เมื่อวันที่ 21 ธันวาคม 2566 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน มอบหมายให้ นายอารี ไกรนรา เลขานุการรัฐมนตรีว่าการกระทรวงแรงงาน พร้อมด้วย นายภูมิพัฒน์ เหมือนจันทร์ โฆษกกระทรวงแรงงาน (ฝ่ายการเมือง) นายวรรณรัตน์ ศรีสุขใส รองปลัดกระทรวงแรงงาน นางโสภา เกียรตินิรชา ผู้ตรวจราชการกระทรวงแรงงาน รักษาราชการแทนอธิบดีกรมสวัสดิการและคุ้มครองแรงงาน และผู้บริหารกระทรวงแรงงาน เจ้าหน้าที่หน่วยงานที่เกี่ยวข้องหารือชี้แจง และทำความเข้าใจการช่วยเหลือกรณีที่ลูกจ้างบริษัท บอดี้ แฟชั่น (ประเทศไทย) จำกัด บริษัท แอลฟ่า สปินนิ่ง จำกัด และบริษัท เอเอ็มซี สปินนิ่ง จำกัด จำนวนประมาณ 250 คน นำโดย นายสมยศ พฤกษาเกษมสุข นางสาวธนพร วิจันทร์ แกนนำกลุ่มเครือข่ายแรงงานเพื่อสิทธิประชาชน ที่ได้นัดรวมพลเดินขบวนจากอนุสาวรีย์ชัยสมรภูมิมาชุมนุมปักหลังบริเวณด้านหน้ากระทรวงแรงงานเพื่อเรียกร้องสิทธิเงินชดเชยตามกฎหมายที่พนักงานตรวจแรงงานได้ออกคำสั่งตามกฎหมายคุ้มครองแรงงาน
นายอารี กล่าวว่า ท่านพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน ได้มีความห่วงใยในความเป็นอยู่ของพี่น้องแรงงานที่ได้รับความเดือดร้อนทุกคน เช่นเดียวกับกรณีที่ลูกจ้างของสถานประกอบการทั้ง 3 แห่ง ที่ได้รวมตัวกันเรียกร้องเงินชดเชยสิทธิตามกฎหมายที่พนักงานตรวจแรงงานได้ออกคำสั่งไปแล้วนั้น
ในเรื่องนี้ ท่านรัฐมนตรีพิพัฒน์ฯ จึงมอบหมายให้ผมพร้อมด้วยรองปลัดกระทรวงแรงงาน และ รักษาการอธิบดีกรมสวัสดิการและคุ้มครองแรงงาน และเจ้าหน้าที่ที่เกี่ยวข้องได้หารือถึงการให้ความช่วยเหลือลูกจ้างกรณีดังกล่าว พร้อมชี้แจงและทำความเข้าใจว่า ที่ผ่านมาหน่วยงานในสังกัดกระทรวงแรงงานได้ให้ความช่วยเหลือลูกจ้างบริษัททั้ง 3 แห่ง รวมประมาณ 1,500 คน ดังนี้ กรมสวัสดิการและคุ้มครองแรงงาน ได้บังคับใช้กฎหมายคุ้มครองแรงงานกับนายจ้างอย่างเข้มงวด โดยรับคำร้องและออกคำสั่งให้ลูกจ้างได้รับเงินตามสิทธิตามกฎหมาย รวมเป็นเงิน 279 ล้านบาทเศษ พร้อมดอกเบี้ย ลูกจ้างได้รับเงินตามคำสั่งพนักงานตรวจแรงงานดังกล่าวแล้ว เป็นเงินจำนวนกว่า 71 ล้านบาท และกรมสวัสดิการและคุ้มครองแรงงานยังได้จ่ายเงินสงเคราะห์จากกองทุนสงเคราะห์ลูกจ้างเพื่อเยียวยาเพิ่มเติมอีก เป็นจำนวนเงินกว่า 53 ล้านบาท รวมเป็นเงินที่กรมสวัสดิการและคุ้มครองแรงงานได้ให้ความช่วยเหลือตามอำนาจหน้าที่รวมกว่า 124 ล้านบาท คงเหลือเงินที่ลูกจ้างยังไม่ได้รับตามสิทธิอีก จำนวน 155 ล้านบาท ซึ่งกรมสวัสดิการและคุ้มครองแรงงานได้ดำเนินคดีตามกฎหมายกับนายจ้าง ให้ชำระเงินตามคำสั่งให้กับลูกจ้าง เพื่อนำเงินดังกล่าวมาจ่ายให้กับลูกจ้าง โดยกรมบังคับคดีมีความคืบหน้า นำทรัพย์ของนายจ้างมาขายทอดตลาด แต่เนื่องจากยังไม่มีผู้ซื้อจึงยังไม่มีเงินนำมาชำระให้ลูกจ้างตามคำสั่งพนักงานตรวจแรงงาน
นายอารี กล่าวต่อว่า ในส่วนความช่วยเหลือของสำนักงานประกันสังคม ลูกจ้างของทั้ง 3 บริษัท ได้รับเงินชดเชยกรณีว่างงานแล้ว จำนวนกว่า 45.5 ล้านบาท ในส่วนความช่วยเหลือของกรมการจัดหางานได้ดำเนินการจัดหาตำแหน่งงานว่างให้กับลูกจ้างทั้ง 3 บริษัท พิจารณาในเบื้องต้นแล้ว ซึ่งขึ้นอยู่กับความสมัครใจของลูกจ้างในการเลือกเข้าทำงาน นอกจากนี้ กรมพัฒนาฝีมือแรงงานยังให้บริการลูกจ้างที่ประสงค์จะพัฒนาฝีมือแรงงานหรือประกอบอาชีพอิสระได้เข้ารับการอบรมเพื่อพัฒนาฝีมือแรงงานตามหลักสูตรของกรมพัฒนาฝีมือแรงงาน โดยมีเบี้ยเลี้ยงเป็นการช่วยเหลือระหว่างการฝึกอบรมอีกด้วย
“กระทรวงแรงงาน ไม่ได้นิ่งนอนใจ อะไรที่เป็นความเดือดร้อนของพี่น้องผู้ใช้แรงงาน ท่านพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน ได้กำชับให้ทุกหน่วยงานในสังกัดเร่งให้ความช่วยเหลือลูกจ้าง ตามสิทธิและอำนาจหน้าที่ตามกฎหมาย ไม่เคยทอดทิ้ง แต่อย่างไรก็ตามเพื่อบรรเทาความเดือดร้อนกลุ่มลูกจ้างที่มาชุมนุม และติดตามความคืบหน้าให้ได้รับสิทธิตามกฎหมายแรงงานโดยเร็ว ” นายอารี กล่าวท้ายสุด
