รัฐมนตรีว่าการกระทรวงแรงงาน สั่งเข้ม กรมการจัดหางาน ตรวจสอบการทำงานแรงงานต่างด้าว พบฝ่าฝืนทำงานห้าม มีโทษทั้งนายจ้าง และลูกจ้าง โดยไม่มีข้อยกเว้น
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า จากกรณีมีข้อร้องเรียนผ่านสื่อมวลชนว่ามีแรงงานต่างด้าวเข้ามาประกอบอาชีพ เร่ขายสินค้า ขายอาหาร นวดแผนไทย และช่างทำผม ในพื้นที่กรุงเทพมหานคร และปริมณฑลเป็นจำนวนมาก นั้น กระทรวงแรงงานขอย้ำเตือนอีกครั้งว่าอาชีพ “ ขายสินค้า, ขายอาหาร, นวดแผนไทย และช่างทำผม เป็นอาชีพที่ชาวต่างชาติห้ามทำโดยเด็ดขาด ซึ่งระบุไว้ในประกาศกระทรวงแรงงาน เรื่อง กำหนดงานที่ห้ามคนต่างด้าวทำ หลังทราบเรื่อง ตนไม่นิ่งนอนใจได้มอบหมายให้อธิบดีกรมการจัดหางานลงพื้นที่ปูพรมตรวจสอบการทำงานของแรงงานต่างด้าวและสถานประกอบการอย่างเคร่งครัด โดยเฉพาะกลุ่มแรงงานต่างด้าวที่แย่งอาชีพคนไทย เพื่อตรวจสอบ ควบคุม และดำเนินคดีแรงงานต่างด้าวที่ทำงานผิดกฎหมาย พร้อมประชาสัมพันธ์สร้างการรับรู้ให้นายจ้างสถานประกอบการ และแรงงานต่างด้าวที่เข้ามาทำงานในประเทศไทยปฏิบัติตามกฎหมายอย่างถูกต้อง
“งานที่ห้ามแรงงานต่างด้าวทำมีทั้งสิ้น 40 งาน แบ่งเป็น งานที่ห้ามทำเด็ดขาด 27 งาน และงานที่ให้คนต่างด้าวทำได้โดยมีเงื่อนไข 13 งาน ซึ่งหากตรวจพบการฝ่าฝืนกฎหมาย คนต่างชาติทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือสิทธิจะมีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกผลักดันส่งกลับ และในส่วนนายจ้างที่จ้างคนต่างชาติที่ไม่มีใบอนุญาตทำงาน หรือให้คนต่างชาติทำงานนอกเหนือสิทธิจะมีโทษปรับตั้งแต่ 10,000-100,000 บาทต่อคนต่างชาติที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องมีโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท หรือทั้งจำทั้งปรับ และห้ามจ้างคนต่างชาติทำงานเป็นเวลา 3 ปี ” รัฐมนตรีว่าการกระทรวงแรงงาน กล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า กรมการจัดหางานรับข้อสั่งการจากรัฐมนตรีว่าการกระทรวงแรงงาน โดยมอบหมายกองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน สำนักงานจัดหางานจังหวัด และสำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 ลงพื้นที่ตรวจสอบการทำงานของคนต่างด้าว นายจ้าง สถานประกอบการ และคนต่างด้าวที่เข้ามาแย่งอาชีพคนไทย โดยปีงบประมาณ 2565 มีการตรวจสอบนายจ้าง/สถานประกอบการ จำนวน 35,258 ราย/แห่ง และดำเนินคดีคนต่างด้าวแย่งอาชีพคนไทย จำนวน 918 คน และปีงบประมาณ พ.ศ. 2566 (1 ต.ค. 65 – 29 ธ.ค. 65) มีการตรวจสอบนายจ้าง/สถานประกอบการ จำนวน 17,476 ราย/แห่ง และดำเนินคดีคนต่างด้าวแย่งอาชีพคนไทย จำนวน 295 คน
“ ล่าสุดวันที่ 5 ม.ค. 2565 เจ้าหน้าที่ชุดเฉพาะกิจฯ กรมการจัดหางาน ได้ดำเนินการตรวจแรงงานต่างด้าวแย่งอาชีพคนไทยโดยได้เข้าตรวจสอบนายจ้าง/สถานประกอบการในเขตพื้นที่ จังหวัดนนทบุรีและกรุงเทพมหานครรวมทั้งสิ้น จำนวน 56 แห่ง/รายพบแรงงานต่างด้าวสัญชาติเมียนมากระทำความผิดประกอบอาชีพแย่งอาชีพคนไทยจำนวน 8 ราย และได้ควบคุมตัวส่งพนักงานสอบสวน สถานีตำรวจบางขุนเทียนดำเนินคดีในข้อหาเป็นคนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ์จะทำได้ตาม มาตรา 8 แห่ง พระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ.2560 แก้ไขเพิ่มเติม (ฉบับที่ 2) พ.ศ.2561”
ทั้งนี้ สำหรับผู้ที่พบเห็นคนต่างด้าวทำงานนอกเหนือสิทธิหรือพบเห็นการจ้างคนต่างด้าวทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน หรือแจ้งเบาะแสโดยตรงที่กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน โทร. 02 354 1729
The Labour Minister instructed the Department of Employment to check the work of foreign workers. If any violations of prohibited work are found, penalties will be imposed on employers and employees without exception.
The Labour Minister, Mr. Suchart Chomklin, spoke about the complaints appearing through the media that foreign workers are working as peddlers, food sellers, and Thai massage and hairdressers in Bangkok and surrounding areas. He said that the Ministry of Labour would like to give a reminder that professions selling goods, selling food, Thai massage, and hairdressing are professions that foreigners are strictly forbidden to do, which is specified in the Ministry of Labour’s notification on occupations prohibited by foreigners. Having heard the news, he assigned the Department of Employment’s Director-General to visit the area to inspect the work of foreign workers and workplaces. In particular, the inspection focused on groups of foreign workers taking occupations reserved for Thai people to inspect, monitor and prosecute illegal foreign workers in wrongdoing. They also publicized the information to create awareness for employers, establishments, and foreign workers who come to work in Thailand to ensure proper compliance with the law.
“There are 40 occupations prohibited by foreign workers, comprising 27 strictly prohibited and 13 permitted with conditions. Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. Employers who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years,” said the Labour Minister.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, said the Department of Employment received orders from the Labour Minister. He assigned the Central Employment Registration and Job Seeker Protection Division, the Provincial Employment Offices, and Bangkok Employment Offices Area 1-10 to inspect the work of foreigners, employers, establishments, and foreigners occupying professions reserved for Thai people. In the 2022 fiscal year, 35,258 employers/business establishments were inspected, and 918 foreigners were prosecuted for taking occupations reserved for Thai people. In the 2023 fiscal year (October 1, 2022- December 29, 2022), 17,476 employers/business establishments were inspected, and 295 foreigners were prosecuted for taking occupations reserved for Thai people.
“On January 5, 2023, the Department of Employment’s special task force inspected foreign workers taking up Thai occupations by examining employers/establishments in Nonthaburi and Bangkok. A total of 56 places were inspected, and 8 Myanmar migrant workers were found guilty of taking occupations reserved for Thai people. They were detained, sent for investigation at the Bang Khun Thian Police Station, and prosecuted for being a foreigner working outside of their rights under Section 8 of the Emergency Decree on Managing the Work of Foreigners, B.E. 2560, amended (No. 2), B.E. 2561.”
