วันที่ 23 พฤษภาคม 2567 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน กล่าวการรับรองปฏิญญาร่วมแรงงานว่าด้วยการเคลื่อนย้ายสิทธิประกันสังคมแรงงานข้ามชาติในกลุ่มประเทศ CLMTV ในการประชุมระดับรัฐมนตรีแรงงาน ครั้งที่ 4 โดยมี นายไพโรจน์ โชติกเสถียร ปลัดกระทรวงแรงงาน นายสมาสภ์ ปัทมะสุคนธ์ ผู้ตรวจราชการกระทรวงแรงงาน นายศักดินาถ สนธิศักดิ์โยธิน ผู้ช่วยปลัดกระทรวงแรงงาน พร้อมด้วยผู้บริหารระดับสูงกระทรวงแรงงาน และหน่วยงานที่เกี่ยวข้องเข้าร่วม ณ ห้องประชุมประสงค์ รณะนันทน์ ชั้น 5 อาคารกระทรวงแรงงาน และการประชุมผ่านระบบทางไกล
นายพิพัฒน์ กล่าวว่า หัวข้อในปีนี้ มุ่งเน้นการเชื่อมโยงสิทธิประกันสังคมสำหรับแรงงานข้ามชาติ ในกลุ่มประเทศ CLMTV เมื่อกล่าวถึงประเด็นการเคลื่อนย้ายถิ่นของแรงงานข้ามชาติ ทั้งแรงงานที่เดินทาง ออกจากประเทศต้นทาง และแรงงานข้ามชาติที่เข้ามาทำงานในประเทศปลายทาง อาจส่งผลให้แรงงานขาดการเข้าถึงความคุ้มครองจากระบบประกันสังคม เนื่องจากข้อจำกัดที่แตกต่างกัน ในแต่ละประเทศ ประเทศไทย โดยกระทรวงแรงงาน ให้ความคุ้มครองด้านการประกันสังคม สำหรับแรงงานข้ามชาติทุกคนอย่างเท่าเทียม โดยไม่มีการเลือกปฏิบัติตามหลักสิทธิมนุษยชนสากล และมาตรฐานแรงงานระหว่างประเทศ อย่างเช่น ในเหตุการณ์การแพร่ระบาดของโรคโควิด – 19 ทางเรา ก็ได้ให้วัคซีนแก่แรงงานข้ามชาติทุกคน และการคุ้มครองที่เท่าเทียมกัน ปัจจุบัน มีผู้ประกันตนข้ามชาติ 1.43 ล้านคน ซึ่งส่วนใหญ่ มาจากกลุ่มประเทศ CLMV จำนวน 1.31 ล้านคน
นายพิพัฒน์ กล่าวต่อว่า ผมเห็นด้วยในหลักการ ต่อร่างปฏิญญารัฐมนตรีแรงงาน ว่าด้วยการเชื่อมโยงสิทธิประกันสังคมสำหรับแรงงานข้ามชาติในกลุ่มประเทศ CLMTV ที่จะส่งเสริมให้แรงงานข้ามชาติ เข้าถึงสิทธิประกันสังคมได้อย่างมีประสิทธิภาพ สำหรับการดำเนินงานของไทย เพื่อรับรองปฏิญญาระหว่างประเทศ จำเป็นต้องนำเสนอเข้าสู่การพิจารณาของคณะรัฐมนตรี เพื่อขอความเห็นชอบก่อน ซึ่งหากเราได้ร่วมกันพิจารณาร่างปฏิญญาฯ อย่างถี่ถ้วนเรียบร้อยแล้ว ผมยินดีที่จะผลักดันร่างปฏิญญาฉบับนี้อย่างเต็มที่ นอกเหนือจากนี้ ประเทศไทยยินดีเป็นเจ้าภาพจัดการประชุม CLMTV ในครั้งต่อไป
ด้าน นายไพโรจน์ โชติกเสถียร ปลัดกระทรวงแรงงาน แสดงความเห็นว่า การแสดงเจตจำนงร่วมกันของรัฐมนตรีแรงงานในกลุ่มประเทศ CLMTV จะเป็นก้าวสำคัญที่จะหาแนวทางความเป็นไปได้สำหรับความร่วมมือ และการประสานงานด้านการเชื่อมโยงสิทธิประโยชน์ประกันสังคมสำหรับแรงงานข้ามชาติระหว่างกันต่อไป
On May 23, 2024, the Labour Minister, Mr. Phiphat Ratchakitprakarn, spoke of the approval of the Joint Labour Declaration on the mobilization of social security rights for migrant workers in the CLMTV countries at the fourth Labour Ministerial Meeting. The Permanent Secretary of Labour, Mr. Pairoj Chotikasathien, the Ministry of Labour’s Inspector-General, Mr. Samat Pattamasukon, the Assistant to the Permanent Secretary of Labour, Mr. Sakdinart Sonthisakyotin, the Ministry of Labour’s executives and related agencies participated at the Prasong Rananant meeting room, 5th floor, Ministry of Labour, and via video conferencing.
Mr. Phiphat said that this year’s topic focuses on linking social security rights for migrant workers in the CLMTV group of countries. The migration of migrant workers, both leaving the country of origin and migrant workers coming to work in the destination country, may result in workers lacking access to social security protection due to different limitations in each country. Thailand, by the Ministry of Labour, provides social security protection for all migrant workers, equally, without discrimination, and according to international human rights principles and international labour standards. For example, during the COVID-19 outbreak, vaccines were provided to all migrant workers, with equal protection. Currently, there are 1.43 million foreign-insured persons, 1.31 million of whom are from CLMV countries.
Mr. Phiphat continued that he agrees, in principle, with the draft Declaration of the Minister of Labour concerning the mobilization of social security rights for migrant workers in CLMTV countries, which will promote migrant workers to have efficient access to social security rights. In order for Thailand to adopt international declarations, such proposals must be submitted to the Cabinet for consideration and approval. Once the draft declaration is reviewed thoroughly, he would be pleased to push this draft declaration forward. In addition to this, Thailand is proud to host the next CLMTV meeting.
The Permanent Secretary of Labour, Mr. Pairoj Chotikasathien, expressed his opinion that The joint commitment of Labour Ministers in CLMTV countries will be an essential step towards finding possible avenues for cooperation and further coordination in linking social security benefits for migrant workers between each other.
