นายบุญสงค์ ทัพชัยยุทธ์ เลขาธิการสำนักงานประกันสังคม เปิดเผยว่า ตามที่สื่อมวลชนได้นำเสนอข่าวจากเพจเฟสบุ๊คปฏิบัติการหมาเฝ้าบ้านเกี่ยวกับการเรียกหัวคิวพม่า 40% แลกเดินเรื่องเงินชดเชยแปดแสนบาทกรณีเหตุการณ์เรือบรรทุกน้ำมันระเบิดกลางแม่น้ำแม่กลอง จังหวัดสมุทรสงคราม เมื่อวันที่ 17 มกราคม 2566 ที่ผ่านมานั้น
ในเรื่องนี้ ทันทีที่ทราบข่าว ท่านสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน ได้สั่งการให้สำนักงานประกันสังคม พร้อมด้วยหน่วยงานในสังกัดกระทรวงแรงงานลงพื้นที่ไปสอบข้อเท็จจริงกับญาติของแรงงานที่เสียชีวิตด้วยตนเอง เพื่อสัมภาษณ์ข้อเท็จจริงหากพบข้าราชการหรือเจ้าหน้าที่รายใดมีส่วนเกี่ยวข้องในการเรียกรับผลประโยชน์ตามข่าวจริง ก็จะถูกส่งดำเนินคดีให้ถึงที่สุด เพราะถ้ามีคนทำนาบนหลังคนเดือดร้อน จะต้องรับโทษตามกฎหมายโดยไม่มีข้อยกเว้นใดๆ ทั้งสิ้น
นายบุญสงค์ กล่าวต่อว่า ในส่วนของสำนักงานประกันสังคม ผมได้รับรายงานจาก นางสาวชณิการ์ โกวะประดิษฐ์ ประกันสังคมจังหวัดสมุทรสาคร ว่า กรณีนี้สำนักงานประกันสังคมจังหวัดสมุทรสาคร ได้ดำเนินการจ่ายเงินค่าทำศพให้กับญาติที่มีชื่ออยู่ในหลักฐานการจัดการศพทั้ง 7 รายๆ ละ 50,000 บาท เรียบร้อยแล้ว ส่วนเงินที่เหลือเป็นเงินค่าทดแทนการตายและเงินบำเหน็จชราภาพ รายละประมาณ 7 แสนกว่าบาท ขณะนี้ อยู่ในขั้นตอนรอหลักฐานของทายาท ซึ่งได้สอบสวนข้อเท็จจริงแล้วว่ามีผู้ใดเป็นผู้มีสิทธิตามกฎหมายและได้ชี้แจงให้ญาติทราบแล้ว ทั้งนี้ เมื่อวันที่ 9 กุมภาพันธ์ 2566 ที่ผ่านมา ได้มี นาย THUREIN TUN ทูตแรงงานเมียนมา และนาย Sai Soe ล่ามของสถานฑูตเมียนมา พร้อมกับ คุณกนกพร บุญโต ผู้รับมอบอำนาจของนายจ้าง และญาติของผู้เสียชีวิตทั้ง 7 ราย มาพบเจ้าหน้าที่สำนักงานประกันสังคมจังหวัดสมุทรสาคร ซึ่งทางสำนักงานฯ ได้ชี้แจงเกี่ยวกับสิทธิประโยชน์และหลักฐาน โดยทางสถานทูตรับเรื่องไปประสานงานและช่วยเหลือในเรื่องการออกพาสปอร์ต หนังสือรับรองยืนยันตัวตนของผู้มีสิทธิ บันทึกถ้อยคำของทายาท และหลักฐานอื่นๆ เช่น ทะเบียนบ้าน ทะเบียนสมรส เป็นต้น
และในวันนี้ ผมได้มอบหมายให้ นางนงลักษณ์ กอวรกุล ผู้ตรวจราชการกรม สำนักงานประกันสังคม สำนักงานประกันสังคมจังหวัดสมุทรสาคร และสำนักงานประกันสังคมจังหวัดสมุทรสงคราม ลงพื้นที่ พร้อมด้วย หน่วยงานในสังกัดกระทรวงแรงงานเพื่อตรวจสอบข้อเท็จจากญาติของผู้เสียชีวิตที่จังหวัดสมุทรสงคราม จากการตรวจสอบข้อเท็จจริงของญาติผู้เสียชีวิตทั้ง 7 ราย พบว่า มี ญาติ 1 ราย ให้ข้อมูลว่า มีผู้มาติดต่อ ณ ที่พักอาศัย จำนวน 4 คน โดยเสนอความช่วยเหลือเกี่ยวกับการเบิกเงินจากสำนักงานประกันสังคมแลกกับการจ่ายเงินค่าเดินเรื่องดังกล่าว แต่ญาติปฏิเสธข้อเสนอเนื่องจากได้รับความช่วยเหลือจากสถานทูตเมียนมาร์และกระทรวงแรงงานโดยสำนักงานประกันสังคมแล้ว และมีความมั่นใจเกี่ยวกับการดำเนินการของเจ้าหน้าที่ที่เกี่ยวข้อง
ทั้งนี้ สำนักงานประกันสังคมได้ตรวจสอบข้อเท็จจริงเพิ่มเติมของกลุ่มบุคคลที่มาติดต่อญาติแล้ว ทราบว่าเป็นกลุ่มบุคคลที่เข้ามาช่วยเหลือรับประสานงานให้กับแรงงานข้ามชาติที่มาทำงานในประเทศไทย และมีเพจเป็นหลักฐานในการอ้างอิงกลุ่มบุคคลดังกล่าว อย่างไรก็ตาม สำนักงานประกันสังคมได้แนะนำญาติผู้เสียชีวิตที่ถูกเรียกรับเงินค่าเดินเรื่อง ว่า หากมีความประสงค์จะดำเนินการทางกฎหมาย จะได้ให้ความช่วยเหลือแนะนำ รวมทั้ง สำนักงานประกันสังคมได้ยืนยันกับญาติผู้ประกันตนทุกรายว่าสำนักงานประกันสังคมพร้อมที่จะประสานงานกับทุกหน่วยงานในการเร่งรัดการจ่ายเงินเยียวยาให้แก่ผู้มีสิทธิโดยเร็ว
“ขอยืนยันว่าเจ้าหน้าที่กระทรวงแรงงานและเจ้าหน้าที่สำนักงานประกันสังคมไม่มีส่วนเกี่ยวข้องกับเรื่องการเรียกหัวคิวพม่า 40% แลกกับการเดินเรื่องกับเงินชดเชยแปดแสนบาท และได้กำชับให้เจ้าหน้าที่ทุกคนช่วยกันสอดส่องดูแลไม่ให้มีกลุ่มบุคคลมาแสวงหาผลประโยชน์จากความเดือดร้อนของผู้ประกันตน หากพบว่ามีความเสียหายเกิดขึ้นจะดำเนินการทางคดีเพื่อป้องกันมิให้เกิดเหตุการณ์เช่นนี้อีก ทั้งนี้ ขอย้ำเตือนไปยังผู้ประกันตนทุกท่านว่า การที่ผู้ประกันตนจะได้รับสิทธิประโยชน์จากสำนักงานประกันสังคมนั้น สำนักงานประกันสังคมจะดูแลผู้ประกันตนอย่างเต็มที่ โดยผู้ประกันตนไม่ต้องมีการจ่ายเงินใด ๆ ทั้งสิ้น ทั้งนี้ หากผู้ประกันตนมีข้อสงสัยเกี่ยวกับสิทธิประโยชน์สามารถติดต่อสอบถามรายละเอียดเพิ่มเติมได้ที่สำนักงานประกันสังคมทุกแห่งทั่วประเทศ หรือโทรสายด่วนกระทรวงแรงงาน 1506 กด 1 สำนักงานประกันสังคม” นายบุญสงค์ กล่าวท้ายสุด

