นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า สืบเนื่องจากที่มีผู้ประกอบการชาวไทยร้องเรียนให้ตรวจสอบคนต่างชาติที่สงสัยว่าเข้ามาประกอบธุรกิจแบบไม่ถูกกฎหมาย ใช้นอมินีคนไทยจดทะเบียนตั้งบริษัทแย่งอาชีพคนไทย และจ้างลูกจ้างชาวต่างชาติเป็นพนักงาน ย่านเยาวราช และห้วยขวาง นั้น ตนได้สั่งการกรมการจัดหางาน โดยเจ้าหน้าที่ชุดเฉพาะกิจตรวจสอบ ปราบปราม จับกุม และดำเนินคดี คนต่างด้าวทำงานผิดกฎหมายฯ ลงพื้นที่เยาวราช แขวงสัมพันธวงศ์ เขตสัมพันธวงศ์ กรุงเทพมหานคร ร่วมกับสำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 8 และชุดอำนวยการฯ เพื่อตรวจสอบแรงงานต่างชาติผิดกฎหมาย ที่นายจ้างนำมาทำงานในสถานประกอบการ โดยจะตรวจบังคับใช้กฎหมายกับคนต่างด้าวที่ไม่มีใบอนุญาตทำงาน ทำงานนอกเหนือสิทธิ ให้แรงงานต่างชาติอยู่ในกรอบกฎหมายอย่างจริงจัง และจะดำเนินคดีทั้งกับนายจ้าง และลูกจ้างที่มีความผิด
“กระทรวงแรงงานขอเตือนให้ทราบว่าตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม คนต่างชาติที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และนายจ้าง/สถานประกอบการ ที่รับคนต่างชาติที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างชาติทำงานนอกเหนือจากที่มีสิทธิ ซึ่งมีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างชาติที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างชาติที่จ้างหนึ่งคน และห้ามจ้างคนต่างชาติทำงานเป็นเวลา 3 ปี” รมว.แรงงาน กล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า จากการตรวจสอบสถานประกอบการ จำนวน 6 แห่ง/ราย พบมีการจ้างแรงงานคนไทย จำนวน 19 คน และต่างชาติ จำนวน 10 คน ในจำนวนนี้มีเอกสารการอนุญาตให้อยู่ในราชอาณาจักรและเอกสารการอนุญาตทำงานถูกต้อง จำนวน 7 คน และพบคนต่างชาติกระทำความผิด จำนวน 3 คน แบ่งเป็น ชายสัญชาติ กัมพูชา 2 ราย และชายสัญชาติ ลาว 1 ราย จึงควบคุมตัวส่งพนักงานสอบสวน สน.พลับพลาไชย 2 ดำเนินคดีในข้อหาเป็นคนต่างด้าวทำงานโดยไม่มีใบอนุญาตทำงาน พร้อมทั้งร้องทุกข์กล่าวโทษ นายจ้าง จำนวน 1 ราย ในข้อหารับคนต่างชาติเข้าทำงานโดยไม่มีใบอนุญาตทำงาน ในส่วนร้านค้า 2 ร้าน ที่มีการเสนอข่าวว่ามีคนจีนมาเปิดร้านไปก่อนหน้า ขณะนี้พบว่าบริเวณหน้าร้านติดป้ายปิดปรับปรุง และปิดทำการไว้ นอกจากนี้ยังพบว่า 1 ในร้านที่เข้าตรวจสอบ มีคนไทยเป็นแคชเชียร์ แต่คิวอาร์โค้ดรับเงิน มีชื่อบัญชี คล้ายชื่อคนจีน ซึ่งพนักงานไม่สามารถให้ข้อมูลของร้านได้ชัดเจน
ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน
The Labour Minister, Mr. Suchart Chomklin, spoke about Thai business operators filing requests to investigate foreigners suspected of doing business illegally by using Thai nominees to register and set up a company to compete for professions from Thai people and hiring foreign employees in the Yaowarat and Huai Khwang areas. He instructed the Department of Employment’s special task force to the area to inspect and suppress foreigners who work illegally. They went to the Yaowarat area, Samphanthawong Subdistrict, Samphanthawong District, Bangkok, the Bangkok Employment Office Area 8, and the Administrative Division. They checked for illegal foreign workers hired to work in establishments by inspecting and enforcing the law on foreigners who do not have a work permit or work beyond their rights, ensuring they remain within the legal framework. Employees and employers in violation will be prosecuted.
“The Ministry of Labour would like to remind everyone about the Emergency Decree on Managing the Work of Foreigners, B.E. 2560, and its amendments. Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. Employers who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years,” said the Labour Minister.
The Department of Employment’s Director-General, Mr. Phairoj Chotikasatien, said that from inspecting six business establishments, there were 19 Thai nationals hired and ten foreigners. Of these, 7 had valid documents to stay in the Kingdom and work. Three foreigners were found guilty, comprising 2 Cambodian nationals and 1 Laotian, who were sent to the Plubplachai Police Station 2 and prosecuted for being a foreign workers without a work permit. A complaint was also filed against one employer for hiring foreigners without work permits. For the two shops that were presented in the news as being owned by Chinese people, it was found that the front of the store was marked with a sign closed for renovation and closed for operation. It also found that one of the shops checked had Thai people as cashiers, but the QR code to receive money had an account name similar to a Chinese name, which the staff could not provide clear information about the shop.
