รัฐมนตรีว่าการกระทรวงแรงงาน ห่วงใยกรณีลูกจ้างโดนท่อลมร้อนไหม้ทั้งตัวเสียชีวิต สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) และสำนักงานประกันสังคม (สปส.) เร่งช่วยเหลือสิทธิประโยชน์พร้อมตรวจสอบข้อเท็จจริงกรณีดังกล่าวโดยด่วน
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงกรณีกรณีลูกจ้างโดนท่อลมร้อนไหม้ทั้งตัวเสียชีวิต ว่า ก่อนอื่นผมต้องขอแสดงความเสียใจกับญาติผู้เสียชีวิต ในขณะเดียวกันผมได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงาน พร้อมด้วยหน่วยงานสังกัดกระทรวงแรงงานเข้าพื้นที่ตรวจสอบสถานที่เกิดเหตุ โดยพนักงานตรวจความปลอดภัย สำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดสมุทรปราการ รายงานเบื้องต้น ว่า เมื่อวันที่ 5 กรกฎาคม 2566 เวลา 10.00 น. ลูกจ้าง ชื่อ นายยศวรรธน์ พ้นภัย อายุ 22 ปี ตำแหน่งช่างเทคนิค ลูกจ้างของบริษัทแห่งหนึ่งในนิคมอุตสาหกรรมบางปู ได้รับอุบัติเหตุจากการทำงานทำให้ลูกจ้างโดนท่อลมร้อนไหม้ทั้งตัว ยกเว้นหน้าอกและท้อง ได้เข้ารับการรักษาที่โรงพยาบาลเมืองสมุทรปากน้ำ (บางปู) จังหวัดสมุทรปราการ ตั้งแต่วันที่ 5 กรกฎาคม2566 และเสียชีวิตในวันที่ 23 กรกฎาคม 2566 หลังจากลูกจ้างได้เสียชีวิต ผมได้มอบหมายให้สำนักงานประกันสังคมจังหวัดสมุทรปราการเร่งดำเนินการช่วยเหลือจ่ายสิทธิประโยชน์ให้แก่ญาติผู้เสียชีวิตพึงได้รับ และให้กรมสวัสดิการและคุ้มครองแรงงานดำเนินการในส่วนที่เกี่ยวข้องตามอำนาจหน้าที่ต่อไป
นายนิยม สองแก้ว อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) กล่าวว่า ในส่วนที่เกี่ยวข้องกับอำนาจหน้าที่ของกรมฯ ได้กำชับสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดสมุทรปราการ (สสค.สมุทรปราการ) และศูนย์ความปลอดภัยในการทำงาน เขต 10 สมุทรปราการ เร่งตรวจสอบข้อมูลเพิ่มเติม โดยพนักงานตรวจความปลอดภัย สสค.สมุทรปราการ ได้มีหนังสือเชิญนายจ้างมาพบวันที่ 27 กรกฎาคมนี้ เพื่อสอบข้อเท็จจริงเพิ่มเติม ว่า นายจ้างมีการปฏิบัติฝ่าฝืนพระราชบัญญัติความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน พ.ศ. 2554 และกฎกระทรวง กำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการ ด้านความปลอดภัย อาชีวอนามัย และสภาพแวดล้อม ในการทำงานเกี่ยวกับเครื่องจักร ปั้นจั่น และหม้อน้ำ พ.ศ. 2564 หรือไม่ ซึ่งถ้าหากนายจ้างไม่ปฏิบัติตามกฎหมายดังกล่าวจะดำเนินการตามกฎหมายต่อไป
นายบุญสงค์ ทัพชัยยุทธ์ เลขาธิการสำนักงานประกันสังคม กล่าวว่า สำนักงานประกันสังคมจังหวัดสมุทรปราการ แจ้งว่าลูกจ้างผู้เสียชีวิต เป็นผู้ประกันตนตามกฎหมาย ทายาทจะได้รับสิทธิประโยชน์จากกองทุนเงินทดแทน ดังนี้ เป็นค่ารักษาพยาบาลตามอัตราที่กำหนดในกฎกระทรวง ค่าทดแทนกรณีหยุดพักรักษาตัวอัตราเดือนละ 9,422 บาท เป็นเวลา 18 วัน (5-22 กรกฎาคม 2566) เป็นเงิน 5,653.20 บาท ค่าทำศพ 50,000 บาท ค่าทดแทนกรณีเสียชีวิตอัตราเดือนละ 9,422 บาท เป็นเวลา 10 ปี เป็นเงิน 1,130,640 บาท และเงินบำเหน็จชราภาพกรณีเสียชีวิต จำนวน 19,072.03 บาท (ยังไม่รวมดอกผล) รวมเป็นเงินทั้งสิ้น 1,205,365.23 บาท
The Labour Minister showed concern about the employee who was burned all over their body by a hot air pipe. He instructed the Department of Labour Protection and Welfare (DLPW) and the Social Security Office (SSO) to urgently assist with benefits and investigate the facts.
The Labour Minister, Mr. Suchart Chomklin, spoke about the case of the employee burned all over their body by a hot air pipe. Firstly, he expressed his condolences to the relatives of the deceased. At the same time, he instructed the Department of Labour Protection and Welfare and agencies under the Ministry of Labour to visit the area to inspect the incident scene. The Security Inspector from the Samut Prakan Provincial Labour Protection and Welfare Office reported that on July 5, 2023, at 10.00 hours, an employee named Mr. Yosawat Panpai, 22, a technician of a company in Bangpoo Industrial Estate, had an accident at work, causing the employee to be burned all over his body by the hot air pipe, except on his chest and stomach. He received treatment at Muang Samut Pak Nam Hospital (Bang Pu), Samut Prakan Province, from July 5, 2023, and died on July 23, 2023. After the employee passed away, he assigned the Samut Prakan Social Security Office to accelerate paying benefits to the deceased’s relatives. The Department of Labour Protection and Welfare shall proceed in the relevant areas according to its powers and duties.
The Department of Labour Protection and Welfare’s Director-General, Mr. Niyom Songkaew, said that in connection with the authority of the department, he had instructed the Samut Prakan Provincial Labour Protection and Welfare Office and the Workplace Safety Center, District 10, Samut Prakan, to speed up checking for more information. The Security Inspector from the Samut Prakan Provincial Labour Protection and Welfare Office sent an invitation letter to the employer to meet on July 27 to investigate further facts and to check whether the employer has violated the Occupational Health, Safety, and Working Environment Act B.E. 2554, and the occupational health, safety, and environment regulations for work on machinery, cranes and boilers B.E 2564. If the employer has failed to comply with the said law, further legal action will be taken.
The Social Security Office’s Secretary-General, Mr. Boonsong Thapchaiyut, said the Samut Prakan Provincial Social Security Office has reported that the deceased employee is legally insured. The beneficiaries will receive benefits from the Compensation Fund as follows: Medical expenses at the rates prescribed in the Ministerial Regulations, compensation in case of a medical break at the rate of 9,422 Baht per month for 18 days (July 5-22, 2023) for 5,653.20 Baht, funeral expenses for 50,000 Baht, compensation in case of death at the rate of 9,422 Baht per month for ten years, amounting to 1,130,640 Baht, and old-age gratuity in the event of death amounting to 19,072.03 Baht (excluding interest), totaling 1,205,365.23 Baht.
