วันที่ 8 ธันวาคม 2566 เวลา 08.30 น. นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เป็นประธานการประชุมหารือร่วมกับ 18 องค์กรภาคีเครือข่ายผู้ประกอบการอาชีพรักษาความปลอดภัย นำโดย ว่าที่ ร.ต.สิทธิพร บาลทิพย์ นายกสมาคมสภารักษาความปลอดภัย และคณะ ที่ได้เข้าพบเพื่อหารือขอให้รัฐมนตรีว่าการกระทรวงแรงงานยับยั้งและทบทวนการเสนอร่างกฎหมายการจ่ายค่าจ้างพนักงานรักษาความปลอดภัยในส่วนที่เกิน 8 ชั่วโมงหรือการจ่ายค่าจ้างในการทำงานในวันหยุด โดยให้ได้รับเท่ากันกับลูกจ้างอื่นทั่วไป เข้าสู่การพิจารณาของคณะรัฐมนตรี (ครม.) ในวันที่ 12 ธันวาคมนี้ โดยมี นายอารี ไกรนรา เลขานุการรัฐมนตรีว่าการกระทรวงแรงงาน นายเดชา พฤกษ์พัฒนรักษ์ รองปลัดกระทรวงแรงงาน นางโสภา เกียรตินิรชา ผู้ตรวจราชการกระทรวงแรงงาน รักษาราชการแทน อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน เข้าร่วม ณ ห้องประชุมคณะกรรมการแรงงานสัมพันธ์ กรมสวัสดิการและคุ้มครองแรงงาน ชั้น 1 อาคารกระทรวงแรงงาน
นายพิพัฒน์ กล่าวว่า ในวันนี้ผมขอขอบคุณนายกสมาคมสภารักษาความปลอดภัย และคณะ ที่ได้เข้าพบเพื่อหารือให้ทบทวนการเสนอร่างกฎหมายการจ่ายค่าจ้างพนักงานรักษาความปลอดภัยในส่วนที่เกิน 8 ชั่วโมงหรือการจ่ายค่าจ้างในการทำงานในวันหยุด เนื่องจากเกรงว่าจะเกิดผลกระทบต่อการจ้าง รปภ.นั้น
ซึ่งในเรื่องนี้ สิ่งที่ 18 องค์กรภาคีเครือข่ายผู้ประกอบการอาชีพรักษาความปลอดภัยนำเสนอมาในวันนี้ผมรับฟังข้อเสนอทุกประการ แล้วจะนำไปทบทวน โดยเราจะเชิญทั้งทุกฝ่ายมาคุยกัน เพื่อหาข้อยุติให้ได้ ทั้งฝ่ายนายจ้างและลูกจ้าง ซึ่งในเรื่อง รปภ.เรามีความจำเป็นอาจจะต้องหารือในการชดเชยกรณีที่เขาทำงานเกินวันละ 8 ชั่วโมง แน่นอนว่า สภาอุตสาหกรรมฯ สภาหอการค้าไทย ซึ่งเป็นผู้ว่าจ้าง รปภ. การที่เราจะประกาศใช้ ต้องหารือว่าสัญญาของแต่ละบริษัทมีช่วงระยะเวลาเป็นอย่างไร เพื่อหาข้อสรุปที่เป็นกลางให้กับพี่น้องอาชีพ รปภ.ได้รับประโยชน์ นายจ้างอยู่ได้ และกระทรวงแรงงานเองก็สามารถทำงานได้ง่ายขึ้น ซึ่งจะเป็นการตอบสนองนโยบายรัฐบาลที่จะช่วยให้แต่ละอาชีพให้ได้รับค่าจ้างที่สูงขึ้นตามมาตรฐานฝีมือเพื่อให้สูงกว่าค่าจ้างขั้นต่ำและมีคุณภาพชีวิตที่ดีขึ้นสอดคล้องกับสภาพเศรษฐกิจในปัจจุบัน
“ผมจะนำเรื่องนี้เข้าหารือกับเลขารัฐมนตรีฯ รักษาการแทนอธิบดีกรมสวัสดิการและคุ้มครองแรงงาน และจะเชิญองค์กรภาคีเครือข่ายผู้ประกอบการอาชีพรักษาความปลอดภัยมาหารือกันอีกครั้งในรูปแบบไตรภาคี ทั้งบริษัท รปภ. ผู้ว่าจ้าง และหน่วยงานที่เกี่ยวข้อง เพื่อให้ได้ข้อสรุปโดยเร็ว ” นายพิพัฒน์ กล่าวท้ายสุด
ภายหลังเสร็จสิ้นจากการหารือ นายพิพัฒน์ฯ ยังได้ไปพบปะให้กำลังใจกับพี่น้อง รปภ.ที่มาร่วมรอฟังผลการหารือในครั้งนี้ โดย รปภ.ต่างพร้อมใจกันส่งเสียงขอบคุณนายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน ที่ลงมาพบและรับฟังเรื่องดังกล่าวพร้อมยืนยันที่จะหารือเพื่อให้ได้ข้อสรุปโดยเร็ว ซึ่งสร้างความประทับใจให้กับพี่น้อง รปภ.และ18 องค์กรภาคีเครือข่ายผู้ประกอบการอาชีพรักษาความปลอดภัยเป็นอย่างมาก
ด้าน ว่าที่ ร.ต.สิทธิพร บาลทิพย์ นายกสมาคมสภารักษาความปลอดภัย กล่าวว่า ในนามสมาคมสภารักษาความปลอดภัย ต้องขอขอบคุณท่านรัฐมนตรีว่าการกระทรวงแรงงาน และผู้บริหารกระทรวงแรงงานเป็นอย่างยิ่งที่ท่านให้ความสำคัญกับความเป็นอยู่ของพี่น้องอาชีพ รปภ.และวันนี้ท่านรัฐมนตรีลงมารับฟังปัญหาดังกล่าวด้วยตนเอง ซึ่งท่านได้ให้ความมั่นใจว่าจะหารือกับทุกฝ่ายที่เกี่ยวข้องในรูปแบบไตรภาคี เพื่อให้ได้ข้อสรุปและเกิดประโยชน์กับพี่น้อง รปภ.โดยเร็วต่อไป
