29 มี.ค.2566 – น.ส.ไตรศุลี ไตรสรณกุล รองโฆษกประจำสำนักนายกรัฐมนตรี กล่าวว่า ตามที่มีข้อร้องเรียนกรณีชาวต่างชาติได้เข้ามาทำงานเป็นมัคคุเทศก์ หรือไกด์นำเที่ยว และแย่งงานมัคคุเทศก์ชาวไทยนั้น รัฐบาลไม่ได้นิ่งนอนใจในปัญหาในเรื่องดังกล่าว พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงกลาโหม ได้กำชับไปยังหน่วยงานเกี่ยวข้อง อาทิ กระทรวงแรงงาน กระทรวงการท่องเที่ยวและกีฬา สำนักงานตำรวจแห่งชาติ ให้กระชับความร่วมมือเพื่อเร่งกวดขันและบังคับใช้กฎหมายอย่างเข้มงวดกับผู้ที่ไม่ปฏิบัติตามกฎหมายของประเทศไทย โดยเมื่อไม่นานมานี้กรมการจัดหางานได้ร่วมกับเจ้าหน้าที่ตำรวจได้ลงพื้นที่ปราบปรามและจับกุม ชาวต่างชาติซึ่งไม่มีบัตรมัคคุเทศก์ตามที่ได้มีประชาชนร้องเรียน นายกรัฐมนตรีเน้นย้ำว่าขอให้ดำเนินการให้ต่อเนื่อง ให้เห็นว่าทางการไทยจริงจังกับการกวาดล้างในเรื่องนี้ โดยที่ผ่านมารัฐบาลได้ดำเนินการทุกวิถีทางเพื่อให้คนไทยได้รับประโยชน์จากการฟื้นฟูของภาคท่องเที่ยว ดังนั้น หน่วยงานที่เกี่ยวข้องต้องดำเนินการอย่างเต็มที่เพื่อรักษางานนี้และให้มัคคุเทศก์ชาวไทยได้ประโยชน์จากการฟื้นตัวในขณะนี้เช่นกัน
น.ส.ไตรศุลี กล่าวว่า นายกฯ ยังได้มอบหมายให้หน่วยงานเกี่ยวข้อง เช่น การท่องเที่ยวแห่งประเทศไทย (ททท.) กระทรวงการต่างประเทศ ที่ได้มีการสื่อสารกับนักท่องเที่ยวต่างชาติ เร่งประชาสัมพันธ์ให้ชาวต่างชาติทราบถึงอาชีพที่เป็นอาชีพสงวนของคนไทย ห้ามต่างชาติทำ รวมถึงให้ทราบถึงโทษที่ฝ่าฝืนด้วย อย่างไรก็ตาม เกี่ยวกับการปราบปรามนี้ กำลังของเจ้าหน้าที่อาจจะไม่เพียงพอเนื่องจาก นักท่องเที่ยวรวมถึงผู้นำเที่ยวต่างๆ อาจกระจายอยู่ทั่วทุกพื้นที่ของประเทศ ดังนั้นรัฐบาลจึงขอความร่วมมือประชาชนร่วมกันเป็นหูเป็นตา และสามารถแจ้งเบาะแสแก่เจ้าหน้าได้ที่กองทะเบียนจัดหางานกลางและคุ้มครองคนหางานกรมการจัดหางาน อาคารกระทรวงแรงงานชั้น 4 โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน หรือสายด่วน 1694 กรมการจัดหางาน เพื่อมีการประสานงานหน่วยงานเกี่ยวข้องเข้าดำเนินการตามกฎหมายต่อไป
ทั้งนี้ ปัจจุบันมัคคุเทศก์หรืองานจัดนำเที่ยวเป็นอาชีพที่ผู้ประกอบวิชาชีพต้องมีสัญชาติไทยเท่านั้น เป็นงานที่ห้ามคนต่างชาติทำโดยเด็ดขาด หากฝ่าฝืนจะมีความผิดตาม พ.ร.ก.การบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม ซึ่งระบุว่าคนต่างด้าวที่ทำงานโดยไม่มีใบอนุญาตทำงานหรือทำงานนอกเหนือจากที่มีสิทธิจะทำได้ มีโทษปรับ ตั้งแต่ 5,000 – 50,000 บาท และถูกส่งกลับประเทศทันที รวมทั้งจะถูกห้ามไม่ให้ห้ามขอใบอนุญาตทำงานเป็นเวลา 2 ปี ส่วนนายจ้างหรือสถานประกอบการที่รับ คนต่างด้าวที่ไม่มีใบอนุญาตทำงานเข้าทำงาน หรือให้ คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิ มีโทษปรับตั้งแต่ 10,000 – 100,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคนหากกระทำผิดซ้ำต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000 – 200,000 บาท ต่อคนต่างด้าวที่จ้างหนึ่งคน และจะถูกห้ามจ้างคนต่างด้าวทำงานเป็นเวลา 3 ปี
March 29, 2023 – Deputy Spokesperson for the Prime Minister’s Office, Ms. Trisulee Trisoranakul, said that following complaints about foreigners working as tour guides and taking jobs from Thai guides, the government is prepared to take action. The Prime Minister and Minister of Defense, General Prayuth Chan-ocha, instructed relevant agencies, such as the Ministry of Labour, the Ministry of Tourism and Sports, and the National Police Agency, to strengthen cooperation to expedite the enforcement of laws against those who do not comply with the laws of Thailand. Recently, the Department of Employment joined forces with the police to crack down on and arrest foreigners who do not have a guide card, as reported by the people. The Prime Minister emphasized that he asked for continued action. It shows that the Thai authorities are serious about cracking down on this matter. The government has done everything possible so that Thai people can benefit from the recovery of the tourism sector. Therefore, relevant agencies must do their utmost to maintain this work so that Thai tour guides can benefit from the recovery during this time.
Ms. Trisulee said that the Prime Minister has also assigned relevant agencies, such as the Tourism Authority of Thailand (TAT) and the Ministry of Foreign Affairs, who communicates with foreign tourists, to spread awareness to foreigners about occupations that are reserved for Thai people and forbidden from foreigners, including the penalties for violations. However, the strength of the officers alone may be insufficient, as many tourists, including tour guides, may be spread across all areas of the country. Therefore, the government asks for the cooperation of the people to be the eyes and ears, and to report any suspicious activity to the officer at the Central Employment Registration and Job Seeker Protection Division, the Department of Employment, Ministry of Labour, 4th floor, call 02 354 1729 or contact the Provincial Employment Offices, the Bangkok Employment Office Area 1-10, or the Ministry of Labour’s 1506 hotline, press 2 for the Department of Employment, or call the Department of Employment’s 1694 hotline, to coordinate with relevant agencies to take further legal action.
Tourist guides or organizing tours is a profession reserved for Thai nationals only, according to the law. It is a job strictly forbidden from foreigners. Violations are offenses under the Foreign Workers Management Act B.E. 2560 and its amendments. Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. They will be banned from applying for a work permit for two years from the penalty date. Employers/business establishments who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years.