As soon as the Labour Minister, Mr. Suchat Chomklin, heard the news, he instructed the Social Security Office and agencies under the Ministry of Labour to visit the area to investigate the facts with the relatives of the deceased workers and to interview and gather facts. If any government official or official is found involved in claiming benefits as claimed in the news, they will be sent to prosecution. Any person in wrongdoing will be punished by law without any exceptions.
Mr. Boonsong continued that on the Social Security Office’s part, he received a report from the Samut Sakhon Provincial Social Security Officer, Ms. Chanika Kowapradit, that the Samut Sakhon Provincial Social Security Office paid funeral expenses to the relatives of the seven workers, at 50,000 Baht each. The remaining is compensation for death and an old-age pension, amounting to around seven hundred thousand Baht per person. They are currently in the process of waiting for evidence from the families. The facts have been investigated regarding who has the rights under the law. The information has been clarified to the relatives. On February 9, 2023, Myanmar Labour Ambassador, Mr. Thurein Tun, Myanmar Embassy Interpreter, Mr. Sai Soe, the Employer’s Power of Attorney, Khun Kanokporn Boonto, and the relatives of the seven deceased workers, met with the staff of the Samut Sakhon Provincial Social Security Office. The officials provided clarity about the benefits and evidence. The Embassy accepted the matter to coordinate and assist in issuing passports and certificates confirming the authorized person’s identity. The statements provided by the families were recorded, and other evidence was collected, such as house registration and marriage certificates.
Today, he assigned the Social Security Office’s Inspector-General, Mrs. Nonglak Korvorakul, the Sakhon Provincial Social Security Office, and the Samut Songkhram Provincial Social Security Office to visit the area together with agencies under the Ministry of Labour to verify facts from relatives of the deceased in Samut Songkhram Province. From investigating the facts provided by relatives of the seven deceased, one relative reported that four people had contacted them at their residence, offering assistance in reimbursing money from the Social Security Office in exchange for payment. However, the relatives declined the offer as assistance had already been received from the Myanmar Embassy and the Ministry of Labour’s Social Security Office, and they had confidence in the actions of the relevant officials.
The Social Security Office has investigated additional facts about the people who contacted their relatives. They are from a group of people coordinating with migrant workers in Thailand. There is a page as evidence to refer to the group of people. The Social Security Office has advised relatives of the deceased who were asked for payment if they wished to take legal action, then they would provide advice. The Social Security Office has confirmed to all insured persons’ relatives that the Social Security Office is ready to coordinate with all agencies to expedite the payment of compensation to those who are eligible as soon as possible.
“I would like to confirm that officials from the Ministry of Labour and the Social Security Office have nothing to do with the 40 percent cut in compensation in exchange for the eight hundred thousand Baht compensation. All officers have been instructed to help monitor and ensure that no group of persons seeks to benefit from the suffering of the insured person. If it is found that damage has occurred, legal action will be taken to prevent this from happening again. The insured persons will receive benefits from the Social Security Office. The Social Security Office will take full care of them, whereby insured persons do not have to pay any money.
