วันที่ 24 กรกฎาคม 2566 เวลา 09.00 น. นายบุญชอบ สุทธมนัสวงษ์ ปลัดกระทรวงแรงงาน มอบหมายให้ นางดรุณี นิธิทวีกุล ผู้ตรวจราชการกระทรวงแรงงาน เป็นประธานในพิธีเปิดโครงการฝึกอบรมเพื่อพัฒนาทักษะการคัดแยกผู้เสียหายจากการค้ามนุษย์ร่วมกับทีมสหวิชาชีพ รุ่นที่ 6 และบรรยายหัวข้อ “นโยบายการป้องกันและแก้ไขการบังคับใช้แรงงานหรือการบริการและการค้ามนุษย์ด้านแรงงาน”ณ โรงแรม ดิ เอมเมอรัลด์ ถนนรัชดาภิเษก เขตดินแดง กรุงเทพมหานคร และอบรมทางไกลผ่านระบบ Zoom Meeting โดยมี นางสาวโสภณา บุญ – หลง ผู้อำนวยการสำนักงานเลขานุการศูนย์บัญชาการป้องกันการค้ามนุษย์ด้านแรงงาน กล่าวรายงานวัตถุประสงค์โครงการ
นางดรุณี กล่าวว่า ตามที่กระทรวงการต่างประเทศสหรัฐอเมริกาได้เผยแพร่รายงานสถานการณ์การค้ามนุษย์ ประจำปี 2566 (TIP Report 2023) เมื่อวันที่ 15 มิถุนายนที่ผ่านมา โดยประเทศไทยได้รับการจัดระดับให้อยู่ใน Tier 2 ติดต่อเป็นปีที่ 2 ซึ่งรายงานดังกล่าวยังคงมีข้อเสนอแนะให้มีการฝึกอบรมเจ้าหน้าที่ให้สามารถนำแนวปฏิบัติตามมาตรา 6/1 ของ พ.ร.บ.ป้องกันและปราบปรามการค้ามนุษย์ พ.ศ. 2551 และที่แก้ไขเพิ่มเติม ไปใช้ในการคัดแยกผู้เสียหายอย่างมีประสิทธิภาพ กำหนดให้ทีมสหวิชาชีพประกอบด้วยเจ้าหน้าที่ที่ผ่านการฝึกอบรมและมีประสบการณ์เพียงพอในการปฏิบัติงานด้านการค้ามนุษย์ เพื่อปรับปรุงประสิทธิภาพในการคัดแยกผู้เสียหาย และเสริมสร้างความตระหนักรู้ให้แก่เจ้าหน้าที่ที่เกี่ยวข้องให้เข้าใจข้อบ่งชี้ของการค้ามนุษย์ เช่น การบังคับทำงานใช้หนี้ การทำงานเกินเวลามากเกินจำเป็น การยึดเอกสารของลูกจ้างและการทำงานโดยไม่จ่ายผลตอบแทน
นางดรุณี กล่าวต่อไปว่า กระทรวงแรงงานเป็นหน่วยงานสำคัญและเป็นหน่วยงานหลักในการต่อต้านการค้ามนุษย์ ภายใต้ยุทธศาสตร์ 20 ปี ด้านความมั่นคง โดยรับผิดชอบเป็นเจ้าภาพหลักในการป้องกันการค้ามนุษย์ของประเทศไทย ซึ่งเป็นนโยบายสำคัญของรัฐบาลที่ได้กำหนดเป็นวาระแห่งชาติ ในการยกระดับมาตรฐานการคุ้มครองดูแลและป้องกันไม่ให้แรงงานไทยและแรงงานต่างด้าวตกเป็นผู้เสียหายจากการค้ามนุษย์ ในปีงบประมาณ พ.ศ. 2566 และท่านสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน ได้มอบหมายให้หน่วยงานสังกัดกระทรวงแรงงานทั้งส่วนกลางและส่วนภูมิภาคนำมาตรฐานการปฏิบัติงาน (SOP) ในการคัดกรองผู้เสียหายจากการค้ามนุษย์ด้านแรงงานและการบังคับใช้แรงงาน และการนำแผนปฏิบัติการว่าด้วยกลไกการส่งต่อระดับชาติฯ (NRM) นำไปใช้เป็นแนวทางในการปฏิบัติงานด้านการป้องกันและแก้ไขปัญหาการบังคับใช้แรงงานหรือบริการและการค้ามนุษย์ด้านแรงงาน เพื่อเพิ่มประสิทธิภาพการคัดแยกผู้เสียหายจากการบังคับใช้แรงงานและการค้ามนุษย์ด้านแรงงานร่วมกับทีมสหวิชาชีพ ซึ่งเป็นการยกระดับการป้องกันและแก้ไขปัญหาการค้ามนุษย์ของประเทศไทยให้เทียบเท่ากับมาตรฐานขั้นต่ำในกฎหมายคุ้มครองผู้เสียหายจากการค้ามนุษย์ ค.ศ. 2000 (TVPA) ของประเทศสหรัฐอเมริกา
“กระทรวงแรงงาน พร้อมผนึกกำลังกับทุกภาคส่วน ไม่ว่าจะเป็นผู้เข้าร่วมการอบรมจากหน่วยงานทีมสหวิชาชีพจากส่วนกลาง ได้แก่ กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ สำนักงานตำรวจแห่งชาติ กองอำนวยการรักษาความมั่นคงภายในราชอาณาจักร (กอ.รมน.) กรมการปกครอง และเจ้าหน้าที่สำนักงานแรงงานจังหวัด สำนักงานจัดหางานจังหวัด และสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดทั้ง 19 จังหวัด รวมจำนวนทั้งสิ้น 64 คน อบรมระหว่างวันที่ 24 – 26 กรกฎาคม 2566 เพื่อให้ผู้อบรมมีความรู้ความเข้าใจเกี่ยวกับนโยบายการป้องกันและปราบปรามการค้ามนุษย์ การขับเคลื่อนการต่อต้านการค้ามนุษย์ ขจัดการบังคับใช้แรงงานและการค้ามนุษย์ในประเทศไทย เพื่อให้ประเทศไทยสามารถปฏิบัติตามมาตรฐานขั้นต่ำของสหรัฐฯ และได้รับการจัดอันดับในรายงานการค้ามนุษย์ให้อยู่ในระดับ Tier 1 ต่อไป”นางดรุณี กล่าวท้ายสุด
