for Management and Operation of Occupational Safety, Health, and Working Environment related to Electricity B.E. 2558. If the employer is found in violation or fails to comply with such laws, they will proceed according to their authority.
The Social Security Office’s Secretary-General, Mr. Boonsong Thapchaiyut, added that if the Bangkok Social Security Office Area 3 verifies that the employees are insured persons, the families will receive benefits in case of death due to work, funeral expenses of 50,000 Baht, compensation in case of death, and the old age pension. The Bangkok Social Security Office Area 5 will accelerate the process according to their eligibility.
