รัฐมนตรีว่าการกระทรวงแรงงาน เผยความคืบหน้าการให้ความช่วยเหลือลูกจ้าง 2 โรงงานปั่นด้าย จังหวัดสมุทรปราการ ถูกเลิกจ้าง แจงพนักงานตรวจแรงงานออกคำสั่งให้นายจ้างจ่ายค่าจ้าง ค่าชดเชยเป็นเงินกว่า 60 ล้านบาท พร้อมสั่งจ่ายเงินกองทุนสงเคราะห์ลูกจ้างเพื่อเยียวยาความเดือดร้อนเบื้องต้นกว่า 5 ล้านบาท
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงความคืบหน้าในการดำเนินการให้ความช่วยเหลือลูกจ้าง 2 โรงงานปั่นทอ ย่านพระสมุทร์เจดีย์ จ.สมุทรปราการ ที่ถูกเลิกจ้างว่า พนักงานตรวจแรงงานสำนักงานสวัสดิการและคุ้มครองแรงงานสมุทรปราการ (สสค.สมุทรปราการ) ได้มีคำสั่งให้ บริษัท แอลฟ่าสปินนิ่ง จำกัด นายจ้าง จ่ายค่าจ้าง ค่าบอกกล่าว และค่าชดเชย ให้กับลูกจ้างที่มายืนคำร้อง 241 คน เป็นเงิน39,930,936.25 บาท ซึ่งคณะกรรมการกองทุนสงเคราะห์ลูกจ้างได้เห็นชอบให้จ่ายเงินสงเคราะห์ให้กับลูกจ้างเป็นเงินทั้งสิ้น 5,242,050 บาท โดยแบ่งเป็นกรณีเงินอื่นนอกจากค่าชดเชย จ่ายให้กับลูกจ้างจำนวน 105 คนเป็นเงิน 2,223,900 บาท ซึ่งสสค.สมุทรปราการ ได้ดำเนินการโอนเงินดังกล่าวให้กับลูกจ้างแล้ว (25 กค. 66) สำหรับเงินสงเคราะห์กรณีนายจ้างเลิกจ้างโดยไม่จ่ายค่าชดเชย เห็นชอบให้จ่ายเงินให้กับลูกจ้าง จำนวน 129 คน เป็นเงิน 3,018,150 บาท คาดว่าจะดำเนินการจ่ายให้กับภายในสัปดาห์นี้ ในส่วนลูกจ้าง 10 คน ที่มายื่นคำร้องภายหลัง พนักงานตรวจแรงงานจะเร่งดำเนินการออกคำสั่งเพื่อให้ลูกจ้างได้รับสิทธิตามกฎหมายโดยเร็ว สำหรับบริษัท เอเอ็มซี สปินนิ่ง จำกัด พนักงานตรวจแรงงานได้ออกคำสั่งให้นายจ้างจ่ายค่าจ้าง ค่าบอกกล่าวล่วงหน้า และค่าชดเชย ให้กับลูกจ้างจำนวน 162 คน เป็นเงินจำนวน 25,928,583.20 บาท ทั้งนี้พนักงานตรวจแรงงานได้เสนอให้คณะกรรมการกองทุนสงเคราะห์ลูกจ้างพิจารณาจ่ายเงินสงเคราะห์ฯเพื่อเป็นการบรรเทาความเดือดร้อนเบื้องให้กับลูกจ้างกลุ่มนี้แล้ว ในส่วนลูกจ้าง 3 คน ที่ยื่นคำร้องเพิ่มเติม พนักงานตรวจแรงงานจะเร่งดำเนินการออกคำสั่งเพื่อให้ลูกจ้างได้รับสิทธิตามกฎหมายต่อไป
รมว.แรงงาน กล่าวต่อว่า ตนได้ทราบว่าในวันนี้ (21 ส.ค. 66) กลุ่มลูกจ้างของสถานประกอบกิจการทั้ง 2 แห่ง ได้เดินทางมาที่กระทรวงแรงงานเพื่อขอให้เร่งดำเนินการช่วยเหลือ ผมได้มอบหมายให้นายสมพงษ์คล้อยแคล้ว หัวหน้าผู้ตรวจราชการกรม กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) เป็นผู้แทนรับหนังสือจากผู้แทนลูกจ้าง ชี้แจงและร่วมกันหาแนวทางในการช่วยเหลือลูกจ้าง ทั้งนี้ได้สั่งการให้กรมสวัสดิการและคุ้มครองแรงงานเร่งดำเนินการตามอำนาจหน้าที่ และเฝ้าติดตามสถานการณ์การจ้างงานของนายจ้างรายนี้อย่างใกล้ชิดต่อไป
ด้าน นายนิยม สองแก้ว อธิบดีกรมสวัสดิการและคุ้มครองแรงงาน (กสร.) กล่าวเพิ่มเติมว่า กรมได้สั่งการให้สำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดสมุทรปราการ เร่งดำเนินการตามอำนาจหน้าที่เพื่อให้ลูกจ้างได้รับสิทธิประโยชน์ตามกฎหมายโดยเร็ว ในส่วนของการดำเนินคดีอาญากรณีนายจ้างไม่ปฏิบัติตามคำสั่งพนักงานตรวจแรงงานและการดำเนินคดีแพ่ง ขณะนี้อยู่ระหว่างการดำเนินการของนิติกร ซึ่งได้กำชับให้ดำเนินการอย่างรวดเร็วเช่นเดียวกัน
The Labour Minister spoke about the progress in supporting employees from two weaving factories in Samut Prakan Province who were laid off. The Labour Inspectors have instructed employers to pay wages and compensation of over 60 million Baht. Additionally, he instructed payment from the Employee Welfare Fund to provide initial remedies totaling over 5 million Baht.
