ที่ประชุม คบต. เห็นชอบ 3 ประเด็น ขยายเวลาให้กลุ่มที่ยื่นขออนุญาตทำงานและจ่ายค่าธรรมเนียมแล้ว, ขยายเวลาให้บริการ ศูนย์ CI และขยายเวลาอยู่ต่อกลุ่ม MOU ครบ 4 ปี
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เป็นประธานการประชุมคณะกรรมการนโยบายการบริหารจัดการการทำงานของคนต่างด้าว (คบต.) ครั้งที่ 1/2566 โดยมีนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน ผู้บริหารกรมการจัดหางาน และหน่วยงานที่เกี่ยวข้องร่วมประชุม โดยนายสุชาติกล่าวว่า วันนี้ที่ประชุม คบต.ได้เห็นชอบ 3 ข้อพิจารณา ดังนี้
1.เห็นชอบแนวทางการบริหารจัดการการทำงานของคนต่างด้าวภายหลังวันที่ 13 กุมภาพันธ์ 2566 โดยผ่อนผันให้คนต่างด้าวที่ยื่นขอต่อใบอนุญาตทำงาน และชำระค่าธรรมเนียมผ่านระบบอิเล็กทรอนิกส์ กรมการจัดหางาน ภายในวันที่ 13 กุมภาพันธ์ 2566 แล้ว สามารถอยู่ในราชอาณาจักรเป็นกรณีพิเศษและทำงานได้ถึงวันที่ 15 พฤษภาคม 2566
เพื่อจัดทำหนังสือเดินทางหรือเอกสารใช้แทนหนังสือเดินทาง โดยระหว่างที่ยังไม่ได้รับใบอนุญาตทำงานจากกรมการจัดหางาน ให้ใช้ใบรับคำขอต่ออายุใบอนุญาตทำงาน หรือทะเบียนใบอนุญาตทำงาน ตามแต่ละกรณี คู่กับใบเสร็จรับเงิน เพื่อใช้แสดงต่อพนักงานเจ้าหน้าที่ว่าได้รับอนุญาตทำงานตามกฎหมายแล้ว ทั้งนี้ เมื่อดำเนินการครบตามขั้นตอนแล้ว คนต่างด้าวจะได้รับอนุญาตทำงานถึงวันที่ 13 กุมภาพันธ์ 2567 หรือวันที่ 13 กุมภาพันธ์ 2568 แล้วแต่กรณี
2.พิจารณาขยายระยะเวลาการดำเนินการออกเอกสารรับรองบุคคล (Certificate of Identity : CI) ของทางการเมียนมา ในพื้นที่ 4 จังหวัด ได้แก่ จังหวัดสมุทรสาคร สมุทรปราการ ระนอง และชลบุรี ให้ดำเนินการได้ไม่เกินวันที่ 13 พฤษภาคม 2566 (90 วัน) และขอความร่วมมือทางการเมียนมาเพิ่มสถานที่ออกเอกสารรับรองบุคคล (CI)
3.เห็นชอบให้คนต่างด้าวที่เข้ามาทำงานตาม MOU ที่วาระการจ้างงานครบ 4 ปี อยู่ในราชอาณาจักรเป็นกรณีพิเศษและทำงาน โดยกลุ่มที่ครบกำหนด 4 ปี ตั้งแต่วันที่ 1 พฤศจิกายน 2563-31 ธันวาคม 2565 ประมาณ 60,000 คน และกลุ่มที่วาระการจ้างงานครบ 4 ปี ระหว่างวันที่ 1 มกราคม-31 กรกฎาคม 2566 จำนวน 50,000 คน ให้อยู่ในราชอาณาจักรเป็นกรณีพิเศษไม่เกิน 6 เดือน นับจากวันที่การอนุญาตให้อยู่ในราชอาณาจักรสิ้นสุดลง เพื่อดำเนินการขออนุญาตนำแรงงานต่างด้าวที่ได้รับการผ่อนผันเข้ามาทำงานตาม MOU ควบคู่ไปด้วย โดยไม่ต้องเดินทางกลับประเทศต้นทาง หรือเดินทางกลับเพียงระยะสั้น ทั้งนี้ ขึ้นอยู่กับประเทศต้นทาง
นายสุชาติกล่าวว่า “พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี ให้ความสำคัญกับการฟื้นฟูเศรษฐกิจของประเทศไทย หลังสถานการณ์โควิด-19 คลี่คลายอย่างยิ่ง โดยได้กำชับกระทรวงแรงงาน บูรณาการร่วมกับหน่วยงานที่เกี่ยวข้อง วางแนวทางป้องกันปัญหาการขาดแคลนแรงงาน โดยเฉพาะงานที่คนไทยไม่ทำ และจำเป็นต้องใช้แรงงานข้ามชาติ
เพื่อให้ผู้ประกอบการมีแรงงานในการขับเคลื่อนกิจการ จึงเป็นที่มาของการเสนอข้อพิจารณา ทั้ง 3 ประเด็นในวันนี้ โดยล่าสุดกรมการจัดหางานได้มีหนังสือไปสอบถามความเห็นจากประเทศต้นทางแล้ว และอยู่ระหว่างรอหนังสือตอบกลับ ระหว่างนี้ทุกหน่วยงานที่เกี่ยวข้องจะดำเนินการในส่วนที่รับผิดชอบ เพื่อเตรียมเสนอต่อที่ประชุมครม.ต่อไป” รัฐมนตรีว่าการกระทรวงแรงงานกล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า ทางการเมียนมามีหนังสืออย่างเป็นทางการถึงประเทศไทย ถึง 2 ฉบับ ขอให้พิจารณาขยายระยะเวลาการผ่อนผันให้แรงงานเมียนมา ดำเนินการเพื่อมีหนังสือเดินทางจนถึงเดือนสิงหาคม 2566 เนื่องจากคนต่างด้าวที่เข้ามาทำงานตาม MOU ซึ่งวาระการจ้างครบ 4 ปี หนังสือเดินทางกำลังทยอยหมดอายุและอยู่ระหว่างการจัดทำหนังสือเดินทางฉบับใหม่ และขอให้พิจารณาขยายระยะเวลาการดำเนินการออกเอกสารรับรองบุคคลออกไปอีก 6 เดือน
นอกจากนี้ กรมการจัดหางานยังได้รับการประสานจากภาคเอกชนถึงปัญหาขัดข้องที่สถานทูตไม่สามารถจัดทำหนังสือเดินทางเล่มใหม่ได้ทันภายในวันที่ 1 สิงหาคม 2565 จากข้อเสนอของทางการเมียนมาและภาคเอกชนดังกล่าว จึงจำเป็นต้องมีแนวทางการบริหารจัดการการทำงานของคนต่างด้าวในส่วนที่เกี่ยวข้องให้สามารถอยู่ในราชอาณาจักรเป็นกรณีพิเศษ เพื่อการทำงานในช่วงระยะเวลาที่อยู่ระหว่างการจัดทำหนังสือเดินทาง หรือเอกสารรับรองบุคคลฉบับใหม่ ตลอดจนขยายระยะเวลาการดำเนินการของศูนย์ CI เพื่อสามารถดำเนินการออกเอกสารรับรองบุคคลให้เสร็จสิ้น
The Foreign Worker Management Policy Committee approved three measures to extend the period for workers that have applied for a work permit and have already paid the fee, extend the service hours of the CI Center, and extend the period for MOU workers for four years to continue working.
