วันที่ 7 ธันวาคม 2566 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า ตามที่ได้เกิดอุบัติเหตุกรณีแผ่นปูนในงานก่อสร้างอาคารทาวเฮ้าท์หล่นทับคนงานบาดเจ็บและเสียชีวิตที่จังหวัดนนทบุรี เมื่อวันที่ 5 ธ.ค.66 นั้น ผมขอแสดงความเสียใจกับครอบครัวของผู้เสียชีวิต ซึ่งทันทีที่ทราบข่าวผมได้กำชับให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ร่วมกับสำนักงานประกันสังคม (สปส.) เข้าตรวจสอบข้อเท็จจริงเพื่อดำเนินการตามกฎหมาย พร้อมทั้งให้หน่วยงานสังกัดกระทรวงแรงงานให้ความช่วยเหลือด้านสิทธิประโยชน์แก่ญาติผู้เสียชีวิตพึงได้รับในทุกมิติ พร้อมเน้นย้ำให้นายจ้างปฏิบัติตามกฎหมายความปลอดภัยในการทำงานอย่างเคร่งครัด เพื่อป้องกันไม่ให้เกิดอุบัติเหตุจากการทำงานเช่นนี้อีก
นายพิพัฒน์ กล่าวต่อว่า จากรายงานของสำนักงานสวัสดิการและคุ้มครองจังหวัดนนทบุรี พบว่า เหตุการณ์ดังกล่าวเกิดขึ้นเมื่อวันที่ 5 ธันวาคมที่ผ่านมา เวลาประมาณ 11.30 น. ได้เกิดเหตุแผ่นปูนในงานก่อสร้างอาคารพาณิชย์สูง 2 ชั้น 3 คูหา ที่อยู่ในระหว่างกำลังก่อสร้างหล่นลงมาทับคนงานภายในหมู่บ้านพฤกษา 16 โครงการทาวน์โฮม 2 ชั้น The Peace สถานที่เกิดอุบัติเหตุตั้งอยู่ที่ตำบลบางใหญ่ อำเภอบางใหญ่ จังหวัดนนทบุรี จากรายงานของสำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดนนทบุรี ยังพบว่า ข้อกฎหมายที่เกี่ยวข้องกับกระทรวงแรงงาน ได้แก่ กฎกระทรวงกำหนดมาตรฐานในการบริหารในงานก่อสร้าง และเกี่ยวกับนั่งร้านและค้ำยัน พ.ศ.2564 ข้อ 15 ซึ่งนายจ้างต้องควบคุมมิให้บุคคลอยู่ใต้บริเวณที่มีการใช้ค้ำยันฯ กรณีผ่าฝืนตามพระราชบัญญัติความปลอดภัยอาชีวอนามัยและสภาพแวดล้อมในการทำงาน มาตรา 8 ต้องระวางโทษตามมาตรา 53 ปรับไม่เกิน 400,000 บาท หรือจำคุกไม่เกิน 1 ปี หรือทั้งจำทั้งปรับ ทั้งนี้ พนักงานตรวจความปลอดภัย สำนักงานสวัสดิการและคุ้มครองแรงงานจังหวัดนนทบุรีจะได้เข้าตรวจสอบสถานที่เกิดเหตุและดำเนินการตามอำนาจหน้าที่ต่อไป
ทั้งนี้ จากรายงานของสำนักงานประกันสังคมจังหวัดนนทบุรี สาขาบางบัวทอง พบว่า เหตุการณ์ดังกล่าวมีผู้เสียชีวิตในที่เกิดเหตุ 1 ราย ทราบชื่อคือ นาย TUB LIN OO เป็นแรงงานสัญชาติเมียนมา และมีผู้บาดเจ็บ 1 ราย ทราบชื่อคือ นาย YEN KO LEN เป็นแรงงานสัญชาติเมียนมาเช่นกัน ซึ่งผู้บาดเจ็บได้เข้ารับการรักษาตัวที่โรงพยาบาลบางใหญ่และได้กลับไปยังที่พักอาศัยแล้ว กรณีการประสบอันตรายดังกล่าวเป็นเหตุเนื่องจากการทำงานลูกจ้างจะได้รับเงินทดแทน เป็นค่ารักษาพยาบาลเบื้องต้นไม่เกิน 50,000 บาท ค่าทดแทนการหยุดงานมาตรา 18 (1) ร้อยละ 70 ของค่าจ้าง ค่าฟื้นฟูสมรรถภาพการทำงาน หากมีการสูญเสียสมรรถภาพการทำงาน กรณีลูกจ้างเสียชีวิต ผู้จัดการศพจะได้รับค่าทำศพ 50,000 บาท และผู้มีสิทธิตามมาตร 20 จะได้รับค่าทดแทนร้อยละ 70 ของค่าจ้างรายเดือนเป็นระยะเวลา 10 ปี โดยสำนักงานประกันสังคมจังหวัดนนทบุรี สาขาบางบัวทอง ได้ออกตรวจสอบสถานที่เกิดเหตุและประสานนายจ้างให้ปฏิบัติให้ถูกต้องตามกฎหมายรวมทั้งแนะนำสิทธิประโยชน์กองทุนเงินทดแทนต่อไป
“กระทรวงแรงงาน เราห่วงใยแรงงานทุกคนที่เข้ามาทำงานในประเทศอย่างถูกต้องตามกฎหมาย
เมื่อประสบอันตรายจากการทำงาน ก็จะต้องได้รับการคุ้มครองไม่ว่าแรงงานคนนั้นจะเป็นคนไทยหรือคนต่างชาติ เพราะแรงงานทุกคนมีส่วนสำคัญในการขับเคลื่อนเศรษฐกิจของประเทศ เขาจึงต้องได้รับสิทธิการคุ้มครองอย่างเท่าเทียมกันทุกประการ” นายพิพัฒน์ กล่าวท้ายสุด