The Labour Minister, Mr. Suchart Chomklin, spoke about the progress in helping the employees who were laid off from the two weaving factories in the Phra Samut Chedi area in Samut Prakan Province. The Labour Inspector from the Samut Prakan Labour Protection and Welfare Office has instructed Alpha Spinning Co., Ltd., the employer, to pay wages, notices, and compensation to 241 employees who filed the petition for 39,930,936.25 Baht. The Employee Welfare Fund Committee has approved the payment of allowances to employees for 5,242,050 Baht. This amount includes cases other than compensation paid to 105 employees for 2,223,900 Baht, in which the Samut Prakan Labour Protection and Welfare Office confirmed the money was transferred to the employees (July 25, 2023). Subsidies, where the employer terminates employment without compensation, were approved for 129 employees for 3,018,150 Baht, expected to be paid within this week. As for the ten employees who later filed a petition, the Labour Inspector will expedite the issuance of orders so that employees are legally entitled as soon as possible. For AMC Spinning Co., Ltd., the Labour Inspector has instructed the employer to pay wages, advance notice, and compensation to 162 employees for 25,928,583.20 Baht. The Labour Inspector has proposed to the Employee Welfare Fund Committee to consider paying aid to alleviate the suffering of this group of employees. For the three employees who filed an additional petition, the Labour Inspector will speed up the issuance of orders so that employees are entitled to legal rights.
The Labour Minister continued that today (August 21, 2023), company employees traveled to the Ministry of Labour to ask them to expedite support. The Department of Labour Protection and Welfare’s Chief Inspector-General, Mr. Sompong Kloyklaew, has been assigned to be the representative in receiving the letters from the employee representatives to clarify and jointly find ways to help the employees. In this regard, the Department of Labour Protection and Welfare has been instructed to expedite actions following its authority and continue to closely monitor the employment situation of this employer.
The Department of Labour Protection and Welfare’s Director-General, Mr. Niyom Songkaew, added that the Department has instructed the Samut Prakan Provincial Labour Protection and Welfare Office to accelerate actions following their authority so that employees receive legal benefits as soon as possible. Criminal proceedings in the case of the employer failing to comply with orders of the Labour Inspector, including civil proceedings, are in the process of legal proceedings, which have been instructed to be executed swiftly as well.
