นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า พล.อ. ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี ห่วงคนไทยถูกแรงงานต่างชาติแย่งงาน แย่งอาชีพ จึงสั่งการให้กระทรวงแรงงานบริหารจัดการแรงงานต่างชาติในประเทศไทยอย่างรอบคอบ เป็นระบบ และบังคับใช้กฎหมายอย่างเข้มข้น โดยเฉพาะกลุ่มแรงงานต่างชาติที่แย่งอาชีพคนไทย ซึ่งตนในฐานะรัฐมนตรีว่าการกระทรวงแรงงานไม่เคยนิ่งนอนใจ ได้กำชับให้กรมการจัดหางานติดตามตรวจสอบและดำเนินคดีแรงงานต่างชาติที่ทำงานผิดกฎหมายหรือแย่งอาชีพคนไทยอย่างใกล้ชิด ซึ่งตั้งแต่วันที่ 1 ตุลาคม 2565 – 13 กุมภาพันธ์ 2566 มีการเข้าตรวจสอบสถานประกอบการที่จ้างแรงงานต่างชาติทั่วประเทศแล้ว จำนวน 14,104 แห่ง ดำเนินคดี 500 แห่ง และตรวจสอบคนต่างชาติ จำนวน 196,402 คน แยกเป็นสัญชาติเมียนมา 145,764 คน กัมพูชา 32,916 คน ลาว 10,181 คน เวียดนาม 103 คน และสัญชาติอื่น ๆ 7,438 คน มีการดำเนินคดีทั้งสิ้น 1,143 คน แยกเป็นสัญชาติเมียนมา 629 คน กัมพูชา 175 คน ลาว 187 คน เวียดนาม 49 คน และสัญชาติอื่น ๆ 103 คน ซึ่งพบเป็นการแย่งอาชีพคนไทย ทั้งสิ้น 600 คน แยกเป็นสัญชาติเมียนมา 264 คน กัมพูชา 121 คน ลาว 97 คน เวียดนาม 39 คน อินเดีย 51 คน และสัญชาติอื่น ๆ 28 คน โดยอาชีพที่พบคนต่างชาติแย่งอาชีพมากที่สุด ได้แก่ งานเร่ขายสินค้า งานตัดผม งานขับขี่ยานพาหนะ และงานนวด ตามลำดับ
“พระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม ระบุว่า คนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือสิทธิที่จะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และนายจ้าง/สถานประกอบการ ที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี ซึ่งกระทรวงแรงงานจะดำเนินคดีกับผู้กระทำผิดโดยไม่มีข้อยกเว้น” รมว.แรงงาน กล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า ประกาศกระทรวงแรงงาน เรื่อง กำหนดงานที่ห้ามคนต่างด้าวทำ มีทั้งสิ้น 40 งาน เป็นงานห้ามคนต่างด้าวทำเด็ดขาด 27 งาน ตามบัญชีที่ 1 ได้แก่
1.งานแกะสลักไม้
2.งานขับขี่ยานยนต์ ยกเว้นงานขับรถยก (Forklift)
3.งานขายทอดตลาด
4.งานเจียระไนเพชร/พลอย
5.งานตัดผม/เสริมสวย
6.งานทอผ้าด้วยมือ
7.งานทอเสื่อ หรืองานทำเครื่องใช้ด้วยกก หวาย ฟาง ไม้ไผ่ ขนไก่ เส้นใย ฯลฯ
8.งานทำกระดาษสาด้วยมือ
9.งานทำเครื่องเขิน
10.งานทำเครื่องดนตรีไทย
11.งานทำเครื่องถม
12.งานทำเครื่องทอง/เงิน/นาก
13.งานทำเครื่องลงหิน
14.งานทำตุ๊กตาไทย
15.งานทำบาตร
16.งานทำผ้าไหมด้วยมือ
17.งานทำพระพุทธรูป
18.ทำร่มกระดาษ/ผ้า

และงานที่ให้คนต่างด้าวทำได้โดยมีเงื่อนไข 13 งาน ตามบัญชีที่ 2 ได้แก่ วิชาชีพบัญชี วิชาชีพวิศวกรรม วิชาชีพสถาปัตยกรรม โดยมีเงื่อนไขให้คนต่างด้าวทำงานได้ตามข้อตกลงระหว่างประเทศหรือพันธกรณีที่ประเทศไทยมีความผูกพันภายใต้บทบัญญัติของกฎหมาย ซึ่งต้องเป็นคนต่างด้าวของประเทศที่มีข้อตกลงกับประเทศไทยเท่านั้น จึงจะสามารถทำได้ ตามบัญชี 3 ได้แก่
1.งานกสิกรรม
2.งานช่างก่ออิฐ/ช่างไม้/ช่างก่อสร้างอาคาร
3.งานทำที่นอน
4.งานทำมีด
5.งานทำรองเท้า
6.งานทำหมวก
7.งานประดิษฐ์เครื่องแต่งกาย
8.งานปั้นเครื่องดินเผาโดยมีเงื่อนไขให้คนต่างด้าวทำงานฝีมือหรือกึ่งฝีมือนั้นได้ก็แต่เฉพาะงานที่มีนายจ้าง
และตามบัญชีที่ 4 ได้แก่ งานกรรมกร และงานขายของหน้าร้าน โดยมีเงื่อนไขให้คนต่างด้าวทำงานนั้นได้ก็แต่เฉพาะงานที่มีนายจ้างและได้รับอนุญาตให้เข้ามาในราชอาณาจักรตามกฎหมายว่าด้วยคนเข้าเมืองภายใต้บันทึกข้อตกลงหรือบันทึกความเข้าใจที่รัฐบาลไทยทำไว้กับรัฐบาลต่างประเทศ (MoU)
“ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน” อธิบดีกรมการจัดหางาน กล่าว

The Labour Minister, Mr. Suchart Chomklin, reported that Prime Minister General Prayuth Chan-ocha is concerned that Thai people are getting their jobs taken away by foreign workers. He instructed the Ministry of Labour to manage foreign workers in Thailand carefully and systematically and to strictly enforce the law, especially foreign workers competing for Thai people’s jobs. The Labour Minister instructed the Department of Employment to closely monitor, inspect and prosecute foreign workers who work illegally or take jobs away from Thai people. From October 1, 2022, to February 13, 2023, 14,104 establishments employing foreign workers have been inspected nationwide, with 500 prosecuted. They examined 196,402 foreigners, 145,764 of whom are Myanmar nationals. 