On July 24, 2023, at 09.00 hours, the Permanent Secretary of Labour, Mr. Boonchob Suttamanaswong, assigned the Ministry of Labour’s Deputy Chief Inspector-General, Mrs. Darunee Nithithaweekul, to preside over the opening ceremony of the training program on identifying human trafficking victims, together with the multidisciplinary team, batch six, and to speak on “policies for the prevention and remediation of forced labour or services and human trafficking in persons.” The occasion took place at the Emerald Hotel, Ratchadaphisek Road, Din Daeng District, Bangkok, and online via Zoom Meetings. The Director of the Office of the Secretariat of the Labour Trafficking Prevention Command Center, Ms. Sopana Boon-Long, reported on the project’s objectives.
Mrs. Darunee said the U.S. Department of State published the 2023 Trafficking in Persons Report (TIP Report 2023) on June 15. Thailand was ranked in Tier 2 for the second year in a row. The report suggested training officials comply with Section 6/1 of the Anti-Human Trafficking Act B.E. 2551 and its amendments to effectively separate victims and to set up a multidisciplinary team consisting of trained staff with sufficient experience in human trafficking operations to improve the efficiency of victim identification and raise awareness among relevant officials to understand the indications of human trafficking, such as forced labour, debt repayment, working overtime more than necessary, confiscation of employee documents and work without pay.
Mrs. Darunee said that the Ministry of Labour is important and the main anti-trafficking agency under the 20-year strategy on security. It is the main host in preventing human trafficking in Thailand. This is an important government policy set on the national agenda to raise protection standards and prevent Thai and foreign workers from becoming victims of human trafficking. In the 2023 fiscal year, the Labour Minister, Mr. Suchart Chomklin, has assigned agencies under the Ministry of Labour in both central and provincial areas to adopt the Standard Operating Procedures (SOPs) in screening victims of human trafficking and forced labour and the implementation of the National Referral Mechanism (NRM) Action Plan as a guideline for the prevention and remediation of forced labour or services, and human trafficking in persons. It aims to increase the efficiency of identifying victims of forced labour and human trafficking in collaboration with a multidisciplinary team. The collaboration raises the level of anti-trafficking in Thailand to meet the minimum standards outlined in the Trafficking Victims Protection Act of 2000 (TVPA) of the United States.
“The Ministry of Labour is ready to join forces with all sectors and participants from the central interdisciplinary team, namely the Ministry of Social Development and Human Security, the Royal Thai Police, the Internal Security Operations Command (ISOC), the Department of Provincial Administration, officials from Provincial Labour Offices, Provincial Employment Offices and the Provincial Labour Protection and Welfare Offices in all 19 provinces, for a total of 64 people. The training took place between July 24-26, 2023, for participants to have knowledge and understanding about the prevention and suppression of human trafficking policy and advocacy against human trafficking, to eliminate forced labour and human trafficking in Thailand so that Thailand can comply with the minimum standards of the United States and continue to become ranked in the Human Trafficking Report as Tier 1,” concluded Mrs. Darunee.