On December 21, 2023, the Labour Minister, Mr. Phiphat Ratchakitprakarn, assigned the Secretariat to the Labour Minister, Mr. Aree Krainara, the Ministry of Labour’s Spokesperson (on Politics), Mr. Phumiphat Mueanchan, the Deputy Permanent Secretary of Labour, Mr. Wannarat Srisuksai, the Ministry of Labour’s Inspector-General and Acting Director-General of the Department of Labor Protection and Welfare, Mrs. Sopa Kieatnircha, the Ministry of Labour’s executives, and officials from relevant agencies, discussed and clarified support for approximately 250 employees of Body Fashion (Thailand) Company Limited, Alpha Spinning Company Limited, and AMC Spinning Company Limited. The issue was led by Mr. Somyot Pruksakasemsuk and Ms. Thanaporn Wichan, leaders of the Worker’s Network for People’s Rights, who had gathered to march from the Victory Monument to rally in front of the Ministry of Labour to demand compensation in accordance with the law, that the Labour Inspector had issued in accordance with the labour protection law.
Mr. Aree said that the Labour Minister, Mr. Phiphat Ratchakitprakarn, is concerned about the wellbeing of all workers who are suffering. The same is true in the case of employees of the three companies who have joined together to demand compensation for their rights according to the law that the Labour Inspector has already ordered.
On this issue, the Labour Minister assigned Mr. Aree, the Deputy Permanent Secretary of Labour, the Acting Director-General of the Department of Labor Protection and Welfare, and relevant officials to discuss support for the employees in such cases. He explained that in the past, agencies under the Ministry of Labour have assisted employees of all three companies, totaling approximately 1,500 people, as follows. The support includes the Department of Labour Protection and Welfare strictly enforcing labour protection laws against the employers. They accepted the request and issued an order for the employees to receive compensation according to their legal rights, for a total of 279 million Baht, plus interest. The employees have received the compensation according to the said order of the Labour Inspector, whereby the amount is over 71 million Baht. The Department of Labour Protection and Welfare has also paid relief from the Employee Welfare Fund to provide additional relief to the employees. The amount is over 53 million Baht. The total compensation that the Department of Labour Protection and Welfare has provided, in accordance with its authority, is over 124 million Baht. The remaining compensation that the employees have not yet received, which they are entitled to, is another 155 million Baht. The Department of Labour Protection and Welfare has acknowledged this and will take legal action against the employer to ensure payment to the employees. The Legal Execution Department has made progress by selling the employer’s property at auction. But since there is still no buyer, there is still no money to pay the employees according to the Labour Inspector’s orders.
Mr. Aree continued that the Social Security Office has provided employees of all three companies with unemployment compensation, amounting to over 45.5 million Baht. The Department of Employment has provided job vacancies for employees of all three companies, which have been initially considered. Job matching will depend on the employee’s willingness to choose the job. In addition, the Department of Skill Development has provided services to employees who wish to develop their skills or are self-employed to receive training to develop their skills according to the Department of Skill Development’s curriculum. There is also an allowance for support during training.
“The Ministry of Labour has taken measures to support workers in suffering. The Labour Minister, Mr. Phiphat Ratchakitprakarn, has urged all agencies under his supervision to expedite support to the employees, following their rights and duties according to law. It will continue to support and alleviate the suffering of the group of employees who gathered and will follow up on progress to ensure they receive their legal entitlements quickly,” concluded Mr. Aree.
