นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงกรณีแรงงานไทยผิดกฎหมายลักลอบทำงานเสียชีวิตในเล้าหมูที่เกาหลีใต้ ว่า ท่านนายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงกลาโหม พล.อ.ประยุทธ์ จันทร์โอชา แสดงความเสียใจกับครอบครัวผู้เสียชีวิต และกำชับให้หน่วยงานที่เกี่ยวข้องเร่งตรวจสอบประสานความช่วยเหลือ ในส่วนของกระทรวงแรงงาน ผมได้สั่งการให้ทูตแรงงานที่เกาหลีใต้ประสานกับสถานเอกอัครราชทูต ณ กรุงโซล กระทรวงการต่างประเทศ ซึ่งจากรายงานของ นายนิธิพัฒน์ วัฒนสุวกุล อัครราชทูตที่ปรึกษาฝ่ายแรงงาน ประจำสถานเอกอัครราชทูต ณ กรุงโซล ที่ได้ประสานกับสถานเอกอัครราชทูต ณ กรุงโซล ซึ่งเป็นหน่วยงานหลัก ทราบว่า แรงงานที่เสียชีวิตรายนี้ ชื่อ นายบุญชู ประวะเสนัง อายุ 67 ปี ภูมิลำเนาเป็นคนขอนแก่น ไม่ได้แจ้งการเดินทางผ่านกรมการจัดหางานและไม่ได้เป็นสมาชิกกองทุนเพื่อช่วยเหลือคนหางานไปทำงานในต่างประเทศ เสียชีวิตใกล้เคียงสถานที่ทำงานในฟาร์มหมู เขตเมืองโพชอน ของเกาหลีใต้ โดยพบศพบริเวณร่องน้ำระหว่างเขากับสวนด้านหลัง เบื้องต้นยังไม่ทราบสาเหตุการเสียชีวิตและอยู่ระหว่างรอผลชันสูตรพลิกศพอย่างเป็นทางการ อย่างไรก็ตามเบื้องต้น สันนิษฐานว่าผู้เสียชีวิตอาจเสียชีวิตเพราะปัญหาสุขภาพหรือเพราะสภาพความเป็นอยู่ที่ไม่ถูกสุขอนามัยหรือเพราะอากาศ แต่เนื่องจากนายจ้าง ชื่อนายคิม เป็นผู้จ้างงานนายบุญชูฯ แบบผิดกฎหมาย เมื่อพบว่าเสียชีวิตจึงไม่กล้าแจ้งความ ซึ่งเจ้าหน้าที่ตำรวจได้จับกุมนายจ้าง พร้อมตั้งข้อหาซ่อนเร้นอำพรางศพ และกำลังสอบสวนลูกชายของนายจ้างว่ามีส่วนร่วมหรือไม่ ส่วนสาเหตุการเสียชีวิตที่แท้จริงต้องรอผลชันสูตรศพประมาณ 2 – 3 สัปดาห์ ทั้งนี้ การเสียชีวิตของนายบุญชูฯ สถานเอกอัครราชทูต ณ กรุงโซล ได้ประสานงานในเรื่องคดีกับทางการสาธารณรัฐเกาหลีแล้ว และฝ่ายแรงงานประจำสถานเอกอัครราชทูต ณ กรุงโซล ประเทศสาธารณรัฐเกาหลีอยู่ระหว่างประสานสถานเอกอัครราชทูต ณ กรุงโซล เพื่อตรวจสอบติดตามสิทธิประโยชน์ที่พึงมีของนายบุญชูฯ อาทิ ค่าจ้างค้างจ่าย เป็นต้น
ด้าน นายบุญชอบ สุทธมนัสวงษ์ ปลัดกระทรวงแรงงาน กล่าวว่า ในส่วนของการดำเนินการที่ประเทศไทย ผมได้สั่งการให้แรงงานจังหวัดขอนแก่น ซึ่งเป็นพื้นที่ภูมิลำเนาของผู้เสียชีวิตนำทีมหน่วยงานสังกัดกระทรวงแรงงานจังหวัดขอนแก่น ลงพื้นที่ร่วมกับทางจังหวัดขอนแก่นไปเยี่ยมบ้านของผู้เสียชีวิต เพื่อสร้างขวัญกำลังใจแก่ครอบครัว ซึ่งได้ไปพบกับ น.ส.มะลิ ภรรยาของผู้เสียชีวิตเป็นอาสาสมัครแรงงานตำบลทางขวาง อำเภอแวงน้อย จังหวัดขอนแก่น จากการพูดคุย ทราบว่า น.ส.มะลิ มีบุตรชาย 1 คน อายุ 34 ปี ขณะนี้บุตรชายเรียนจบและทำงานที่บริษัท อิตาเลียนไทย ที่จังหวัดสระบุรี และ น.ส.มะลิจะเดินทางพร้อมบุตรชายไปจัดการศพนายบุญชูที่เกาหลีด้วยตัวเองโดยจะเดินทางไปในวันศุกร์ที่ 10 มีนาคมนี้ โดย นายไกรสร กองฉลาด ผู้ว่าราชการจังหวัดขอนแก่น ได้มอบเงินจำนวน 10,000 บาท ให้แก่ภรรยาของผู้เสียชีวิตด้วย ในส่วนของสำนักงานประกันสังคมจังหวัดขอนแก่น ยังได้แจ้งสิทธิประโยชน์ประกันสังคมที่ผู้เสียชีวิตเคยเป็นผู้ประกันตน มาตรา 40 มีเงินบำเหน็จชราภาพอยู่ประมาณ 1,700 บาท เพื่อมอบสิทธิประโยชน์ดังกล่าวให้แก่ทายาทตามกฎหมายต่อไป
“ขอย้ำเตือนให้แรงงานไทยที่ไปทำงานในต่างประเทศ ขอให้เดินทางไปอย่างถูกต้องตามกฎหมาย เพราะหากเข้าไปทำงานแบบผิดกฎหมายจะไม่ได้รับการดูแลตามสิทธิที่พึงมี หากเจ็บป่วยในต่างประเทศค่าใช้จ่ายจะสูงมาก และยังมีโอกาสถูกนายจ้างเอาเปรียบได้ ทั้งนี้ ปัจจุบันการเดินทางไปทำงานต่างประเทศอย่างถูกต้องตามกฎหมายมี 5 วิธี ได้แก่ กรมการจัดหางานจัดส่ง บริษัทจัดหางานจัดส่ง นายจ้างในประเทศไทยพาลูกจ้างไปทำงานต่างประเทศ นายจ้างในประเทศไทยส่งลูกจ้างไปฝึกงานต่างประเทศ และคนหางานแจ้งการเดินทางไปทำงานต่างประเทศด้วยตนเอง จึงขอแจ้งเตือนไปยังคนหางานที่ประสงค์เดินทางไปทำงานต่างประเทศไปทำงานด้วยวิธีที่ถูกต้องตามกฎหมายและสมัครเป็นสมาชิกเพื่อช่วยเหลือคนหางานไปทำงานในต่างประเทศ จะได้รับสิทธิประโยชน์การคุ้มครอง หากประสบอันตราย เสียชีวิต พิการ ทุพพลภาพ หรือประสบปัญหาในต่างประเทศ โดยสามารถสอบถามรายละเอียดเพิ่มเติมได้ที่ กรมการจัดหางาน หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด และสำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1 – 10 หรือสอบถามข้อมูลเพิ่มเติมได้ที่สายด่วนกระทรวงแรงงาน โทร. 1506 กด 2 กรมการจัดหางาน นายบุญชอบ กล่าวท้ายสุด