32,916 Cambodians, 10,181 Laotians, 103 Vietnamese, and 7,438 other nationalities. A total of 1,143 people were prosecuted, divided into 629 Myanmar nationals, 175 Cambodians, 187 Laotians, 49 Vietnamese, and 103 other nationalities. It was found that 600 people were competing for jobs from Thai people, comprising 264 Myanmar nationals, 121 Cambodians, 97 Laotians, 39 Vietnamese, 51 Indians, and 28 other nationalities. The occupations with the most foreigners competing for jobs were peddling goods, haircutting, driving vehicles, and massage, respectively.
“The Foreign Worker Management Emergency Decree B.E. 2560, and its amendments, indicate that foreigners who work without a work permit or work beyond their rights face fines ranging from 5,000 – 50,000 Baht. Employers/business establishments that accept foreigners who do not have work permits to allow foreigners to work beyond their rights face a fine from 10,000 – 100,000 Baht per foreigner employed. Repeated offenses are liable to imprisonment for a term not exceeding one year or a fine ranging from 50,000 – 200,000 Baht per foreigner employed. The employer/establishment would be prohibited from employing foreigners for three years. The Ministry of Labour will prosecute the offenders without exception,” said the Labour Minister.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, said that the Ministry of Labour’s announcement on the specification of work that foreigners are prohibited from includes 40 jobs, 27 of which are prohibited for foreigners. According to List 1, this includes:
1. Wood carving.
2. Motor vehicle driving, except for driving a forklift.
3. Auction work.
4. Diamond/gem cutting work.
5. Hairdressing/beautician work.
6. Handmade weaving
7. Mat weaving or making utensils with reeds, rattan, straw, bamboo, feathers, fibers, etc.
8. Handmade mulberry paper.
9. Making lacquerware.
10. Making Thai musical instruments.
11. Making a reclamation machine
12. Gold/silver/copper work.
13. Making a stone machine.
14. Making Thai dolls.
15. Making food offerings.
16. Making silk by hand.
17. Buddha statue work.
18. Making paper/cloth umbrellas.
19. Broker/agent job.
20. Thai massage job.
21. Rolling cigarette job.
22. Guide work.
23. Peddling work.
24. Alphabet work.
25. Thread twisting.
26. Secretarial work.
27. Legal services.
Thirteen jobs allow foreigners to work in conditions according to List 2, namely accounting, engineering, and architecture professions, with the condition that foreigners can work following international agreements or obligations in which the provisions of the law bind Thailand. The foreigner must be from a country with only an agreement with Thailand. Under List 3, the jobs are:
1. Agricultural work.
2. Bricklayer work/carpenters/building construction workers
3. Mattress making.
4. Knife making.
5. Shoemaking.
6. Hat-making.
7. Costume making.
8. Pottery work. The condition is that foreigners can work on that craft or semi-skill, but only for jobs that have employers.
Under list 4, the jobs include labour work and store sales work with the condition that foreigners can only work in those jobs that have employers and are allowed to enter the Kingdom under the law on immigration, under an MOU made by the Thai and foreign governments.
“Anyone who sees illegal employment of foreigners can report them to the Central Employment Registration and Job Seeker Protection Division, Department of Employment, Ministry of Labour Building, 4th floor, or contact the Provincial Employment Office in every province, the Bangkok Employment Office Areas 1-10, at the Ministry of Labour’s Hotline on 1506 press 2 for the Department of Employment, or the Department of Employment’s hotline on 1694,” said the Department of Employment’s Deputy Director-General.