The Labour Minister, Mr. Suchart Chomklin, chaired the Foreign Worker Management Policy Committee Meeting No. 1/2023. The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, the Department of Employment’s executives, and relevant agencies joined the meeting. Mr. Suchart said that today at the meeting, the Foreign Worker Management Policy Committee approved three measures as follows:
1. Guidelines for managing the work of foreigners after February 13, 2023, allowing foreigners who apply for a work permit extension and pay fees via the electronic system by February 13, 2023, to stay in the Kingdom as a special case and work until May 15, 2023, to prepare a passport or document to be used in place of a passport. While waiting for the work permit from the Department of Employment, the workers can use the work permit renewal application form or work permit registration, together with the receipt, to show the competent officials that they have been permitted to work according to the law. Foreigners will be permitted to work until February 13, 2024, or February 13, 2025, as the case may be.
2. Extending the period for issuing Certificate of Identity (CI) of the Myanmar authorities in four provinces: Samut Sakhon, Samut Prakan, Ranong, and Chonburi, no later than May 13, 2023 (90 days) and ask for cooperation from the Myanmar authorities to expand the place of issuing the CI.
3. Foreigners who come to work under the MOU whose employment term has completed four years to stay in the Kingdom as a special case and work. There are about 60,000 workers that completed four years from November 1, 2020 – December 31, 2022, and 50,000 completed the 4-year employment term between January 1 – July 31, 2023. These group of workers can stay in the Kingdom as a special case for no more than six months from the date the permission to stay in the Kingdom ends to apply for permission to bring foreign workers who have received a waiver to work under the MOU alongside without having to return to their country of origin or a short return trip, depending on the country of origin.
Mr. Suchart said, “Prime Minister General Prayuth Chan-ocha gives importance to Thailand’s economic recovery after the COVID-19 situation has improved. The Ministry of Labour was instructed to work with relevant agencies to lay out guidelines to prevent labour shortages, especially in occupations not taken by Thai people and require migrant workers, to ensure business operators have workers to drive their business. This is the source of the proposal for consideration on all three measures. The Department of Employment sent a letter asking for suggestions from the countries of origin and is waiting for a reply. In the meantime, all relevant agencies will take action in their scope to prepare and present to the Cabinet in the next meeting.
The Department of Employment’s Director-General, Mr. Phairoj Chotikasatien, said that Myanmar sent two official letters to Thailand asking to consider extending the grace period for Myanmar workers to apply for a passport until August 2023 as foreigners who come to work according to the MOU whose employment term has completed four years, the passport is expired and is in the process of preparing a new one. Myanmar requested consideration on extending the process of issuing identity documents for another six months.
In addition, the Department of Employment has also coordinated with the private sector regarding the problem that the embassy cannot produce a new passport in time for August 1, 2022, from the proposals of the Myanmar authorities and the private sector. Therefore, it is necessary to have guidelines for managing the work of foreigners so that they can stay in the Kingdom as a special case for working during the period of processing a new passport or identification document and extending the processing period of the CI Center to be able to complete the issuance of identification documents.
