รัฐมนตรีว่าการกระทรวงแรงงาน สั่งการกรมการจัดหางาน ลงพื้นที่แยกราชประสงค์ เขตปทุมวัน กวาดล้างไกด์เถื่อนชาวต่างชาติแย่งอาชีพคนไทย เตือน!! “ไกด์” สงวนสิทธิ์เฉพาะคนไทย หากฝ่าฝืนมีความผิดตามกฎหมาย
วันที่ 23 มีนาคม 2566 นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน เปิดเผยว่า สืบเนื่องจากที่สมาคมมัคคุเทศก์อาชีพแห่งประเทศไทยได้รับความเดือดร้อน กรณีพบชาวต่างชาติซึ่งไม่มีบัตรมัคคุเทศก์เข้ามาแย่งงานไกด์คนไทย ส่งผลให้มัคคุเทศก์ไทยที่ทำงานถูกต้องตามกฎหมาย ได้งานไม่สอดคล้องกับจำนวนนักท่องเที่ยวที่เดินทางเข้ามาท่องเที่ยวในประเทศไทย นั้น นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน ทราบเรื่องแล้วไม่ได้นิ่งนอนใจ สั่งการกรมการจัดหางานตรวจสอบและดำเนินคดีคนต่างชาติที่แย่งอาชีพคนไทยอย่างเข้มงวด ในวันนี้ตนจึงลงพื้นที่เพื่อตรวจสอบ โดยมีนายสันติ นันตสุวรรณ รองอธิบดีกรมการจัดหางาน พ.ต.อ. นิมิตร นูโพนทอง ผู้กำกับการ สถานีตำรวจนครบาล ลุมพินี เจ้าหน้าที่ชุดเฉพาะกิจตรวจสอบ ปราบปราม จับกุม และดำเนินคดีคนต่างด้าวทำงานผิดกฎหมายฯ และเจ้าหน้าที่จากสำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1 ร่วมลงพื้นที่แยกราชประสงค์ เขตปทุมวัน กรุงเทพมหานคร ตามเบาะแสที่มีผู้แจ้งเข้ามาว่าพบไกด์เถื่อน และชาวต่างชาติแย่งอาชีพคนไทย จากการตรวจสอบพบชาวจีน จำนวน 1 คน และเวียดนาม จำนวน 1 คน กำลังทำหน้าที่มัคคุเทศก์ยืนบรรยายให้ความรู้แก่นักท่องเที่ยว เมื่อสอบถามทั้งหมดให้การว่าตนมากับทัวร์กลุ่มดังกล่าวจริงและทำหน้าที่บรรยายสถานที่ท่องเที่ยวจุดดังกล่าวให้แก่นักท่องเที่ยวจริง จึงได้ควบคุมตัวส่งพนักงานสอบสวน สน.ลุมพินี ดำเนินคดีข้อหาเป็นคนต่างชาติทำงานโดยไม่มีใบอนุญาตทำงาน หรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้
“อาชีพมัคคุเทศก์หรืองานจัดนำเที่ยว เป็นงานที่กฎหมายกำหนดให้ผู้ประกอบวิชาชีพต้องมีสัญชาติไทยเท่านั้น และเป็นงานที่ห้ามคนต่างชาติทำโดยเด็ดขาด เพราะเป็นอาชีพสงวนของไทย คนต่างชาติจึงไม่สามารถขอใบอนุญาตทำงานต่อนายทะเบียนเพื่อทำงานดังกล่าวได้ ดังนั้นจึงมีความผิดตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม ซึ่งระบุว่าคนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศต้นทาง รวมถึงห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี นับตั้งแต่วันที่ได้รับโทษ และนายจ้าง/สถานประกอบการที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี” อธิบดีกรมการจัดหางาน กล่าว
ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน
The Labour Minister instructed the Employment Office to inspect the Ratchaprasong Intersection in Pathumwan District to wipe out illegal foreign guides taking Thai people’s occupation. He warned that “guides” are reserved for Thai people. Violations are an offense under the law.
On March 23, 2023, the Department of Employment’s Director-General, Mr. Phairoj Chotikasatian, reported that the Professional Tour Guide Association of Thailand had suffered from foreigners not holding the proper guide licenses, found to compete for the jobs from the Thai guide. As a result, legally permitted Thai guides were getting jobs inconsistent with the number of tourists traveling to Thailand. The Labour Minister, Mr. Suchart Chomklin, heard the news and instructed the Department of Employment to inspect and suppress foreigners taking occupations reserved for Thai people. Today, he visited the area for an initial inspection. The Deputy Director-General of the Department of Employment, Mr. Santi Nantasuwan, Superintendent of Lumpini Police Station, Colonel Nimit Nuphonethong, the special task force to inspect, suppress, arrest, and prosecute foreigners working illegally, and officials from the Bangkok Employment Office Area 1 joined in at Ratchaprasong Intersection, Pathumwan District, Bangkok, following tips that illegal foreign guides were identified. From the inspection, 1 Chinese and 1 Vietnamese were found acting as guides, standing and educating tourists. When asked, they said that they had come with the tour group and were in charge of describing the tourist attractions in those spots to the tourists. Therefore, they were detained and sent to an investigator at Lumpini Police Station for further prosecution. They were charged with being a foreigner working without a work permit or working outside their right.
“Tourist guides or organizing tours is a profession reserved for Thai nationals only, according to the law. It is a job strictly forbidden from foreigners. Therefore, foreigners cannot apply for a work permit from the Registrar to do such work. It is an offense under the Foreign Workers Management Act B.E. 2560 and its amendments. Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. They will be banned from applying for a work permit for two years from the penalty date. Employers/business establishments who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years,” said the Department of Employment’s Director-General.
