วันที่ 28 มีนาคม 2566 นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน พร้อมด้วยนายสันติ นันตสุวรรณ รองอธิบดีกรมการจัดหางาน นำชุดเฉพาะกิจตรวจสอบ ปราบปราม จับกุม และดำเนินคดีคนต่างด้าวทำงานผิดกฎหมาย และเจ้าหน้าที่สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 10 ลงพื้นที่ห้วยขวาง เพื่อตรวจสอบปราบปรามคนต่างชาติที่ลักลอบทำงานโดยผิดกฎหมาย ร่วมกับ พ.ต.ท. ไอยรา อากาศวิภาต สวป.สน. ห้วยขวาง
นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน เปิดเผยว่า ในวันนี้ตนลงพื้นที่ตรวจสอบการทำงานของแรงงานต่างชาติ ณ พื้นที่ห้วยขวาง เพื่อตรวจบังคับใช้กฎหมายกับคนต่างชาติที่ไม่มีใบอนุญาตทำงานและทำงานนอกเหนือสิทธิ โดยเรื่องนี้สืบเนื่องจากที่กรมการจัดหางานได้รับแจ้งจากผู้ประกอบการชาวไทย ซึ่งอยู่ในย่านการค้า ทำเลทองที่ทั้งคนไทยและต่างชาตินิยมไปจับจ่ายใช้สอย ว่ามีคนต่างชาติที่สงสัยว่าเข้ามาประกอบกิจการจำหน่ายอาหาร โดยจ้างคนไทยเป็นนอมินี และจ้างลูกจ้างชาวต่างชาติเป็นพนักงาน จึงจำเป็นต้องลงพื้นที่ตรวจสอบแรงงานต่างชาติทั้งหมดอย่างเข้มงวด เพื่อมิให้กระทบต่อโอกาสการมีงานทำของคนไทย และส่งผลต่อความมั่นคงและระบบเศรษฐกิจของประเทศไทย ซึ่งจากการตรวจสอบสถานประกอบการ 6 แห่ง พบสถานประกอบการกระทำความผิด 3 แห่ง คนต่างชาติกระทำความผิด จำนวน13 คน แบ่งเป็นสัญชาติจีน 2 คน เมียนมา 2 คน และพื้นที่สูง 9 คน จึงได้ควบคุมตัวส่งพนักงานสอบสวน สน. ห้วยขวาง ดำเนินคดีข้อหาเป็นคนต่างด้าวทำงานโดยไม่มีใบอนุญาตทำงาน พร้อมร้องทุกข์กล่าวโทษนายจ้างที่กระทำความผิด ซึ่งตามพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม คนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศต้นทาง รวมถึงห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี นับตั้งแต่วันที่ได้รับโทษ และนายจ้าง/สถานประกอบการที่รับคนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี
“กรมการจัดหางานจะใช้มาตรการลงพื้นที่สุ่มตรวจโดยไม่แจ้งล่วงหน้าในทุกจังหวัดอย่างเข้มงวดต่อไป จึงขอฝากไปยังผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย หรือพบคนต่างชาติลักลอบทำงานโดยผิดกฎหมาย ให้ช่วยกันเป็นหูเป็นตาแจ้งเบาะแสร้องทุกข์มาที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน อาคารกระทรวงแรงงาน ชั้น 4 โทร. 023541729 หรือที่สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน” อธิบดีกรมการจัดหางาน กล่าว

On March 28, 2023, the Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, and the Deputy Director-General of the Department of Employment, Mr. Santi Nantasuwan, led the special task force to inspect, suppress, arrest, and prosecute foreigners working illegally, and officials from the Bangkok Employment Office Area 10 to the Huay Kwang area to investigate and suppress foreigners working illegally. The inspection was in collaboration with the Suppression Inspector from Huai Khwang Police Station, Pol. Lt.Col. Iyara Akakwiphat.
The Department of Employment’s Director-General, Mr. Pairoj Chotiksetian, said that today, he inspected foreign workers in the Huay Kwang area, checking on foreigners who do not have a work permit or working beyond their rights. The inspection followed reports to the Department of Employment by Thai business operators in the area, a commercial area and a golden location for Thais and foreigners to shop. It was reported that foreigners are suspected of entering the food distribution business by employing Thai people as nominees and foreign workers as employees. Therefore, it is necessary to inspect all foreign workers in the area to not affect the job opportunities for Thai people, including the stability and economy of Thailand. From inspecting six business establishments, three were found in wrongdoing, comprising 13 workers divided into 2 Chinese nationals, 2 Myanmar nationals, and nine from highland areas. The workers were detained and sent for an investigation at the Huai Khwang Police Station to prosecute the charge of being a foreigner working without a work permit. A complaint was also filed to prosecute two employers for accepting foreigners to work without a work permit following the Foreign Worker Management Emergency Decree B.E. 2560 and its amendments. A foreigner working without a work permit or working outside their right to do so faces a fine ranging from 5,000 – 50,000 Baht, will be sent back to their country of origin, and not be allowed to apply for a work permit for two years from the date of punishment. Employers/establishments that accept foreigners who do not have a work permit or allow foreigners to work beyond their rights face a fine from 10,000 – 100,000 Baht per foreigner employed. Repeated offenses are liable to imprisonment for a term not exceeding one year or a fine ranging from 50,000 – 200,000 Baht per foreigner employed. The employer/establishment will not be allowed to employ foreigners for another three years.
