วันที่ 24 กุมภาพันธ์ 2566 นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน สั่งการกรมการจัดหางาน ลงพื้นที่ปากคลองตลาด เพื่อตรวจสอบ ปราบปรามคนต่างชาติที่ลักลอบทำงานโดยผิดกฎหมายและคนต่างชาติที่ไม่ดำเนินการตามมติคณะรัฐมนตรีเมื่อวันที่ 5 กรกฎาคม 2565 ที่นายจ้างนำมาทำงานในสถานประกอบการ โดยมี นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน ร่วมกับ พ.ต.ท.ภาวัต วรรธสุภัทร รอง ผกก.จร รักษาราชการแทน ผกก สน.พระราชวัง นำชุดอำนวยการฯ และเจ้าหน้าที่สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 8 ลงพื้นที่ตรวจสอบ
นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า กรมการจัดหางานลงพื้นที่ตรวจสอบการทำงานของแรงงานต่างชาติ ณ พื้นที่ปากคลองตลาด เพื่อตรวจบังคับใช้กฎหมายกับคนต่างชาติที่ไม่มีใบอนุญาตทำงาน ทำงานนอกเหนือสิทธิ โดยเรื่องนี้สืบเนื่องจากที่ พล.อ. ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี มีข้อสั่งการให้กระทรวงแรงงานกวาดล้างแรงงานต่างชาติแย่งงานคนไทยอย่างเข้มงวด เพื่อมิให้กระทบต่อโอกาสการมีงานทำของคนไทย และส่งผลต่อความมั่นคงและระบบเศรษฐกิจของประเทศไทย ซึ่งจากการตรวจสอบสถานประกอบการ 7 แห่ง พบคนต่างด้าวไม่มีใบอนุญาต 3 แห่ง จำนวน 7 คน
นอกจากนั้นยังตรวจพบต่างด้าวเข็นรถขายของแย่งอาชีพคนไทยอีก 7 คน รวมทั้งสิ้นเป็นต่างด้าวที่ทำผิดกฎหมาย 14 คน จึงได้ควบคุมตัวส่งพนักงานสอบสวน สน. พระราชวัง ดำเนินคดีข้อหาเป็นคนต่างด้าวทำงานโดยไม่มีใบอนุญาตทำงาน รวมทั้งร้องทุกข์กล่าวโทษดำเนินคดีนายจ้างจำนวน 3 แห่ง ข้อหารับคนต่างด้าวทำงาน โดยที่คนต่างด้าวไม่มีใบอนุญาตทำงาน ซึ่งตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม คนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศต้นทาง รวมถึงห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี นับตั้งแต่วันที่ได้รับโทษ และนายจ้าง/สถานประกอบการที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี
“ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 023541729 หรือสำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน” อธิบดีกรมการจัดหางาน กล่าว

On February 24, 2023, the Labour Minister, Mr. Suchart Chomklin, instructed the Department of Employment to visit the Pak Khlong Talat area to inspect and suppress foreigners working illegally and foreigners who do not comply with the Cabinet’s resolution on July 5, 2022, employed by employers in business establishments.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, joined the Deputy Superintendent and Acting Superintendent of the Royal Palace Police Station, Pol. Lt. Col. Pawat Wattasuphat, who led the administrative team and staff from the Bangkok Employment Office Area 8 to inspect the area.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, said that the Department of Employment inspected foreign workers in the Pak Khlong Talat area to examine law enforcement on foreigners without work permits or work beyond their rights. Prime Minister General Prayuth Chan-ocha has ordered the Ministry of Labour to crack down on foreign workers competing for jobs with Thai people to not affect the job opportunities of Thai people and the stability and economy of Thailand. From the inspection of 7 establishments, three were found with unlicensed foreign workers, comprising seven people.
In addition, another seven foreigners were found peddling goods and taking professions reserved for Thai people. The 14 illegal workers were detained and sent to investigators at the Royal Palace Police Station for further prosecution for being foreigners working without a work permit. A complaint was also filed to prosecute three employers for hiring illegal foreign workers.
The Foreign Worker Management Emergency Decree B.E. 2560, and its amendments, indicate that foreigners who work without a work permit or work beyond their rights face fines ranging from 5,000 – 50,000 Baht. Employers/business establishments that accept foreigners who do not have work permits to allow foreigners to work beyond their rights face a fine from 10,000 – 100,000 Baht per foreigner employed. Repeated offenses are liable to imprisonment for a term not exceeding one year or a fine ranging from 50,000 – 200,000 Baht per foreigner employed. The employer/establishment would be prohibited from employing foreigners for three years.
“Anyone who sees illegal employment of foreigners can report them to the Central Employment Registration and Job Seeker Protection Division, Department of Employment, Ministry of Labour Building, 4th floor, call 023541729, or contact the Provincial Employment Office in every province, the Bangkok Employment Office Areas 1-10, at the Ministry of Labour’s Hotline on 1506 press 2 for the Department of Employment, or the Department of Employment’s hotline on 1694,” said the Department of Employment’s Deputy Director-General.
