ตามที่ คบต. ได้เห็นชอบข้อพิจารณา ขยายเวลาให้กลุ่มที่ยื่นขออนุญาตทำงานและจ่ายค่าธรรมเนียมแล้ว ภายใน 13 กุมภาพันธ์ 2566 และสามารถอยู่ต่อในราชอาณาจักรเป็นกรณีพิเศษ ได้ถึงวันที่ 15 พฤษภาคม 2566 โดยมีรายละเอียดดังนี้
คณะกรรมการนโยบายการบริหารจัดการการทำงานของคนต่างด้าว (คบต.) ได้เห็นชอบแนวทางการบริหารจัดการการทำงานของคนต่างด้าวภายหลังวันที่ 13 กุมภาพันธ์ 2566 โดยผ่อนผันให้คนต่างด้าวที่ยื่นขอต่อใบอนุญาตทำงาน และชำระค่าธรรมเนียมผ่านระบบอิเล็กทรอนิกส์ กรมการจัดหางาน ภายในวันที่ 13 กุมภาพันธ์ 2566 แล้ว สามารถอยู่ในราชอาณาจักรเป็นกรณีพิเศษและทำงานได้ถึงวันที่ 15 พฤษภาคม 2566 เพื่อจัดทำหนังสือเดินทางหรือเอกสารใช้แทนหนังสือเดินทาง โดยระหว่างที่ยังไม่ได้รับใบอนุญาตทำงานจากกรมการจัดหางาน ให้ใช้ใบรับคำขอต่ออายุใบอนุญาตทำงาน หรือทะเบียนใบอนุญาตทำงาน ตามแต่ละกรณี คู่กับใบเสร็จรับเงิน เพื่อใช้แสดงต่อพนักงานเจ้าหน้าที่ว่าได้รับอนุญาตทำงานตามกฎหมายแล้ว ทั้งนี้ เมื่อดำเนินการครบตามขั้นตอนแล้ว คนต่างด้าวจะได้รับอนุญาตทำงานถึงวันที่ 13 กุมภาพันธ์ 2567 หรือวันที่ 13 กุมภาพันธ์ 2568 แล้วแต่กรณี
นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน กล่าวว่า “พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี ให้ความสำคัญกับการฟื้นฟูเศรษฐกิจของประเทศไทย หลังสถานการณ์โควิด-19 คลี่คลายอย่างยิ่ง โดยได้กำชับกระทรวงแรงงาน บูรณาการร่วมกับหน่วยงานที่เกี่ยวข้อง วางแนวทางป้องกันปัญหาการขาดแคลนแรงงาน โดยเฉพาะงานที่คนไทยไม่ทำ และจำเป็นต้องใช้แรงงานข้ามชาติ เพื่อให้ผู้ประกอบการมีแรงงานในการขับเคลื่อนกิจการ”
นายสุชาติ กล่าวต่อว่า นอกจากนี้ กรมการจัดหางานยังได้รับการประสานจากภาคเอกชนถึงปัญหาขัดข้องที่สถานทูตไม่สามารถจัดทำหนังสือเดินทางเล่มใหม่ได้ทันภายในวันที่ 1 สิงหาคม 2565 จากข้อเสนอของทางการเมียนมาและภาคเอกชนดังกล่าว จึงจำเป็นต้องมีแนวทางการบริหารจัดการการทำงานของคนต่างด้าวในส่วนที่เกี่ยวข้องให้สามารถอยู่ในราชอาณาจักรเป็นกรณีพิเศษ เพื่อการทำงานในช่วงระยะเวลาที่อยู่ระหว่างการจัดทำหนังสือเดินทาง หรือเอกสารรับรองบุคคลฉบับใหม่ ตลอดจนขยายระยะเวลาการดำเนินการของศูนย์ CI เพื่อสามารถดำเนินการออกเอกสารรับรองบุคคลให้เสร็จสิ้น ทั้งนี้ ก็ขอฝาก และย้ำเตือนให้สถานประกอบการ และตัวแรงงานต่างด้าวเอง ให้รีบดำเนินการให้แล้วเสร็จภายในวันที่ 15 พฤษภาคมนี้ เพื่อรักษาสิทธิของตนเองอีกทางหนึ่ง
The Foreign Worker Management Fund Committee approved to extend of the time for groups who have applied for a work permit and paid the fee by February 13, 2023, to stay in the Kingdom as a special case until May 15, 2023, with the following details:
The Foreign Worker Management Fund Committee approved guidelines for the management of work for foreigners after February 13, 2023, by allowing foreigners who applied for work permit extensions and paid fees online to the Department of Employment by February 13, 2023, to stay in the Kingdom as a special case and work until May 15, 2023, to prepare a passport or document to be used in replacement. While they haven’t received a work permit from the Department of Employment, they must use the work permit renewal application form or work permit registration, depending on the case, together with a receipt to show the competent officials that they have been permitted to work according to the law. Foreigners will be permitted to work until February 13, 2024, or February 13, 2025, as the case may be.
The Labour Minister, Mr. Suchart Chomklin, said, “The Prime Minister General Prayuth Chan-ocha, gives importance to Thailand’s economic recovery after the COVID-19 situation improved. The Ministry of Labour was instructed to work with relevant agencies to lay out guidelines to prevent labour shortages, especially the work that Thai people do not do, which requires migrant workers so that business operators have the manpower to drive their business.”
Mr. Suchart continued that additionally, the Department of Employment has coordinated with the private sector about the issue that embassies could not produce new passports by August 1, 2022, from proposals from the Myanmar authorities and the private sector. Therefore, it is necessary to have a guideline for managing the work of foreigners involved in staying in the Kingdom as a special case and work during the period in which the passport is being prepared or a new identification document as well as extending the operation period of the CI Center to complete the issuance of the identity document. He reminded employers and the foreign workers to hurry and complete the process by May 15 to maintain their eligibility.
