กรมการจัดหางานรับข้อสั่งการ รมว.สุชาติ ลุยตรวจต่างชาติแย่งอาชีพคนไทย เป้าหมายแรกเมืองท่องเที่ยว กรุงเทพฯ ภูเก็ต สมุย พัทยา ก่อนปูพรมตรวจทั่วประเทศ
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า จากกรณีผู้ประกอบการธุรกิจร้านอาหารคนไทย ร้องเรียนให้ตรวจสอบคนต่างชาติที่สงสัยว่าเข้ามาประกอบธุรกิจแบบไม่ถูกกฎหมาย ใช้นอมินีคนไทยจดทะเบียนตั้งบริษัทแย่งอาชีพคนไทย และจ้างลูกจ้างชาวต่างชาติเป็นพนักงาน นั้น ตนรับทราบเรื่องแล้วไม่ได้นิ่งนอนใจ ได้สั่งการกรมการจัดหางานบูรณาการร่วมกับหน่วยงานที่เกี่ยวข้อง ลงพื้นที่ตรวจสอบทั่วประเทศ โดยเฉพาะในเมืองท่องเที่ยวหลัก ทั้งกรุงเทพมหานคร ภูเก็ต สมุย พัทยา ที่เป็นแหล่งประกอบอาชีพของคนไทย ซึ่งหากตรวจสอบพบมีความผิดจะดำเนินคดีตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม โดยไม่มีข้อยกเว้น
“ขอเตือนว่ากระทรวงแรงงานเอาจริงเอาจังกับการบังคับใช้กฎหมาย โดยเฉพาะกรณีคนต่างชาติแย่งอาชีพคนไทย โดยปีงบประมาณ พ.ศ. 2566 มีการตรวจสอบนายจ้าง/สถานประกอบการแล้ว จำนวน 9,883 แห่ง ดำเนินคดี 355 แห่ง และตรวจสอบคนต่างชาติ จำนวน 153,882 คน ดำเนินคดี 795 คน ในจำนวนนี้เป็นคนต่างชาติที่แย่งอาชีพคนไทย จำนวน 386 คน” รมว.แรงงาน กล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า กรมการจัดหางานรับข้อสั่งการรัฐมนตรีว่าการกระทรวงแรงงาน มอบหมายสำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1 – 10 และสำนักงานจัดหางานจังหวัดทั่วประเทศ และเจ้าหน้าที่ชุดเฉพาะกิจฯ ลงพื้นที่ตรวจสอบและบังคับใช้กฎหมายอย่างเข้มข้น โดยมีแนวทางจะบูรณาการร่วมกับสำนักงานตรวจคนเข้าเมือง ตำรวจท่องเที่ยว สันติบาล ตำรวจในพื้นที่ กรมพัฒนาธุรกิจการค้า และกรมสรรพากร เพื่อตรวจสอบและดำเนินคดีตามกฎหมายที่เกี่ยวข้อง ในส่วนของกรมการจัดหางานจะดำเนินคดีคนต่างชาติที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ ซึ่งมีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และนายจ้าง/สถานประกอบการ ที่รับคนต่างชาติที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างชาติทำงานนอกเหนือจากที่มีสิทธิ ซึ่งมีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างชาติที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างชาติที่จ้างหนึ่งคน และห้ามจ้างคนต่างชาติทำงานเป็นเวลา 3 ปี
ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน

The Department of Employment responded to instructions from the Labour Minister, Mr. Suchart, to inspect foreigners taking occupations reserved for Thais. Initial areas include tourist locations comprising Bangkok, Phuket, Samui, and Pattaya, before expanding inspections nationwide.
The Labour Minister, Mr. Suchart Chomklin, spoke about Thai restaurant business operators requesting inspections of foreigners suspected of conducting business illegally, using Thai nominees to register and set up a company to compete for Thai people’s occupations employing foreign workers as employees. He acknowledged the matter and ordered the Department of Employment to work with relevant agencies to inspect sites across the country, especially in tourist destinations, including Bangkok, Phuket, Samui, and Pattaya, which are sources of occupations for Thai people. Foreign workers found in wrongdoing will be prosecuted according to the Emergency Decree on Managing the Work of Foreigners, B.E. 2560, and its amendments, without exception.
“I would like to remind you that the Ministry of Labour is serious about law enforcement, especially when foreigners compete for Thai occupations. In the 2023 fiscal year, 9,883 employers/establishments have been inspected with 355 prosecuted. 153,882 foreigners have been examined, and 795 prosecuted, of which 386 are foreigners taking occupations reserved for Thai people,” said the Labour Minister.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, said that the Department of Employment has responded to the Labour Minister’s instructions, assigning the Bangkok Employment Offices Area 1-10, the Provincial Employment Offices, and a special task force, to inspect the area and enforce the law. There are guidelines for working with the Immigration Office, Tourist Police, Special Branch Bureau, local police, the Department of Business Development, and the Revenue Department to investigate and prosecute following relevant laws. The Department of Employment will prosecute foreigners who work without a work permit or work outside of their rights, in which the foreigners will be fined 5,000 – 50,000 Baht. Employers who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years.
