วันที่ 21 เมษายน 2566 นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงผลการประชุมระดับวิชาการกัมพูชา – ไทย ว่าตามที่ได้รับรายงานจาก นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน ซึ่งเป็นหัวหน้าคณะผู้แทนฝ่ายไทย เข้าร่วมการประชุมร่วมกับ ดร.เส็ง ศักดา (H.E.Seng Sakda) อธิบดีกรมแรงงาน กระทรวงแรงงานและการฝึกอาชีพ แห่งราชอาณาจักรกัมพูชา ที่โรงแรมอังกอร์พาราไดซ์ จังหวัดเสียมราฐ ราชอาณาจักรกัมพูชา เมื่อวันที่ 19 – 21 เมษายน 2566 ซึ่งภายหลังการประชุมดังกล่าวทั้งสองฝ่ายได้มีการลงนามบันทึกข้อตกลงว่าด้วยการจ้างแรงงานระหว่างรัฐบาลแห่งราชอาณาจักรไทยและรัฐบาลแห่งราชอาณาจักรกัมพูชา โดยมีผลการประชุมที่สำคัญ ดังนี้ การออกเอกสารประจำตัวให้แก่แรงงานกัมพูชาในประเทศไทย แรงงานกัมพูชาสามารถเดินทางไปทำเอกสารเดินทาง (TD) ณ ศูนย์ One Stop Services ซึ่งตั้งอยู่ในกรุงพนมเปญ พระตะบอง และบันเตียเมียนเจย กรณีแรงงานกัมพูชาไม่มีเอกสารเดินทาง สามารถขอเอกสารข้ามแดนได้ที่สถานเอกอัครราชทูตกัมพูชาประจำราชอาณาจักรไทย เพื่อเดินทางไปกัมพูชาเพื่อขอบัตรแรงงานกัมพูชาในต่างแดน (Overseas Cambodia Worker Card : OCWC) และเอกสารเดินทาง (TD) ณ ศูนย์ One Stop Services ได้ ทั้งนี้ ฝ่ายไทยจะแจ้งข้อมูลของแรงงานกัมพูชาที่จำเป็นต้องจัดทำเอกสาร เพื่อเป็นข้อมูลพื้นฐานสำหรับการตรวจสอบและยืนยันข้อมูลเพื่อพิจารณาออกเอกสารเดินทาง (TD) ฉบับใหม่
นายสุชาติ ยังกล่าวถึงรายงานผลการประชุมวิชาการต่อว่า สำหรับการปรับปรุงแก้ไขบันทึกข้อตกลงว่าด้วยการจ้างแรงงาน (Agreement) ระหว่างรัฐบาลแห่งราชอาณาจักรไทยกับรัฐบาลแห่งราชอาณาจักรกัมพูชานั้น ทั้งสองฝ่ายเห็นชอบให้การตรวจสุขภาพในประเทศต้นทางต้องกำหนดโดยหน่วยงานที่มีอำนาจของประเทศผู้รับ โดยแรงงานจะต้องตรวจสุขภาพจากประเทศต้นทางก่อนที่แรงงานจะเดินทางเข้ามาในประเทศไทย สำหรับการแก้ไขบทเฉพาะกาล ทั้งสองฝ่ายเห็นชอบให้ประเทศผู้รับสามารถปรับขั้นตอนการบริหารจัดการแรงงานโดยเน้นที่การคุ้มครองสิทธิ และประโยชน์ในกรณีที่เกิดภัยพิบัติหรือสถานการณ์ที่ไม่คาดคิดที่กระทบต่อนโยบายและประสิทธิภาพในการจัดส่งแรงงานในส่วนของการจัดตั้งศูนย์สนับสนุนแรงงานกัมพูชา (Cambodian Migrant Workers Supporting Center) ในประเทศไทย ฝ่ายไทยรับทราบและจะนำประเด็นดังกล่าวไปหารือกับหน่วยงานที่เกี่ยวข้อง ส่วนการเสนอให้ใช้ระบบการยื่นเอกสารที่เกี่ยวข้องกับกระบวนการส่งและรับแรงงานกัมพูชาตาม MOU ผ่านช่องทางออนไลน์นั้น ฝ่ายไทยเห็นด้วยในหลักการในการใช้แพลตฟอร์มออนไลน์เพื่อแบ่งปันข้อมูลระหว่างกัน นอกจากนี้ ในประเด็นอื่น ๆ ฝ่ายกัมพูชาจะประสานหน่วยงานที่เกี่ยวข้อง เพื่อสนับสนุนให้แรงงานกัมพูชาสามารถเข้ามาทำงานในฤดูเก็บเกี่ยวในประเทศไทย เพื่อแก้ปัญหาการขาดแคลนแรงงานในภาคการเกษตร
ด้าน นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า ผลจากการประชุมระดับวิชาการระหว่างรัฐบาลแห่งราชอาณาจักรไทยและรัฐบาลแห่งราชอาณาจักรกัมพูชาในครั้งนี้ ซึ่งได้มีการลงนามบันทึกข้อตกลงว่าด้วยการจ้างงานจะทำให้เกิดประโยชน์ต่อการจ้างแรงงานที่มีประสิทธิภาพมากยิ่งขึ้น ที่สำคัญจะเป็นการอำนวยความสะดวก ลดขั้นตอนต่าง ๆ แก่แรงงานกัมพูชาที่เข้ามาทำงานในประเทศไทยได้เข้าสู่ระบบการจ้างงานที่ถูกต้อง ได้รับการดูแลคุ้มครองสิทธิตามมาตรฐานสากล อันจะเป็นการแก้ไขปัญหาขาดแคลนแรงงานให้สอดคล้องกับความต้องการของนายจ้าง/ผู้ประกอบการในประเทศไทย รวมทั้งการแก้ไขปัญหาการค้ามนุษย์ด้านแรงงาน และที่สำคัญจะช่วยขับเคลื่อนเศรษฐกิจระหว่างสองประเทศอีกด้วย

