รัฐมนตรีว่าการกระทรวงแรงงาน สั่งการกรมการจัดหางาน ลงพื้นที่ห้วยขวาง ตรวจสอบใบอนุญาตทำงานคนต่างชาติ เตือนไม่มีใบอนุญาตทำงาน หรือทำงานนอกเหนือสิทธิ มีโทษทั้งนายจ้าง – ลูกจ้าง
วันนี้ (17 ก.พ.66) นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน สั่งการกรมการจัดหางาน ลงพื้นที่ห้วยขวาง เพื่อตรวจสอบ ปราบปรามคนต่างชาติที่ลักลอบทำงานโดยผิดกฎหมายและคนต่างชาติที่ไม่ดำเนินการตามมติคณะรัฐมนตรีเมื่อวันที่ 5 กรกฎาคม 2565 ที่นายจ้างนำมาทำงานในสถานประกอบการ โดยมีนายสันติ นันตสุวรรณ รองอธิบดีกรมการจัดหางาน นำชุดอำนวยการฯ และเจ้าหน้าที่สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 10 ลงพื้นที่ตรวจสอบ
นายสันติ นันตสุวรรณ รองอธิบดีกรมการจัดหางาน กล่าวว่า นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน ได้มอบหมายตนลงพื้นที่ตรวจสอบการทำงานของแรงงานต่างชาติ ณ พื้นที่ห้วยขวาง เพื่อตรวจบังคับใช้กฎหมายกับคนต่างชาติที่ไม่มีใบอนุญาตทำงาน ทำงานนอกเหนือสิทธิ โดยเรื่องนี้สืบเนื่องจากที่พล.อ. ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี มีข้อสั่งการให้กระทรวงแรงงานกวาดล้างแรงงานต่างชาติแย่งงานคนไทยอย่างเข้มงวด เพื่อมิให้กระทบต่อโอกาสการมีงานทำของคนไทย และส่งผลต่อความมั่นคงและระบบเศรษฐกิจของประเทศไทย ซึ่งจากการตรวจสอบสถานประกอบการ จำนวน 5 แห่ง/ราย พบสถานประกอบการกระทำความผิด 2 แห่ง คนต่างชาติกระทำความผิด รวมทั้งสิ้น 9 คน ประกอบด้วย กัมพูชา 3 คน เมียนมา 4 คน และบุคคลไม่มีสถานะทางทะเบียน 2 คน จึงได้ควบคุมตัวส่งพนักงานสอบสวน สน. ห้วยขวาง ดำเนินคดีข้อหาเป็นคนต่างด้าวทำงานโดยไม่มีใบอนุญาตทำงาน รวมทั้งร้องทุกข์กล่าวโทษดำเนินคดีนายจ้างจำนวน 2 แห่ง ข้อหารับคนต่างด้าวทำงาน โดยที่คนต่างด้าวไม่มีใบอนุญาตทำงาน ซึ่งตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม คนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศต้นทาง รวมถึงห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี นับตั้งแต่วันที่ได้รับโทษ และนายจ้าง/สถานประกอบการที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี
“ทั้งนี้ ผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 023541729 หรือสำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน” รองอธิบดีกรมการจัดหางาน กล่าว
The Labour Minister assigned the Department of Employment to the Huai Khwang area to check foreigners for their work permits, sharing a reminder that those not having a work permit or working outside their entitlements will result in penalties for both employers and employees. Today (February 17, 2023), the Labour Minister Mr. Suchart Chomklin assigned the Department of Employment to the Huai Khwang area to inspect and suppress foreigners who work illegally and foreigners who do not comply with the Cabinet’s resolution on July 5, 2022, where employers have brought them in to work in the workplace. The Department of Employment’s Deputy Director-General, Mr. Santi Nantasuwan, brought the Administrative Division and staff from the Bangkok Employment Office Area 10 to inspect the area.
The Department of Employment’s Deputy Director-General, Mr. Santi Nantasuwan, said that the Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, assigned him to inspect foreign work workers in the Huay Kwang area. The inspection inspected law enforcement on foreigners who do not have a work permit or working beyond their rights. In this regard, the Prime Minister and Minister of Defence General Prime Minister, Prayuth Chan-ocha, instructed the Ministry of Labour to strictly crack down on foreign workers competing for jobs from Thai people to not affect the job opportunities of Thai people or Thailand’s stability and economy.
From inspecting five business establishments, two were found in wrongdoing, comprising nine workers divided into 3 Cambodian nationals, 4 Myanmar nationals, and two unregistered people. The workers were detained and sent for an investigation at the Huai Khwang Police Station to prosecute the charge of being a foreigner working without a work permit. A complaint was also filed to prosecute two employers for accepting foreigners to work without a work permit following the Foreign Worker Management Emergency Decree B.E. 2560 and its amendments. A foreigner working without a work permit or working outside their right to do so faces a fine ranging from 5,000 – 50,000 Baht, will be sent back to their country of origin, and not be allowed to apply for a work permit for two years from the date of punishment. Employers/establishments that accept foreigners who do not have a work permit or allow foreigners to work beyond their rights face a fine from 10,000 – 100,000 Baht per foreigner employed. Repeated offenses are liable to imprisonment for a term not exceeding one year or a fine ranging from 50,000 – 200,000 Baht per foreigner employed. The employer/establishment will not be allowed to employ foreigners for another three years.
“Anyone who sees illegal employment of foreigners can report them to the Central Employment Registration and Job Seeker Protection Division, Department of Employment, Ministry of Labour Building, 4th floor, call 023541729, or contact the Provincial Employment Office in every province, the Bangkok Employment Office Areas 1-10, at the Ministry of Labour’s Hotline on 1506 press 2 for the Department of Employment, or the Department of Employment’s hotline on 1694,” said the Department of Employment’s Deputy Director-General.
