นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า จากข้อกังวลของสมาคมนักธุรกิจและการท่องเที่ยวเมืองพัทยา (PBTA) ในเรื่องการขาดแคลนแรงงานแม่บ้าน คนทำความสะอาด เนื่องจากคนไทยไม่ทำ และปัจจุบันจำเป็นต้องใช้แรงงานต่างชาติทดแทน จึงเสนอให้พิจารณางานที่ห้ามคนต่างชาติทำใหม่อีกครั้งนั้น กรมการจัดหางานขอชี้แจงว่า กรมการจัดหางานได้กำหนดหลักเกณฑ์การนำคนต่างชาติมาทำงานกับนายจ้างในประเทศและการทำงานของคนต่างชาติ โดยจำกัดเสรีภาพในการประกอบอาชีพเท่าที่จำเป็นเพื่อให้นายจ้าง สถานประกอบการมีแรงงานเพียงพอในการขับเคลื่อนกิจการ โดยไม่ให้เกิดการแย่งอาชีพคนไทย ซึ่งงานแม่บ้าน ทำความสะอาด ถือเป็นงานกรรมกรตามประกาศกระทรวงแรงงาน เรื่อง กำหนดงานที่ห้ามคนต่างด้าวทำ บัญชีที่ 4 ซึ่งมีเงื่อนไขให้คนต่างด้าวทำงานนั้นได้ก็แต่เฉพาะงานที่มีนายจ้างและได้รับอนุญาตให้เข้ามาทำงานตาม MoU จำนวน 2 งาน ได้แก่ งานกรรมกร และงานขายของหน้าร้าน ดังนั้นนายจ้าง สถานประกอบการที่ประสงค์จ้างแรงงานข้ามชาติทำงานดังกล่าว สามารถจ้างแรงงานที่เข้ามาทำงานตาม MOU โดยไม่ต้องกังวลว่าจะเป็นการทำผิดกฎหมาย
อย่างไรก็ตามในส่วนของชาวต่างชาติที่เข้ามาเปิดร้านอาหาร ร้านพลอย หรือเป็นผู้ลงทุนแล้วจ้างคนไทยเปิดกิจการ นั้น กรม ฯ ขอยืนยันว่า ไม่สามารถทำได้ โดยคนต่างชาติที่จะเป็นเจ้าของกิจการต้องเป็นผู้ได้รับอนุญาตให้ประกอบธุรกิจอย่างถูกต้องตามกฎหมาย ซึ่งเงื่อนไขและหลักเกณฑ์เป็นไปตามพรบ.การประกอบธุรกิจของคนต่างด้าว พ.ศ. 2542 และจะต้องมีใบประกอบธุรกิจที่เกี่ยวข้อง เช่น โรงงาน โรงแรม เป็นต้น และหากจ้างคนไทยให้ทำสัญญาแทนก็ไม่สามารถทำได้ โดยทั้งผู้ว่าจ้างและบุคคลที่รับจ้างจะมีความผิดตามพรบ.เดียวกัน
“กรมการจัดหางาน มีการตรวจสอบและดำเนินคดีกับคนต่างชาติที่ทำงานโดยไม่มีใบอนุญาตทำงาน และคนต่างชาติที่แย่งอาชีพคนไทยอย่างเข้มงวดโดย ปีงบประมาณ พ.ศ. 2566 มีการตรวจสอบนายจ้าง/สถานประกอบการแล้ว จำนวน 10,174 แห่ง ดำเนินคดี 360 แห่ง และตรวจสอบคนต่างชาติ จำนวน 156,471 คน ดำเนินคดี 808 คน ในจำนวนนี้เป็นคนต่างชาติที่แย่งอาชีพคนไทย จำนวน 435 คน ซึ่งอาชีพห้ามที่พบแรงงานต่างด้าวทำงานมากที่สุด ได้แก่ งานเร่ขายสินค้า งานตัดผม งานนวดไทย และงานขับขี่ยานพาหนะ ตามลำดับ” อธิบดีกรมการจัดหางาน กล่าว
The Labour Minister Mr. Suchart Chomklin spoke about concerns raised by the Pattaya Business and Tourism Association (PBTA) on the shortage of domestic workers and cleaners, as Thai people take up these occupations which, therefore, require foreign workers instead. Thus, the association proposed considering occupations foreigners are prohibited from doing again. The Department of Employment clarified that it had set rules for employers bringing foreign workers into the country, including the nature of work done by foreigners, by limiting freedom on occupations as necessary so that employers and business operators have enough workers to drive the business without taking away careers from Thai people. The housekeeping job follows the Ministry of Labour’s notification on occupations prohibited by foreigners in List 4, which outlines conditions allowing foreigners to work only for jobs that have employers and are allowed to work according to the MOU. Two jobs are listed: manual labour jobs, and store sales jobs. Therefore, employers and business operators wishing to employ migrant workers can hire workers who come to work according to the MOU without worrying about breaking the law.
However, the Department confirmed that foreigners could not open a restaurant or a gem shop or are investors and hire Thai people to open a business. Foreigners who are business owners must be licensed to operate the business legally. The conditions and criteria must follow the Foreign Business Act B.E. 2542. According to the same Act, the employer and the hired person will be guilty.
“The Department of Employment has conducted investigations and prosecution against foreigners working without a work permit, including those occupying jobs reserved for Thai people. In the 2023 fiscal year, 10,174 employers/establishments have been inspected, and 360 prosecuted. 156,471 foreigners have been examined, and 808 prosecuted, including 435 foreigners occupying professions reserved for Thais. Prohibited jobs with the most foreign workers occupying them included peddling goods, hairdressers, Thai massages, and driving vehicles, respectively,” said the Director-General of the Department of Employment.
