กระทรวงแรงงาน ใช้มาตรการลงพื้นที่สุ่มตรวจทั่วประเทศโดยไม่แจ้งล่วงหน้า เผยตรวจสอบสถานประกอบการแล้ว 18,966 แห่ง ดำเนินคดี 685 แห่ง ตรวจสอบคนต่างชาติ จำนวน 240,918 คน ดำเนินคดี 1,550 คน เป็นความผิดแย่งอาชีพคนไทย 883 คน
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า จากกรณีพบคนต่างชาติเร่ขายสินค้า ตามแหล่งท่องเที่ยวและย่านการค้าซึ่งเป็นที่นิยมทั้งในกลุ่มชาวไทยและนักท่องเที่ยวต่างชาติ จนกระทบต่อบรรดาผู้ประกอบการในพื้นที่ นั้น พล.อ. ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี ทราบเรื่องแล้วรู้สึกห่วงใยพ่อค้าแม่ค้าคนไทยจะถูกแรงงานต่างชาติแย่งอาชีพครไทย แย่งรายได้อย่างมาก จึงสั่งการให้กระทรวงแรงงานกวาดล้างแรงงานต่างชาติที่แย่งอาชีพคนไทย รวมถึงแรงงานต่างชาติที่ทำงานผิดกฎหมาย ไม่มีใบอนุญาตทำงาน โดยบังคับใช้กฎหมายอย่างเข้มข้น ซึ่งตนในฐานะรัฐมนตรีว่าการกระทรวงแรงงานรับข้อสั่งการแล้วไม่เคยนิ่งนอนใจ ใช้มาตรการลงพื้นที่สุ่มตรวจโดยไม่แจ้งล่วงหน้าในทุกจังหวัด
“จากผลการดำเนินการปีงบประมาณ 2566 (วันที่ 1 ตุลาคม 2565 – 12 มีนาคม 2566) มีการเข้าตรวจสอบสถานประกอบการที่จ้างแรงงานต่างชาติทั่วประเทศแล้ว จำนวน 18,966 แห่ง ดำเนินคดี 685 แห่ง และตรวจสอบคนต่างชาติ จำนวน 240,918 คน แยกเป็นสัญชาติเมียนมา 177,134 คน กัมพูชา 40,750 คน ลาว 12,311 คน เวียดนาม 140 คน และสัญชาติอื่น ๆ 10,583 คน มีการดำเนินคดีทั้งสิ้น 1,550 คน แยกเป็นสัญชาติเมียนมา 846 คน กัมพูชา 245 คน ลาว 269 คน เวียดนาม 65 คน และสัญชาติอื่น ๆ 125 คน ซึ่งพบเป็นการแย่งอาชีพคนไทย ทั้งสิ้น 883 คน แยกเป็นสัญชาติเมียนมา 392 คน กัมพูชา 195 คน ลาว 139 คน เวียดนาม 55 คน อินเดีย 68 คน และสัญชาติอื่น ๆ 34 คน โดยอาชีพที่พบคนต่างชาติแย่งอาชีพมากที่สุด ได้แก่ งานเร่ขายสินค้า งานตัดผม งานขับขี่ยานพาหนะ และงานนวด ตามลำดับ” รมว.แรงงาน กล่าว
ด้านนายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า เจ้าหน้าที่ชุดเฉพาะกิจตรวจสอบ ปราบปราม จับกุม และดำเนินคดี คนต่างด้าวทำงานผิดกฎหมายฯ ของกรมการจัดหางาน และสำนักงานจัดหางานจังหวัดทั่วประเทศ รับข้อสั่งการรัฐมนตรีว่าการกระทรวงแรงงาน บูรณาการร่วมกับหน่วยงานที่เกี่ยวข้อง ปูพรมตรวจสอบทั่วประเทศ โดยเฉพาะในเมืองท่องเที่ยวหลัก ทั้งกรุงเทพมหานคร ภูเก็ต สมุย พัทยา เชียงใหม่ ที่เป็นแหล่งประกอบอาชีพของคนไทย และย่านการค้าแหล่งเศรษฐกิจสำคัญที่พบเห็นแรงงานต่างชาติทำงานจำนวนมาก อย่างในพื้นที่กรุงเทพมหานคร อาทิ เยาวราช ห้วยขวาง ปากคลองตลาด และจังหวัดปริมณฑล อาทิ สมุทรสาคร นครปฐม สระบุรี ปทุมธานี ซึ่งหากตรวจสอบพบมีความผิดจะดำเนินคดีตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม โดยไม่มีข้อยกเว้น
“แรงงานต่างชาติที่เข้ามาทำงานในประเทศไทยต้องเคารพกฎหมายของเรา เช่นเดียวกับที่เวลาคนไทยไปทำงานในต่างประเทศก็ต้องเคารพกฎหมายของประเทศนั้นๆ โดยแรงงานต่างชาติต้องมีเอกสารประจำตัวบุคคลและใบอนุญาตทำงานถูกต้อง รวมทั้งต้องทำงานตามสิทธิ ที่ระบุไว้ในประกาศกระทรวงแรงงาน เรื่อง กำหนดงานที่ห้ามคนต่างด้าวทำ (มีทั้งสิ้น 40 งาน) ซึ่งคนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือสิทธิที่จะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศต้นทาง รวมถึงห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี นับตั้งแต่วันที่ได้รับโทษ และนายจ้าง/สถานประกอบการ ที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี” อธิบดีกรมการจัดหางงาน กล่าว
The Ministry of Labour has implemented measures to visit random areas nationwide without prior notice. It reported that 18,966 establishments were inspected, 685 were prosecuted, 240,918 foreigners were examined, and 1,550 were prosecuted.