The Labour Minister Mr. Suchart Chomklin spoke about the case of an illegal Thai worker who died in a pigsty in South Korea. He said that the Prime Minister and Minister of Defence, General Prayuth Chan-ocha shared his condolences to the deceased worker’s family and urged relevant agencies to speed up investigations and coordinate assistance. The Ministry of Labour has instructed the Labour Ambassador in South Korea to coordinate with the embassy in Seoul under the Ministry of Foreign Affairs. The Minister Counselor on Labour at the Royal Thai Embassy in Seoul, Mr. Nithipat Watanasuwakul, coordinated with the Royal Thai Embassy in Seoul, the main agency. He reported that the deceased worker is Mr. Boonchu Prawasenang, 67 years old, domiciled in Khon Kaen Province. He did not report his travel through the Department of Employment and was not a member of the fund to help job seekers working abroad. He died near the place of work on a pig farm. Pocheon, South Korea. The body was found in the gutter between a hill and the back garden. The cause of death is still unknown and pending official autopsy results. However, it is assumed that the deceased may have died because of health problems, unsanitary living conditions, or the weather. But because the employer, named Mr. Kim, illegally hired Mr. Boonchu when he was found dead, he did not dare to make a report. Police officers have arrested the employer with a charge of hiding the body and are investigating whether the employer’s son was involved. The cause of death will be reported in about 2-3 weeks following the autopsy results. The Royal Thai Embassy in Seoul has coordinated the case with the South Korean authorities and the Labour Department at the Royal Thai Embassy in Seoul. It is coordinating with the Royal Thai Embassy in Seoul to monitor and follow up on benefits that should be available to Mr. Boonchu, such as unpaid wages.
The Permanent Secretary of Labour, Mr. Boonchob Suttamanaswong, said that in Thailand, he instructed the Khon Kaen Provincial Labour Office. which is the domicile area of the deceased, to lead a team of agencies under the Ministry of Labour in Khon Kaen Province to the area with the Khon Kaen Province Administration, to visit the home of the deceased to build morale for the family. They met with Ms. Mali, the deceased’s wife, a labour volunteer in Tang Kwang Subdistrict, Waeng Noi District, Khon Kaen Province. Ms. Mali has one son, 34 years of age. The son has graduated and works at Italian-Thai in Saraburi Province. Ms. Mali will travel with her son to manage Mr. Boonchu’s funeral in South Korea, departing on Friday, March 10. The Khon Kaen Provincial Governor, Mr. Kraisorn Kongchalad, gave 10,000 Baht to the wife of the deceased. The Khon Kaen Social Security Officer has provided information on social security benefits that the deceased is entitled to, as he was an insured person under Section 40. He has an old-age pension of about 1,700 Baht. The benefits will be presented to the legal heirs.
“I would like to remind Thai workers who go to work abroad to ensure they travel legally. If you go illegally, you will not be taken care of according to your rights. If you get sick in a foreign country, the cost will be very high, and there is a chance employers may exploit you. Currently, there are five ways to legally travel to work abroad. This includes the Department of Employment, a recruitment company, employers in Thailand deploying their employees to work abroad, employers in Thailand sending their employees to do internships abroad, and job seekers informing their travels to work abroad by themselves. I would like to caution Thai workers to ensure they travel for work abroad legally and apply to be a member of the fund to help job seekers work abroad so that they receive protection and benefits in case of an accident, death, disability, or an emergency abroad.