On December 8, 2023, at 08.30 hours, the Labour Minister, Mr. Phiphat Ratchakitprakarn, chaired the meeting with 18 organizations affiliated with the security professional network, led by the President of the Security Services Association of Thailand, Acting Lt. Col. Sittiporn Balthip, and committee. The group met with the Labour Minister to discuss halting and reconsidering the proposed draft law on the payment of wages for security guards in excess of 8 hours or the payment of wages for working on holidays, to receive the same amount as other employees in general. It will be considered by the Cabinet on December 12. The Secretariat to the Labour Minister, Mr. Aree Krainara, the Deputy Permanent Secretary of Labour, Mr. Decha Pruekphathanarak, and the Ministry of Labour’s Inspector-General and Acting Director-General of the Department of Labor Protection and Welfare, Mrs. Sopa Kieatnircha, joined the meeting at the Labour Relations Committee meeting room, Department of Labour Protection and Welfare, 1st Floor, Ministry of Labour.
Mr. Phiphat thanked the President of the Security Services Association of Thailand and the delegation for the meeting to discuss and reconsider the proposed draft law on the payment of wages for security guards in excess of 8 hours or the payment of wages for working on holidays, coming from the concern that it will impact the hiring of security guards. He listened to all proposals by the 18 member organizations of the security professional network presented today, which will reviewed further. All parties, including employer and employee representatives, will then be invited to discuss and find a solution. On the topics of security guards, they may need to discuss compensation in cases where they work beyond 8 hours a day. The Federation of Thai Industries and the Thai Chamber of Commerce, who hire security guards, will need to be involved. For announcements, it is necessary to discuss the duration of each company’s contract to find neutral conclusions for both security guards’ benefit and employers’ sustainability and for the Ministry of Labour itself to operate smoothly. This will align with government policy that supports each profession to receive higher wages according to skill standards so that they are higher than the minimum wage and workers have a better quality of life, in line with the current economic conditions.
“I will take this matter into discussion with the Ministry’s Secretary and Acting Director-General of the Department of Labour Protection and Welfare. We will invite organizations in the security professional network to discuss this topic in a tripartite format, including security companies, employers, and related agencies, to conclude quickly,” concluded Mr. Phiphat.
After the discussion finished, Mr. Phiphat met with the security guards, who waited to hear the results of the discussion and shared words of encouragement. The security guards were united in expressing their thanks to the Labour Minister, Mr. Phiphat Ratchakitprakarn. They appreciated him for meeting them, listening to the matter, and confirming that the matter would be discussed further to conclude quickly. This made a great impression on the security guard and 18 organizations affiliated with the security professional network.
The President of the Security Services Association of Thailand, Acting Lt. Col. Sittiporn Balthip, said that on behalf of the Security Services Association of Thailand, he thanked the Labour Minister and the Ministry of Labour’s executives for their concern and priority for the well-being of professional security guards. Today, the Labour Minister came down to listen to the problems in person and assured the people that he would discuss the matter with all parties involved in a tripartite manner to reach a conclusion that will benefit security guards as soon as possible.