The Labour Minister, Mr. Suchart Chomklin, spoke about the case of foreigners peddling goods around tourist attractions and commercial areas popular among Thai and foreign tourists, which has affected business operators in the area. Prime Minister General Prayuth Chan-ocha has acknowledged the issue and shown concern for Thai merchants having their jobs and income taken by foreign workers. Therefore, the Ministry of Labour was instructed to remove foreign workers taking Thai people’s careers, including foreign workers working illegally without a work permit, by rigorously enforcing the law. The Labour Minister received the orders and has implemented measures to visit random areas without prior notice in all provinces.
“For the 2023 fiscal year (October 1, 2022 – March 12, 2023), 18,966 establishments employing foreign workers have been inspected nationwide, of which 685 have been prosecuted. 240,918 foreign workers have been inspected, comprising 177,134 Myanmar nationals, 40,750 Cambodian nationals, 12,311 Laotian nationals, 140 Vietnamese nationals, and 10,583 people of other nationalities. From this, 1,550 have been prosecuted, comprising 846 Myanmar nationals, 245 Cambodian nationals, 269 Laotian nationals, 65 Vietnamese nationals, and 125 people of other nationalities. There were 883 foreigners found in professions reserved for Thai people, comprising 392 Myanmar nationals, 195 Cambodian nationals, 139 Laotian nationals, 55 Vietnamese nationals, 68 Indian nationals, and 34 from other nationalities. The top occupations foreigners had illegally taken were peddling goods, hairdressers, drivers, and massage jobs, respectively,” said the Labour Minister.
The Department of Employment’s Director-General, Mr. Phairoj Chotikasatien, said that the special task force to inspect, suppress, arrest and prosecute foreigners working illegally from the Department of Employment and provincial employment offices across the country received the Labour Minister’s orders. It has worked with relevant agencies in inspections nationwide, especially in tourist cities, including Bangkok, Phuket, Samui, Pattaya, and Chiang Mai, a source of occupation for Thai people. Inspections have also taken place in commercial areas and important economic sources that see many foreign workers working in Bangkok areas such as Yaowarat, Huai Khwang, Pak Khlong Talat and its vicinity, such as Samut Sakhon, Nakhon Pathom, Saraburi, Pathum Thani. If found guilty, the prosecution will be taken according to the Emergency Decree on Managing the Work of Foreigners, B.E. 2560, and amendments, without exception.
“Foreign workers working in Thailand must obey our laws, just like when Thai people work in foreign countries, they must respect the laws of that country. Foreign workers must have a valid personal identification document and work permit and work according to the right specified in the Ministry of Labour’s notification on the work that foreigners are prohibited from doing (a total of 40 jobs). Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. They will not be allowed to apply for a work permit for two years from the prosecution date. Employers who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years,” said the Department of Employment’s Director-General.
