เมื่อวันที่ 4 ตุลาคม 2566 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยถึงกรณีเหตุกราดยิงที่ศูนย์การค้าสยามพารากอน เมื่อช่วงเย็นวันที่ 3 ตุลาคมที่ผ่านมาว่า ทันทีที่ทราบข่าวว่าผู้เสียชีวิตจากการกราดยิง 2 ราย เป็นชาวเมียนมาและชาวจีน
ผมได้สั่งการให้กรมฯ ที่เกี่ยวข้อง เร่งตรวจสอบทันที ซึ่งจากการตรวจสอบข้อเท็จจริงกับสำนักงานประกันสังคม พบว่า ชาวเมียนมาที่เสียชีวิต เป็นผู้ประกันตนตามมาตรา 33 ในส่วนของ ผู้บาดเจ็บ อีก 5 ราย พบว่าเป็นผู้ประกันตน 4 ราย แบ่งเป็นผู้ประกันตนตามมาตรา 33 ที่เป็นลูกจ้างชาวไทย จำนวน 2 ราย เป็นผู้ประกันตนตามมาตรา 33 ที่เป็นลูกจ้างแรงงานสัญชาติลาว จำนวน 1 ราย และเป็นผู้ประกันตนตามมาตรา 39 ที่เป็นลูกจ้างชาวไทย จำนวน 1 ราย
” ในนามของกระทรวงแรงงาน ซึ่งดูแลชาวต่างชาติที่ทำงานอยู่ในประเทศไทย ขอแสดงความเสียใจต่อการสูญเสียในครั้งนี้ เรามีความห่วงใยต่อชาวต่างชาติทุกคนที่เข้ามาทำงานอยู่ในประเทศไทย และขอให้เชื่อมั่นว่าเราจะดูแลและคุ้มครองแรงงานต่างชาติที่เข้ามาทำงานในประเทศไทยอย่างถูกต้องตามกฎหมายทุกคนให้เท่าเทียมกับแรงงานไทยทุกประการ ให้ความคุ้มครองตามหลักสิทธิมนุษยชน และสิทธิประโยชน์ตามกฎหมาย เพราะแรงงานต่างชาติทุกคนที่เข้ามาทำงานในประเทศไทย คือส่วนสำคัญในการขับเคลื่อนเศรษฐกิจของประเทศ โดยชาวต่างชาติที่ทำงานในประเทศไทยอย่างถูกต้องตามกฎหมายและเป็นผู้ประกันตนตามกฎหมายประกันสังคม หากเสียชีวิตจะได้รับสิทธิประโยชน์กรณีเสียชีวิตเป็นค่าทำศพ และเงินสงเคราะห์
ในส่วนลูกจ้างที่ได้รับบาดเจ็บ ซึ่งเป็นลูกจ้างบริษัทรักษาความปลอดภัย และเป็นผู้ประกันตนตามมาตรา 33 นับเป็นการบาดเจ็บเนื่องจากการทำงาน จะได้รับเงินทดแทนร้อยละ70 ของค่าจ้าง ขณะที่ ลูกจ้างที่เป็นผู้ประกันตนตามมาตรา 39 จะได้รับเงินทดแทนการขาดรายได้ร้อยละ 50 ของค่าจ้าง โดยผู้ที่ได้รับบาดเจ็บ สำนักงานประกันสังคมจะดูแลสิทธิในการรักษาพยาบาลจนสิ้นสุดการรักษาทุกราย และขณะนี้ สำนักงานประกันสังคมได้เข้าไปดูแลเรียบร้อยแล้ว ” นายพิพัฒน์ฯ กล่าว
On October 4, 2023, the Labour Minister, Mr. Phiphat Ratchakitprakarn spoke about the shooting incident at Siam Paragon shopping center on the evening of October 3. When the news emerged that two people had died from the shooting, Myanmar nationals and Chinese nationals, he assigned the relevant departments to perform checks immediately. After checking the facts with the Social Security Office, it was found that the Myanmar person who died was insured under Section 33. As for the other five injured people, four were insured. The insured persons include three under Section 33, two of whom were Thai nationals and one from Laos. There was also one Thai national insured under Section 39.
“On behalf of the Ministry of Labour, which takes care of foreigners working in Thailand, I would like to express my condolences for this loss. We care about all foreigners coming to work in Thailand. Please be confident that we will take care of and protect all foreign workers who come to work in Thailand legally to be equal to Thai workers in all respects. We protect according to human rights principles and legal benefits, as all foreign workers who come to work in Thailand are an important part of driving the country’s economy. Foreigners who work in Thailand legally and are insured according to social security law will receive funeral expenses and allowances in the case of death.”
“For the injured person who is an employee of a security company and is insured under Section 33, it is considered a work-related injury and, therefore, will receive compensation of 70 percent of their wages. Employees who are insured under Section 39 will receive compensation for lost income of 50 percent of their wages. For those injured, the Social Security Office will take care of everyone’s rights and medical treatment until the end of treatment. Now, the Social Security Office has already taken care of it,” Mr. Phiphat said.