On April 21, 2023, the Labour Minister, Mr. Suchart Chomklin, spoke about the Cambodia-Thailand Academic Level Conference, following the report from the Department of Employment’s Director-General, Mr. Phairoj Chotikasatian, the head of the Thai delegation, who attended the meeting with Cambodia’s Director General of the Ministry of Labour and Vocational Training, H.E.Seng Sakda. The occasion took place at the Angkor Paradise Hotel, Siem Reap Province, Kingdom of Cambodia, on April 19-21, 2023. After this, both parties signed a Memorandum of Agreement on employment between the Thai and Cambodian governments. The key results of the meeting include the issuance of identity documents for Cambodian workers in Thailand. Cambodian workers can travel to obtain a travel document (TD) at One-Stop Services centers located in Phnom Penh, Battambang, and Banteay Meanchey. For Cambodian workers without travel documents, cross-border documents can be obtained at the Cambodian embassy in Thailand to travel to Cambodia to apply for an Overseas Cambodia Worker Card (OCWC) and Travel Documents (TD) at the One Stop Services Center, as a basis for verification and confirmation of information to consider in issuing a new Travel Document (TD).
Mr. Suchart spoke about the results of the academic conference on the amendment of the Memorandum of Agreement on the Employment of Labour in the Thai and Cambodian governments. Both sides agreed that health checks in the country of origin are required by the competent authorities of the receiving country. The workers must have a health check from their country of origin before entering Thailand. For the provisional amendment, both parties agreed that the receiving country could adjust its labour management procedures with a focus on rights protection and benefits in the event of disasters or unexpected situations that affect the policy and efficiency in labour delivery. Regarding establishing the Cambodian Migrant Workers Support Center in Thailand, Thailand acknowledged and will discuss the matter with relevant agencies. As for the proposal to use the system for submitting documents related to sending and receiving Cambodian workers under the MOU via online channels, Thailand agreed, in principle, to use online platforms to share information among themselves. In addition, Cambodia will coordinate with relevant agencies to encourage Cambodian workers to work during the harvest season in Thailand to resolve labour shortages in the agricultural sector.
The Department of Employment’s Director-General, Mr. Phairoj Chotikasatian, said that the outcomes from the Cambodia-Thailand Academic Level Conference, which included signing a Memorandum of Agreement on employment, will bring benefits to more efficient employment. Importantly, it will promote convenience and reduce steps for Cambodian workers working in Thailand, to enter the correct employment system and receive protection of rights according to international standards. This will further solve labour shortages, in line with the needs of employers/businesses in Thailand, and solve the issue of labour trafficking in persons. Most importantly, it will help drive the economy between the two countries.