On December 7, 2023, the Labour Minister, Mr. Phiphat Ratchakitprakarn, spoke about an accident in which a cement slab fell on a worker from a townhouse building during construction in Nonthaburi Province. The incident happened on December 5, 2023, causing injury and death. The Labour Minister expressed his condolences to the family of the deceased. As soon as I heard the news, he instructed the Department of Labour Protection and Welfare (DLPW) and the Social Security Office (SSO) to investigate the facts in order to take legal action. He also asked agencies under the Ministry of Labour to assist in all aspects of the benefits that the relatives of the deceased should receive. He emphasized that employers must strictly comply with occupational safety laws to prevent accidents at work like this again.
Mr. Phiphat said that the Nonthaburi Provincial Labour Protection and Welfare Office reported that the incident happened on December 5 at approximately 11.30 hours. A cement slab from the construction of a 2-story, 3-unit commercial building under construction fell on workers inside Pruksa 16 Village, The Peace 2-story townhome project. The accident location is in Bang Yai Subdistrict, Bang Yai District, Nonthaburi Province. The Nonthaburi Provincial Labour Protection and Welfare Office’s report also identified legal matters related to the Ministry of Labour, including ministerial regulations specifying standards for management in construction work and regarding scaffolding and bracing, B.E. 2021, Section 15, in which the employer must ensure that no person is under the area where the bracing is used. Violating the Occupational Safety, Health and Environment Act, Section 8, will result in punishments according to Section 53, with a fine not exceeding 400,000 Baht or imprisonment not exceeding one year, or both. The Safety Inspector from the Nonthaburi Provincial Labour Protection and Welfare Office will inspect the scene of the incident and take further action according to its authority.
The Nonthaburi Social Security Office’s Bang Bua Thong Branch found that there was one death at the scene of the incident. The known name is Mr. Tub Lin Oo, a worker of Myanmar nationality. There was also one injured person, Mr. Yen Ko Len, also from Myanmar. The injured person received treatment at Bang Yai Hospital and has returned to his residence. In the event that such injury is caused by work, the employee will receive compensation covering basic medical expenses not exceeding 50,000 Baht, compensation for time off from work under Section 18 (1), which is 70 percent of wages, and work rehabilitation expenses if there is a loss of working ability. In the case of the death of an employee, funeral directors will receive funeral expenses of 50,000 Baht. Those eligible under Section 20 will receive compensation of 70 percent of their monthly wages for ten years. The Nonthaburi Provincial Social Security Office’s Bang Bua Thong Branch inspected the scene of the incident and coordinated with the employer to comply with the law, including recommending benefits from the Compensation Fund.
“The Ministry of Labour cares about all workers who come to work in the country legally. When experiencing danger from work, whether the worker is a Thai or a foreigner, they must be protected. Every worker plays an important role in driving the country’s economy. Therefore, they are equally protected in all respects,” Mr. Phiphat concluded.
