นายภูมิพัฒน์ เหมือนจันทร์ โฆษกกระทรวงแรงงาน เปิดเผยว่า นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน รับทราบปัญหาความเดือดร้อนของผู้ประกอบอาชีพไรเดอร์ที่มีอยู่กว่า 500,000 คนทั่วประเทศ ที่ได้ร้องเรียนผ่านสมาคมไรเดอร์มายังกระทรวงแรงงาน เช่น ค่ารอบที่ไม่เท่ากันของแต่ละแพลตฟอร์ม สัญญาของบริษัทแพลตฟอร์มที่ไม่เป็นธรรม การถูกปิดระบบรับงาน และยังขอให้ออกกฎหมายคุ้มครองอาชีพไรเดอร์ ซึ่งที่ผ่านมากรมสวัสดิการและคุ้มครองแรงงานได้เชิญผู้แทนบริษัทแพลตฟอร์มต่าง ๆ มาพูดคุยเพื่อเปิดช่องทางการร้องเรียนให้กับไรเดอร์ผ่านแอปพลิเคชัน รวมทั้งเจรจากับบริษัทให้เปิดระบบรับงานในกรณีที่ถูกปิดระบบด้วย
สำหรับการผลักดันกฎหมายคุ้มครองไรเดอร์นั้น ถือเป็นมิติใหม่ที่กระทรวงแรงงานได้เร่งผลักดันร่าง พ.ร.บ.ส่งเสริมและคุ้มครองแรงงานอิสระ พ.ศ. …ให้เข้าสู่การพิจารณาของสภาผู้แทนราษฎรโดยเร็ว ซึ่งร่างกฎหมายนี้มีบทบัญญัติที่จะคุ้มครองและส่งเสริมผู้ประกอบอาชีพไรเดอร์ด้วย ส่วนปัญหาค่ารอบและสัญญาที่ไม่เป็นธรรมนั้น กรมสวัสดิการและคุ้มครองแรงงานได้หารือกับสำนักงานพัฒนาธุรกรรมทางอิเล็กทรอนิกส์ (ETDA) ซึ่งเป็นหน่วยงานที่ดูแลกฎหมายเกี่ยวกับการประกอบธุรกิจบนแพลตฟอร์มดิจิทัล โดยจะเสนอตั้งคณะอนุกรรมการเพื่อศึกษาแนวทางการแก้ไขปัญหาการลดค่ารอบ สัญญาและเงื่อนไขต่าง ๆ ที่บริษัทกำหนดขึ้นโดยไม่เป็นธรรม ซึ่งจะมีผู้แทนจากสมาคมไรเดอร์ไทยร่วมเป็นคณะทำงานด้วย
“ท่านพิพัฒน์ห่วงใยพี่น้องไรเดอร์ทุกคน โดยกำชับให้หน่วยงานของกระทรวงแรงงานทั้งในส่วนกลางและส่วนภูมิภาคเป็นคนกลางรับเรื่องร้องเรียนต่าง ๆ เพื่อนำมาเข้ามาแก้ไข พร้อมทั้งเชิญชวนให้ไรเดอร์สมัครเป็นผู้ประกันตนตามมาตรา 40 ซึ่งเป็นระบบประกันสังคมภาคสมัครใจ ที่จะช่วยบรรเทาความเดือดร้อนหากเกิดอุบัติเหตุถึงขั้นหยุดงานและสูญเสียรายได้ หรือเสียชีวิต” นายภูมิพัฒน์ กล่าว
The Ministry of Labour’s Spokesperson, Mr. Phumiphat Mueanchan, said that the Labour Minister, Mr. Phiphat Ratchakitprakarn, acknowledged the issue where over 500,000 riders across the country have filed complaints through the Rider Association to the Ministry of Labour. The complaints include unequal trip fees among platforms, unfair contracts from platform companies, and the job-receiving system being shut down. They also requested legislation to protect riders. In the past, the Department of Labour Protection and Welfare invited representatives of various platform companies to talk to open a complaint channel for riders through the application. They also discussed opening the system to accept work with the companies in the event that the system is closed.
Pushing for the law to protect riders is considered a new dimension that the Ministry of Labour has rushed to push forward the draft Independent Working Promotion and Protection Act, B.E…. to be considered by the House of Representatives. This draft law has provisions to protect and promote those who work as riders. As for the problem of round fees and unfair contracts, the Department of Labour Protection and Welfare has discussed this with the Electronic Transactions Development Agency (ETDA), which oversees laws regarding conducting business on digital platforms. A proposal will be put forth to set up a subcommittee to study ways to solve the issue of reducing trip fees and various contracts and conditions set by companies that are deemed unfair. Representatives from the Thai Rider Association will join the working group.
“Mr. Phiphat cares about all my riders. He has instructed the agencies of the Ministry of Labour, in both central and provincial regions, to act as mediators to receive complaints and surface them for resolution. He has invited riders to apply to become insured under Section 40, which is a voluntary social security system that will help relieve suffering if an accident occurs, causing work to stop and a loss of income, or in the case of death,” Mr. Phumiphat said.
